The subject of the study is the analysis of the content of specific answers which were given by the Pontifical Council for Legislative Texts with regard to doubts which arose after the promulgation of the Apostolic Letter„Mitis Iudex Dominus Iesus”. Some of them were published on the website of the Council, others on the websites of Italian Bishops` Conference and other sites dedicated to canon law. Some answers were placed there as explanatory notes. Therefore, it was necessary to explain the difference between declarations, explanatory notes and specific answers to next comment on answers.

Francis’ Motu Proprio Mitis Iudex, published on September 8, 2015, which is devoted to the reform of canons of the of the Code of Canon Law related to laws on marriage annulment, along with the attached Instruction, constitutes an important novum in relation to current law. In order to meet the expectations of spouses who got divorced and remarried (civil marriage), the new document makes a far reaching reform of the marriage process, which becomes shortened and simplified.The author presents the provisions of Motu proprio and Instruction, at the same time indicating important tasks which the Conferences of Bishops, diocesan bishops and court Christians have to face. The most important innovations of the new document are: removing the requirement of two instances, enabling the possibility of a single court and introducing processus brevior before bishop. It appreciates the care of the highest Church legislator of the faithful who require special need in ascertaining the truth about the marriage which de facto ceased to exist.

The article reflects upon the question of modifications in canonical matrimonial processes caused by pope Francis’ motu proprio Mitis Iudex Dominus Iesus. Some of the issues brought up by the author are: changes of tribunals’ competences in matrimonial cases, collegiality of the tribunal, the sufficiency and enforceability of the sentence after the affirmative decision of the first instance and both the positive and negative effects of designing a briefer form of trying nullity cases called processus matrimonialis brevior coram Episcopo.

The amendments caused by motu proprio Mitis Iudex Dominus Iesus are currently broadly discussed, court’s employees are trying to cope with it and they are doing their best it in order to implement the new regulations and adapt them to their everyday work. The analysis and considerations within the article aim at presenting the changes made in those regulations. The author focuses on how the defining of local jurisdiction of courts entitled to adjudicate in particular case, has been broadened. The potential dangers and risks that may arise due to the amendments have been defined and presented on the basis of analysis of the regulations from over last hundred years. Those risks are relevant both in the context of searching for the Truth as well as smooth operating of Church courts. The main source of those risks is people’s (petitioners’) attitude, not serious enough and superficial, toward the case of invalidity of the marriage. The author enumerates that their priority is to finalize the case quickly and efficiently as well as to minimalize the court costs. In the author’s opinion the foresight is needed in order to prevent and counteract the effects of this kind of malpractices.

The amendment to the process to declare the nullity of marriage introduced a new institution, a pre-judicial or a pastoral inquiry. The purpose of this procedure is to help those who have experienced the drama of breaking up a sacramental marriage. The diocesan bishop and the parish priest are responsible for helping such persons. An inquiry should be entrusted to other persons who will be adequately prepared for this. A pre-judicial inquiry is intended to be a tool to help assess the situation of such persons in order to determine the legitimacy case to present petition to the competent tribunal. Faithfull in the pastoral inquiry should be acquainted with the procedure and should help them to prepare formally to start process to declare the nullity of marriage. Some situations do not qualify for declaring the nullity of marriage. Then the pastoral inquiry should help those who have experienced the breakup of marriage to point out other forms of help that will service them to find the role, the meaning, and the function in the community of the Church.For this reason, the ecclesiastical law obliged those responsible for carrying out this procedure to cooperate with other legal entity who have the possibility to provide adequate assistance within the framework of structures of pastoral care of marriage.

The new canon 1672 simply reiterates the previous norm that tribunals are competent if they are the tribunals of the place where the marriage was celebrated (an adaption of the ancient notion of the forum of the place where the contract was entered) or the tribunals of the place where the respondent has a domicile or quasi-domicile or the tribunals of the place in which the majority of proofs are to be gathered. In his motu proprio Apostolic Letter Mitis Iudex, Pope Francis underscores the role and responsibility of every Diocesan Bishop in the pastoral exercise of canonical justice and points out what must be done in the carrying out of the bishop’s own judicial power. The goal of this study is to bring together the teaching of the Pope and of the Church on the responsibility of the Diocesan Bishop in causes of marriage nullity. The question under study is not only presented in light of Mitis Iudex, but also takes into consideration other documents of the Holy See, especially those of the Apostolic Signatura, which sees to the correct administration of justice in the Church. For this reason the presentation of the topic is broader than its treatment in Mitis Iudex, and as a consequence it seeks a more comprehensive handling of the question at hand, naturally within the limits of such an article. In the first part of the study, questions of a doctrinal nature are dealt with, revealing, above all, that each Diocesan Bishop is the iudex natus of his own diocese. Therefore, he has not only the right, but also the duty – both of which have their origin in divine law – to judge coram Domino the cases of his faithful. In the next part, these rights and duties are presented, which then leads to an examination of the responsibility of the Diocesan Bishop in causes of marriage nullity. In the wake of the recent reforms – especially the elimination of the obligation to have a double conforming sentence and the introduction of the processus brevior – the responsibilities of the Diocesan Bishop are significantly amplified. In fact, in the pastoral exercise of his own judicial power, he must ensure that no laxism of any sort creeps in and that the truth is the foundation, mother, and law of justice in every aspect of the judicial process.
