    Opis:
    Pope Francis, speaking on November 8, 2013 to the members of the Supreme Tribunal of the Apostolic Signatura, returned to the issue reiterated for years – namely to emphasise the role of the defender of the bond in a process. Based on this speech many important issues appear, such as a pastoral good of parties and bound up with it the principle of truth, the role of the defender of the bond in safeguard of this truth and reciprocal relationship between the defender and a judge. It shows that evangelistic activity of the Church is indissolubly connected with the ecclesial administration of justice and that in ecclesiastical courts it is necessary to always have an icon of the Good Shepherd before eyes, which first of all is a righteous Shepherd.

    The article analyses role of the defender marital knot in the cases of declaration of the nullity of a marriage. The basic question is: what is the place in the process, what is the rights and obligations of the defender marital knot? Is he defends the validity of marriage at all costs? Benedict XIV’s Constitution Dei miseratione and the Code of Canon Law from the year 1917 give that basic obligation of the defender is defense of marriage. Later this concept evolved. In the Code of Canon Law from the year 1983 we have following meaning. The defender defends the validity of marriage, but not at all costs. This defense must be rational. We have also this statement in the process’s instruction Dignitas connubii. In conclusion, Author stats that  efender defends the validity of marriage with regard to the truth.

    Opis:
    The right to appeal resulting from natural justice serves to guarantee a fair judgment. Also after the reform of the marriage process carried out by Pope Francis in 2015, the appeal remains the primary appeal, which can be used by the private and public parties involved in the case. This article discusses the norms and principles that should be maintained when an appeal in the ordinary trial for nullity of marriage is made by the defender of the bond. His public office not only authorizes him, but in certain conditions also obliges him to use the institution of appeal. After presenting the legal basis of the law and the duty of the defender of the bond to appeal, the procedure of its submission, the applicable time limits and the nature of the justification that must take place after filing the appeal are discussed. In the last part, the reflection concerns problematic issues associated with the application of the new norm contained in can. 1680 KPK standards, the judges’ attitude towards the application and the court costs incurred in connection with the submission of an appeal.

    Opis:
    The application for appeal against the judgment is also possible in the so-called processus brevior, a shortened form of the trial for the nullity of marriage, which takes place before the bishop. It is obvious that the economy of the shortened process can not be in contradiction with the fundamental right to a just judgment and its challenge if the party does not consider it so. Despite the postulated speed of the process, this right must be preserved. In the case of the appeal of the defender of the bond, in the face of the abolition of the requirement of two identical judgements, we additionally deal with the defense of the sacrament of marriage as a public good. This is in the interest of the Church, which is protected by appealing the judgement. The specificity of the processus brevior, consisting in its simplification and acceleration of the procedures, obviously requires the use of specific norms set for it, different from those that govern the ordinary process. This applies to the jurisdiction of the appellate tribunal, confirmation of the bishop’s judgment and the admission itself, or the possibility of rejecting the appeal a limine. The remaining requirements for the appeal in the processus brevior are identical to those that the legislator asks the ordinary in the ordinary process. However, they refer to the presentation of the appeal, its support, and statutory deadlines for accomplishing this. The appeal of the defender of the bond in the processus brevior has a special meaning, because most often with such, if it occurs, we will have to deal with procedural practice. This is supported by the consistent demand of private parties that appear to be interested in obtaining pro nullitate judgement, which is the only one that can be issued by the bishop before which the proceedings are pending.
