    Opis:
    The liturgy of the Church is an expression of his life with Christ, it uses natural signs such as: wine, water, light, fire, smoke, oil, salt, and ash. It is through Christ, that they are given new meaning. This meaning is to glorify God and sanctify man. The sacramental ordinances are determined by ecclesiastical law which follows the nature and life of the Church. The ordinances of the Church, through the visible, direct us to the invisible. Behind what is visible there is no action or God's grace. These signs of God's presence are symbols, which St. Augustine calls the encounter between God and man in the world of signs and symbols, a Sacrament. The sacraments of the Church are graces given by God to man for his sanctification. In sacramental rites, the Church can change form, but never in essence and matter. The matter of the sacrament of marriage is between a woman and a man. The rites of the sacrament of marriage, were announced in 1969, are used in Poland, however, it has been adapted to the new Code of Canon Law of 1983. Jesus instituted the sacrament of marriage. Marriage should be celebrated at Holy Mass and is characterized by unity and indissolubility. During the rites of the sacrament of marriage, the Church then asks what is the will of the person is for getting married. The couple then join their right hands and place the wedding rings on each other’s ring finger. The effects of the sacrament of marriage, which express the Rites of the Sacrament of Marriage, are: marriage community, grace and family. The liturgy with the sacrament of marriage speaks of the sanctity of marriage through the beauty of its celebration.

    Opis:
    Two of few elements which have an influence on validity of the sacraments administration are the matter and form. The most important is the fact if they were defined directly by the very Jesus Christ and they are in the deposit of revelation. Otherwise, they are defined by the Church, which specifies them by means of canonical and liturgical law, the conditions for a sacrament to be valid. The gesture of a minister of a sacrament is the matter of a given one, which is necessary for validity of an act and for receiving a sacramental grace, while the words spoken by him during the celebration of a sacrament (that is a sacramental formula), included in the liturgical books, constitute the form. But is a problem with sacrament of marriage. The matter and form of such sacrament are different in the Roman catholic and orthodox Churches. In the first of those the matter is matrimonial consent. It is an act of will by which a man and a woman by an irrevocable covenant mutually give and accept one another for the purpose of establishing a marriage. The form is formula of consent. In the orthodox Church the matter is priest’s or bishop’s blessing, and the form is formula of such blessing. This article shows history of the matter and form of those sacrament and various problems relative this questions.

    The sacrament of penance and reconciliation constitutes an integral part of the Christian life. It restores the state of sanctifying grace lost by man as a result of mortal sin. Confession also plays a major role in the preparation of prospective spouses for being joined in the sacrament of matrimony. No mandatory duty is imposed at this point by the legislation yet the sacrament of penance is strongly recommended before the holy matrimony takes place in order to render it more fruitful. The priest preparing the prospective spouses for the holy matrimony is obliged to raise the question of premarital confession and be of help should the need arise.The confessor of the prospective spouses should be characterised by appropriate spiritual and intellectual formation. He should demonstrate particular tactfulness and thoughtfulness when asking questions, especially those concerning premarital sex. The minister’s teaching ought to result in providing positive guidelines for the future married life.The prospective spouses are supposed to fulfill all the acts of the penitent: repentance, disclosure of sins and reparation. A careful examination of conscience is yet another significant component paving the way for a good confession and fruitful matrimony.

