Opis:: The article presents the problem of the right of pre-emption of agricultural real property and attempt to answer the question whether it was justified for the legislator to introduce a right which limits an attribute of an owner, such as the right of asset disposal. The statutory right of pre-emption of agricultural property has been regulated in different legal acts and entitle to the lessee, the Agricultural Property Agency and the co-owner. The article also discusses issues concerning the exercise of the right of pre-emption and problems concerning the concurrence of the right of pre-emption from the Act on the establishment of the agrarian system with other cases of the statutory right of pre-emption. In Authors opinion the fact that the right of pre-emption of agricultural property to the lessee and co-owner has to be considered as positive, but some conditions should be change. It is also necessary to change the provisions of the Act of 11 April 2003 on the establishment of the agrarian system concerning the right of pre-emption of the Agricultural Property Agency The objective scope of the application of the right of pre-emption (re-demption) is too wide.
W artykule przedstawiono problematykę prawa pierwokupu nieruchomości rolnych oraz podjęto próbę odpowiedzi na pytanie, czy słuszne było wprowadzenie przez ustawodawcę prawa, które ogranicza atrybut właściciela, jakim jest uprawnienie do swobodnego rozporządzania rzeczą. Prawo pierwokupu nieruchomości rolnych jest uregulowane w różnych ustawach i przysługuje dzierżawcy, Agencji Nieruchomości Rolnych oraz współwłaścicielowi. Artykuł porusza także kwestie dotyczące wykonania prawa pierwokupu oraz problematykę zbiegu prawa pierwokupu z ustawy o kształtowaniu ustroju rolnego z innymi przypadkami ustawowego prawa pierwokupu. Zdaniem Autorów, należy pozytywnie ocenić przyznanie prawa pierwokupu nieruchomości rolnych dzierżawcy oraz współwłaścicielowi. Jeżeli chodzi o prawo pierwokupu Agencji Nieruchomości Rolnych, to wydaje się konieczna zmiana przepisów ustawy z dnia 11 kwietnia 2003 roku o kształtowaniu ustroju rolnego [Ustawa... 2003]. Zakres przedmiotowy zastosowania prawa pierwokupu (wykupu) jest zbyt szeroki.

Opis:: Conceptualisation of multifunctional agriculture in Dutch policy and research has to be understood within the typical Dutch context and can be related to different perspectives of agriculture and the rural area. The Netherlands is a densely populated country with a very produc-tive agricultural sector, exporting most of its production. Limited space, the needs for and side-effects of agricultural modernisation and increasing societal demands towards food and the rural area have since long set the debate.
Koncepcja przeprowadzonych badań opiera się na założeniu, że wielofunkcyjność rolnictwa w holenderskiej polityce i badaniach należy rozpatrywać w odniesieniu do specyfiki rolnictwa holenderskiego. W Holandii koncepcja wielofunkcyjności pojawiła się w latach siedemdziesiątych wraz z problemami wywołanymi negatywnymi skutkami intensyfikacji rolnictwa. Dalszy rozwój w latach osiemdziesiątych i dziewięćdziesiątych przyczynił się do rozszerzenia koncepcji wielofunkcyjności i określenia definicji: "rolnictwo szerszych celów", rolnictwo alternatywne, zintegrowane rolnictwo i zróżnicowane rolnictwo. Wielofunkcyjność rolnictwa oceniono z uwzględnieniem jego udziału w zrównoważonym rozwoju obszarów wiejskich. Obecnie zrównoważony rozwój obszarów w większym stopniu niż koncepcja wielofunkcyjności koncentruje uwagę zarówno polityków, jak i badaczy w Holandii.

