Opis:
The author of the presented article discusses the issue of indissolubility of marriage in the writings of 4th century Latin Church Fathers. His analyses proved that among patrologists there are mixed opinions concerning the value of some writings on this topic. The majority of patrologists believes that, apart from Ambrosiaster, all other writers of that time gave no consent for people to remarry while some patrologists think the opposite.On the basis of the research carried out by H. Crouzel, the author pointed out that, apart from Ambrosiaster, all Church Fathers agreed that the texts of Mt 5, 32 and 19, 9 should be interpreted as an exception to the rule of not abandoning the spouse. Only Ambrosiaster stood for entering into a new marriage not only in the case of adultery but also for a few other reasons. Some patrologists think that his writings reflect certain practices adopted in the Church of that time. In this case, however, it was not a common practice but, as Kamas believes, a kind of laxism which appeared in the practice of a local Church.

Although marital law was attracting particular attention of the doctrine from the very beginning of its creation (as a field of science), only the promulgation of codes of canon law (CIC 1917, CIC 1983, CCEO 1990) “liberated” the natural need of issuing manuals and commentaries regarding marital law.The subject of the first part of the paper are the manuals and commentaries in Polish regarding the entire marital law (substantive), from before 1917 and then those issued after 1917 – before the Second Vatican Council and after the Council.The author discusses particular manuals and commentaries in chronological order and provides their evaluation.In that period of time several comprehensive manuals and commentaries appeared (in Polish) to the marital law included in CIC by: J. Pycia, F. Bączkowicz, J. Baron, W. Stawinoga, B. Wilanowski, W. Szmyd, S. Biskupski, W. Szafrański, M. Żurowski. E. Sztafrowski.

Opis:
The circumstances of promulgating in 1983 by John Paul II of the new Canon Law shaped in the spirit of science and the guidelines of the Second Vatican Council, which was raising interest of canonist, prompted deeper studies over its norms, also in the sphere of marital law. Marital law has been amended and modifies since the Code of 1917, which was clear from the post-Council law and intense work of the Papal Commission on Revision of CIC.In that period of time several comprehensive manuals and commentaries appeared (in Polish) to the marital law included in CIC by: T. Pawluk, E. Sztafranowski, W. Góralski, J. Krukowski, M. Żurowski, P. Gajda and P. Majer.The authors of the manuals and commentaries to the marital law included in CCEO are W. Góralski and K. Nitkiewicz.

The author of the article presented the views of Latin Church Fathers from the turn of the 5th century on the question of the possibility of contracting another marriage. His analyses showed that they were against such practices. The popes of those times, Innocent I and Gregory the Great, made a few particular decisions in that matter connected with the specific conditions in which Christians lived at that time, namely the relation between the Christian doctrine and the then valid Roman law. The author also proved that, as far as marriage was concerned, the Church Fathers implicitly acknowledged secular jurisdiction apart from the regulations that were non-acceptable from the perspective of the Christian doctrine.

The author of the presented article carried out an analysis of the writings of Early Christian Latin writers of 2nd and 3rd centuries concerning the unity and indissolubility of marriage. He pointed out that all of them stood for the unity of marriage (Tertullian, Marcus Minucius Felix, Saint Cyprian, Novatian). Some interpretative controversies arise among patrologists around the texts of Tertullian and Lactantius concerning the indissolubility of marriage. The author proved, mainly on the basis of the views of Crouzel, that these texts should be interpreted primarily in the context of conditions in which they were written. They should not be perceived as consent for a new marriage in the case of adultery.

Opis:
The contraction of a marriage by proxy is a tradition deeply embedded in the Church history and, although it is rare in practice, it is still present in the canon law. The contraction of a marriage while one of the nuptrients is absent is obviously far from a typical situation and not well recognized in the church practice and canon doctrine, which raises some doubts. The first question that appears is whether, due to the specific nature of matrimonium per procura, are the canonical requirements regarding the activities directly preceding the contraction of marriage still valid? Are all the regulations applied when both nuptrients are physically present also required of the nuptrients who cannot be present at the marriage contraction? What are the consequences of the potential breaches in this matter? Is the ceremony itself of the marriage contraction by proxy in any way different than the ‘classic’ ceremony, and if so – what are these differences? This article is an attempt to answer these questions, presenting the relevant regulations of the canon law concerning the subject matter.

Opis:
According to the belief prevailing in Poland that the deacon cannot assist at the marriage, the author enquires whether the practice of blessing marriages only by the priests is consistent with the law of the Roman Catholic Church. In his discussion, the author goes back to the norms written in the Second Vatican Council constitution Lumen Gentium and the Apostolic Letter of Pope Paul VI Sacrum Diaconatus Ordinem – consisting the basis of legislation regulating the considered matter. Subsequently, applying the general norms of the code of Canon Law about the collisions of law, he is answering a question about the value of the documents released by the Apostolic See and Polish Bishop’s Conference since 1983. In conclusion, the author notes that if, contrary to the cited arguments, someone would still insist that the deacon, beyond the delegation needs a specific consent of the local ordinary, it should be noted that in this case it is a doubt about the lawand such law do not oblige.