    Dla zapobieżenia nieważnemu i niegodziwemu zawieraniu małżeństw, narzeczeni przed wyrażeniem zgody małżeńskiej w Kościele katolickim na terenie Polski egzaminowani są zgodnie z normami promulgowanymi przez Konferencję Episkopatu Polski w Dekrecie ogólnym o przeprowadzaniu rozmów kanoniczno-duszpasterskich z narzeczonymi przed zawarciem małżeństwa kanonicznego z dn. 8 października 2019 roku W niniejszym artykule autor przeanalizował przepisy ogłoszone w przedmiotowym dekrecie pod kątem realizacji prawa nupturientów do zachowania własnej intymności i dobrego imienia. Ponadto wskazał duchownym przeprowadzającym egzamin przedślubny możliwe działania (w tym nieuregulowane wprost w obowiązującym prawie partykularnym), które pozwalają skuteczniej zabezpieczyć prawa nupturientów zapisane w kan. 220 KPK/83 wtedy, gdy podlegają one ograniczeniu ze względu na dobro wspólne, ius connubii przyszłych małżonków oraz obowiązek spoczywający na duszpasterzu rozeznającym zdatność nupturientów do zawarcia małżeństwa (kan. 1066-1067 KPK/83). Autor zaproponował również możliwe sposoby postępowania osób przeprowadzających egzamin, kiedy realizacja wspomnianych praw i obowiązków w trakcie spisywania protokołu przedślubnego zdaje się być nie do pogodzenia.
    Under the provisions of the General Decree of 8 October 2019 promulgated by the Conference of the Bishops of Poland, couples intending to marry in the Roman Catho- lic Church on the territory of the Republic of Poland are required to attend a premarital canonical and pastoral interview. This is done to prevent the invalid or illicit administration of the Sacrament of Matrimony. This article discusses the provisions of the Decree as regards the protection of couples’ right to privacy and a good reputation. It also offers priests conducting the premarital interview a series of suggestions (including courses of action not formally regulated in the particular provisions currently in force) affording a more effective means of protection for the rights of engaged couples as defined in Canon 220 of the Code of Canon Law of 1983, in situations when these rights may be restricted subject to the common good, the couple’s right to contract marriage (ius connubii), and the duties incumbent on the priest who is to determine whether they may contract a valid marriage under (can. 1066-1067). This is supplemented with a set of procedures the priest may decide to follow if he considers the proper performance of his duties as required by Canon Law may be incompatible with the full observation of the couple’s rights, and anticipates that he will have serious problems with drawing up a lawful and accurate premarital assessment report.     Der Artikel stellt die Problematik des Beitritts der Bräutigame zum Sakrament der Buße und der Heiligsten Eucharistie vor als Bedingung der fruchtbringenden Annahme des Ehesakraments. Zuerst stellte man die enge Verbindung von Buße und Eucharistie mit der Annahme des Ehesakraments vor. Wiederum zeigte man die dringende Empfehlung des Beitritts der Brautleute zur Beichte und zum Heiligen Abendmahl im Kodex des Kanonischen Rechtes aus dem Jahre 1983, um sich endlich auf der besprochenen Problematik zu konzentrieren, wie sie sich in den Vorschriften polnischer Kirchenversammlungen offenbart, die nach dem Jahre 1983 stattgefunden haben.

    Mając na uwadze występującą niekiedy tendencję do oddzielania wiary od życia sakramentalnego, Papieska Komisja Teologiczna dnia 3 marca 2020 roku wydała dokument zatytułowany Reciprocità tra fede e sacramenti nell’economia sacramentale. Jego celem jest dostarczenie ogólnych wskazówek, które mogą być przydatne dla duszpasterzy. Czwarty rozdział dokumentu poświęcony jest zagadnieniu relacji wiara – sakrament małżeństwa chrześcijańskiego. Rozdział ten obejmuje trzy punkty: 1) Sakrament małżeństwa; 2) Kwestia wątpliwa: sakramentalny przymiot małżeństwa „ochrzczonych niewierzących”; 3) Intencja i ustanowienie węzła małżeńskiego w przypadku braku wiary. Rozdział ten autor prezentuje i komentuje.
    Bearing in mind the sometimes tendency to separate faith from sacramental life, on March 3, 2020, the Pontifical Theological Commission issued a document entitled Reciprocità tra fede e sacramenti nell’economia sacramentale. Its purpose is to provide general guidelines that may be useful for pastors. The fourth chapter of the document is devoted to the problem of the faith-sacrament relationship of Christian marriage. This chapter covers three points: 1) The Sacrament of Matrimony; 2) Doubtful point: the sacramental quality of marriage to “baptized non-believers”; 3) Intention and establishment of a marriage bond in the event of lack of faith. The author presents and comments on this chapter.

    Der Artikel “Die Annahmepflicht des Firmungsakraments von Neuvermählten” ist eine Interpretationsprobe (Kanon 1065 § 1).Zuerst hat man die wesentliche Rolle der Firmung im Leben des Ehepaars akzentuiert, dann hat man die Annahmepflicht dieses Sakraments von den Gläubigen hervorgehoben, um endlich bedingte Annahmepflicht des Firmungssakraments von den Neuvermählten zu zeigen, was der Kanon 1065 § 1 reguliert.Anhand der Gesamtheit von Überlegungen sieht man die Sorge des Gesetzgebers um das volle christliche Einweihen des Ehepaars, obwohl er andererseits keine neue Hindernisse fur die Verwirklichung des Rechtes zur Eheschließung schaffen will, wenn eine ernste Schwierigkeit der Firmungannahme vor der Trauung erscheint.

    Opis:
    In the presented study the Author commented on the judgment of the Roman Rota c. Bottone of 2 February 2010. The analysis shows that the legal part of the rotal judgment was based on the general theory of a legal act. In the factual part ponens accumulated two titles exclusion of the good of the sacrament and exclusion of the good of faith. The invalidity of the marriage was proven using indirect proof. In the present case, it has been shown that what prompted the defendant to take such a step was the fact that even before the marriage she had maintained a relationship with another man. It was also proved that the plaintiff's exclusion of offspring was in close connection with the defendant's change of attitude towards him.