Opis:: Prior to the year 1970, agriculture was the main source of livelihood and backbone of the Nigerian economy until the discovery of oil drastically decelerated its potential to sustainably maintain food security and generate significant export earnings. Despite its sudden fall in productivity, agriculture still remains the main sector providing the highest employment (70% of the population) for the populace. To tackle these problems, many policies were formulated (from 1960 to 2015) to resuscitate the sector but to no availdue to failure in tailoring suitable policies to engage small-scale farmers and address other socio-economic problems. This paper constitutes an in-depth review of agricultural production and food security in Nigeria with relative importance attributed to local food supply and small-scale farmers. The article analyzes several documents of the Nigerian Government and international organizations, such as the Food and Agricultural Organization, the National Bureau of Statistics (NBS), Department of Agriculture and Rural Development and a number of peer-reviewed journals across various disciplines to provide a balanced inter[1]disciplinary review. The paper concludes that food insecurity is at its peak in Nigeria and urgent attention is required in the agricultural sector to compensate for the unstable food balance in the country. There is a need for the Government to take strong measures against the food deficit situation and to support the development of the primary agriculture sector. The paper pro[1]poses viable policies that could involve smallholders, aid transformation and positively restructure the agricultural sector.

Opis:: A review of the Spanish literature on agricultural multifunctionality shows that it has mostly centred on analysing the wide range of functions displayed by agriculture, paying a special attention to the protection of biodiversity and the environmental functions. The Spanish debate on the conceptual and strategic ? in terms of policy reform and international trade negotiations ? aspects of multifunctionality has been comparatively scarce. Research oriented to provide alterna-tives to a monofunctional or productivistic view of farming has come mainly under the general heading of rural development.
Celem artykułu był przegląd hiszpańskiej literatury dotyczącej wielofunkcyjności rolnictwa i obszarów wiejskich. W rezultacie wykazano, że w większości koncepcje wielofunkcyjności koncentrują się na analizie możliwości poszerzenia zakresu funkcji rolnictwa. Szczególną uwagę zwraca się na ochronę bioróżnorodności i środowiskowe funkcje rolnictwa. W artykule zanalizowano także koncepcje wielofunkcyjności w odniesieniu do politycznych reform i międzynarodowych negocjacji handlowych. Jednocześnie wykazano, że głównym nurtem badań odnoszących się do rozwoju obszarów wiejskich jest określenie alternatywy dla monofunkcyjności tych obszarów lub produkcyjnego profilu rolnictwa.

Opis:: Downward tendency in potato production in the years 1980-1998 was a result of the declining of area of agricultural land and fluctuation in the crop production issued from the variation of the yields. The main reasons for reducing of a potato sown area include a decrease in the competitiveness of potatoes as a fodder, changes in the collectivized agriculture sector and the reduction in demand for potatoes from the processing industry.
Celem niniejszego opracowania było określenie i analiza trendów zachodzących w produkcji ziemniaków w Polsce oraz porównanie tych zmian ze zmianami zachodzącymi w wybranych krajach UE. Zakres czasowy analizy obejmował lata 1989-1998.

W wyniku przemian zachodzących w rosyjskim rolnictwie pojawiły się w Rosji wielkoobszarowe przedsiębiorstwa rolnicze. Aby nimi zarządzać, muszą być wdrożone nowe praktyki. Znacznym ułatwieniem w prowadzeniu przedsiębiorstw rolniczych może być dobry system zarządzania informacją. Autor proponuje przykładowy model takiego systemu.

Opis:: There are low levels of farm mechanization in South Africa despite government efforts to improve access to infrastructure and finance through the Comprehensive Agricultural Support Programme (CASP). The objective of this study is to assess the levels of mechanisation in the emerging sector and the determinants thereof. The sample size consisted of 163 randomly selected maize and sunflower emerging farmers in North West Province. Data was collected using a structured questionnaire. Descriptive statistics were used to assess level of mechanization and the Tobit regression model was used to analyze factors that influence usage of farm machinery. The study revealed that variables including land tenure (p < 0.05), financial assistance (p < 0.01), access to loans (p < 0.05), and accessibility to road infrastructure (p < 0.01) positively influenced usage of mechanization. In addition, the variable age (p < 0.01) had a negative statistically significant influence on farm mechanization. Based on the results of this study, it is recommended that the government should consider scaling up the CASP to finance more farmers and review its land reform policy to ensure ownership of land to more young smallholder farmers who can use mechanization services for efficient agricultural production.

Opis:: Despite the fact that multifunctionality and sustainability are guiding principles of Swiss agricultural policy, the number of contributions from Swiss academics to the literature on multifunctionality is small. However, the quality of these contributions is quite high, as they generally address the comprehensiveness of the concept as well as the context in which agricul-ture is positioned. Moreover, the review of existing literature reveals a lack of analyses that inves-tigate the relationship between the concepts of multifunctionality and sustainability, or sustainable development.
W artykule przedstawiono wyniki badań nad koncepcjami wielofunkcyjności rolnictwa i obszarów wiejskich w Szwajcarii. Na podstawie badań można stwierdzić, że pomimo określenia wielofunkcyjności i zrównoważenia jako priorytetów szwajcarskiej polityki rolnej, badania szwajcarskich naukowców związane z wielofunkcyjnością są realizowane w niewielkim zakresie. Dotychczasowe badania odnoszą się do koncepcji wielofunkcyjności w innych krajach Europy i charakteryzuje je wysoka jakość. Przegląd dostępnej literatury ujawnia brak analiz, które przedstawiają relacje między koncepcjami wielofunkcyjności, zrównoważenia i zrównoważonego rozwoju.

Opis:: This study seeks to analyse the process of rural areas policy development in Poland. In this sense, various approaches towards multifunctional rural development within the scientific arena are presented. In Poland, the concept of multifunctionality of rural areas occurred at the beginning of the 1990?s as a result of political system transformation. The research conducted so far points to the definitions of multifunctionality of rural areas as referring to non-agricultural activities of the rural community.
Celem artykułu było zanalizowanie koncepcji wielofunkcyjnego rozwoju rolnictwa i obszarów wiejskich. Przeprowadzone badania określiły kierunki rozwoju polityki obszarów wiejskich w Polsce. Jednocześnie przedstawiono różne podejścia badawcze dotyczące wielofunkcyjnego rozwoju obszarów wiejskich. W Polsce zwarte koncepcje wielofunkcyjności rolnictwa i obszarów wiejskich pojawiły się na początku lat dziewięćdziesiątych w rezultacie transformacji systemu politycznego i dążenia do integracji z Unią Europejską. Przeprowadzone dotychczas w Polsce badania wskazują, że wielofunkcyjność jest definiowana przede wszystkim w odniesieniu do rozwoju pozarolniczej aktywności społeczności wiejskiej.

Opis:: The research work on multifunctionality in France is being carried on by a variety of epistemologic communities, with a wide range of research questions and methods. The purpose of this state of the art report is to identify these communities, their different uses of the concept of multifunctionality, and the types of agriculture it refers to. The functions to be promoted and the way to enhance them can be related to the theoretical framework used. Six main types of epis-temic communities are identified in the French literature, which highlight a common view on the functions of agriculture, and the scientific approach. Some research gaps in the French literature are suggested. The way to convert the principles of multifunctionality or the principles of sustain-able development into farm policy principles in particular is a matter of interest. More empirical research is also needed to characterize multifunctionality, including divergent perceptions and valuations by different stakeholder groups.
Badania dotyczące wielofunkcyjności we Francji są prowadzone przez różne grupy badawcze w szerokim zakresie analitycznym i metodycznym. Celem artykułu było zidentyfikowanie tych grup, zdefiniowanie różnic pomiędzy koncepcjami w odniesieniu do typu rolnictwa. Funkcje przypisywane koncepcji wielofunkcyjności nawiązują do teoretycznych podstaw. W badaniach zidentyfikowano sześć głównych nurtów badawczych realizowanych we Francji, jednocześnie wskazano na obszary badawcze wymagające dalszych badań. Dodatkowo określono zakres implementacji idei wielofunkcyjności lub zrównoważonego rozwoju polityki rolnej.

Opis:: This article aims at presenting the agricultural aspect of ongoing negotiations in the scoupe of the Doha Round. In this paper are set out interests and positions of the most important groups of countries in WTO and key pillars of agriculture negotiations.
Negocjacje liberalizujące handel światowy w zakresu rolnictwa w ramach obecnej Rundy Doha koncentrują się na trzech obszarach tematycznych: dostępu do rynku, wsparcia wewnętrznego i konkurencji eksportowej. Kluczowych uczestników tych rokowań można zaklasyfikować w kilka ugrupowań w zależności od postulowanego stopnia otwarcia sektora agrarnego. Do najważniejszych uczestników rokowań należy zaliczyć takie państwa, jak: USA, UE, Brazylię i Indie i to właśnie od uzgodnień tych krajów będzie zależał stopień przyszłej liberalizacji handlu światowego artykułami rolnymi. KE przedstawiła swoje postulaty negocjacyjne w ofercie złożonej 28 października 2005 roku. Największy zakres możliwych do akceptacji ustępstw dotyczy pierwszego filaru negocjacji, z kolei możliwość liberalizacji instrumentów wsparcia eksportu jest najbardziej warunkowa. Ponieważ przyszłe zobowiązania przyjęte przez KE będą wywierać bezpośredni wpływ na warunki funkcjonowania rolnictwa w Polsce, jest konieczne, aby KE zachowała możliwość stosowania środków ochronnych w rolnictwie, takich jak klauzula SSG. Interes gospodarczy Polski wymaga również modyfikacji przez KE listy towarów wrażliwych, tak aby w większym stopniu odzwierciedlała ona produkty rolne cenne dla gospodarki Polski, takie jak: mięso wołowe, wieprzowe, cukier, mleko i produkty mleczne, niektóre owoce i warzywa. Dodatkowo Polska powinna zwiększyć działania promujące jakość i wyjątkowość polskich produktów tradycyjnych i regionalnych. Jest to niezwykle istotne, gdyż w wyniku działań liberalizujących handlu należy oczekiwać zwiększonego napływu towarów rolno-spożywczych z krajów trzecich bez możliwości uzyskania przez Polskę analogicznej rekompensaty. Komitet 133 jest bardzo dobrym miejscem, na forum którego Polska może prezentować swoje kluczowe postulaty chroniące sektor rolny. Poza tym Polska może zabiegać o poparcie dla swojej pozycji wśród krajów, w których sektor agrarny odgrywa równie istotną rolę, jak Francja i Irlandia.

Opis:: The article makes an attempt to determine whether the legal regulations provide a perpetual lessee with, first of all, stable conditions to hold agricultural lands and to run a business activity on these lands and, second of all, whether the regulations make it easier for perpetual lessees to acquire the right to own the lands they possess. The first part of the article concentrates on the legal nature of perpetual usufruct as well as the rights and financial obligations of a perpetual lessee. Then, the paper focuses on the transformation of perpetual usufruct into the right of ownership and the expiry of perpetual usufruct. Next, the article analyses the issue of a perpetual lessee as an agricultural producer. At the end, the Author states that perpetual lessee possesses a wide range of rights and can freely run an agricultural activity on agricultural lands. The legislator has acknowledged perpetual usufruct, along with the most popular forms of holding lands such as ownership and lease, to be a stable element of rural relations. Thus, a perpetual lessee can be granted the European funds, agricultural tax reliefs and insurance in KRUS.
Celem artykułu była próba ustalenia, czy regulacje prawne zapewniają użytkownikom wieczystym stabilne warunki władania gruntami rolnymi oraz prowadzenia na nich działalności rolniczej, a także, czy ułatwiają tym podmiotom nabycie własności posiadanych gruntów. W pierwszej kolejności rozważania skupiały się na charakterze prawnym użytkowania wieczystego oraz uprawnieniach i obowiązkach finansowych użytkownika wieczystego. Następnie podjęto tematykę przekształcania użytkowania wieczystego we własność oraz wygaśnięcia użytkowania wieczystego. Kolejna część artykułu odnosiła się do zagadnienia użytkownik wieczysty jako producent rolny. W podsumowaniu stwierdzono, że rozważania wykazały, iż użytkownik wieczysty ma szeroki zakres uprawnień i może on swobodnie prowadzić działalność rolniczą na gruntach rolnych. Ustawodawca uznał bowiem, że użytkowanie wieczyste, obok najpopularniejszych form władania gruntami rolnymi, jak własność i dzierżawa, wpisało się trwale w stosunki wiejskie i dlatego użytkownik wieczysty może korzystać ze środków unijnych, ulg w podatku rolnym czy ubezpieczenia w KRUS.
