The reference point for deliberations is constituted by two documents: the Apostolic Constitution of Francis Episcopalis communio and the final document of XV General Assembly of the Synod of Bishops dedicated to the problems of young people Young People, the Faith, and Vocational Discernment. The synodal document presented the issues which were not discussed during the synodal sessions and concern the synodal path of the Church. The author reflects on common elements of both documents and interprets each of them in the light of the other one. He highlights the element of discernment of gifts, charisms, and conscience, which determine the position of the faithful in the ecclesial community and influence the bonds between them and the pastors of the Church. Extending the area of implementation of the synodal character of the Church allows the author to ask the question about the model of the presence of the Church in the world. The author points out similarities between the synodal way and the methodology of ecumenical dialogue, which may affect summoning of the Synod dedicated to ecumenical issues.

The concept of the synod plays a special role in the Evangelical ecclesiology. In the 20th century, the synod was radically defined as “the personification of the Church.” In the Evangelical tradition, however, there are equal Church management systems: episcopal, synodal-consistory, presbyterian (mainly in the Evangelical-Reformed denomination), and to a lesser extent congregational (especially observed in the so-called free Churches). Reformation theology understands the Church as a community of all saints, where the Gospel is preached purely and the sacraments are properly administered (Augsburg Confession — CA VII). The system of the Church does not belong to the so-called notae ecclesiae. An important theological doctrine of the Reformation is the teaching about the universal priesthood of all believers, which is the theological foundation of the idea of the synodal responsibility of the Church. In the 19th century synods concerned mainly clergy. In the 20th century, in the course of democratisation processes, most Evangelical Churches raised the importance of the synod in the overall management of the Church, and the Polish Lutheran Church introduced a provision into her law which stipulates that the synod is “the embodiment of the Church” and its supreme authority.
Il concetto di sinodo svolge un ruolo speciale nell’ecclesiologia evangelica. Nel XX secolo, il sinodo è stato definito in modo radicale come “personificazione della Chiesa”. Nella tradizione evangelica, tuttavia, ci sono sistemi equiparati di gestione della Chiesa: episcopale, sinodale-concistoro, presbiteriano (principalmente nella Chiesa evangelica riformata) e, in misura minore, congregazionalista (praticato soprattutto nelle strutture della chiesa libera). La teologia della Riforma intende la Chiesa come una comunità di santi in cui il Vangelo è chiaramente predicato e i sacramenti sono amministrati correttamente (Confessione di Augsburgo — CA VII). Il sistema della Chiesa non appartiene alle cosiddette notae ecclesiae. Un’importante dottrina teologica della Riforma è la dottrina del sacerdozio universale di tutti i credenti, che è il fondamento teologico dell’idea di responsabilità sinodale per la Chiesa. Nel XIX secolo, i sinodi riguardavano principalmente il clero. Nel corso dei processi democratici nel XX secolo, la maggior parte delle chiese evangeliche ha sollevato l’importanza del sinodo nella gestione generale della Chiesa, e la Chiesa luterana polacca ha introdotto una disposizione nella sua legge secondo cui il sinodo è l’incarnazione della Chiesa e la sua autorità suprema.

The Second Vatican Council shaped a new model for a diocesan synod, which was adopted, among others, in Poland, and is characterised by a departure from making the norms of particular law and the popularisation of the council teaching in particular Churches. On the other hand, after the promulgation of the new Code of Canon Law in 1983, the diocesan synods adjusted the diocesan law to the code norms. When this period of the reception of the code law to the diocesan legislation achieved its result, the final resolutions of the subsequent diocesan synods, which were usually extensive, do not meet — to a large extent — the requirements set by the documents of the Holy See: Instruction of the Congregation for Bishops and the Congregation for the Evangelisation of Nations of 1997 and the Directory of the Congregation for Bishops Apostolorum successores of 2004. The author calls for the use of these enunciations so that diocesan synods can be an effective tool for the renewal of a particular Church.
Le Concile Vatican II a créé un nouveau modèle de synode diocésain, qui a été adopté, entre autres, en Pologne, et qui se caractérise par le renoncement à l’établissement de normes de droit particulier et par la diffusion de la doctrine conciliaire dans les Églises particulières. Après la promulgation du nouveau Code de droit canonique en 1983, les synodes diocésains, à leurs tours, ont adapté le droit diocésain aux normes du code. Lorsque cette période de réception de du droit de code à la législation diocésaine a atteint son résultat, les résolutions finales des synodes diocésains ultérieurs, en règle générale étendues, ne répondent pas — dans une large mesure — aux exigences des documents du Saint-Siège: l’Instruction de la Congrégation pour les évêques et la Congrégation pour l’évangélisation des nations de 1997 et aussi le Directoire de la Congrégation pour les évêques Apostolorum successores de 2004. L’auteur de l’article insiste sur le besoin de suivre les dispositions de ces énonciations, afin que les synodes diocésains puissent être un outil efficace pour le renouvellement de l’Église particulière.
Il Concilio Vaticano II ha creato un nuovo modello di sinodo diocesano, che è stato adottato, tra l’altro in Polonia, e che è caratterizzato dalla rinuncia allo stabilire le norme del diritto particolare e dalla diffusione della dottrina conciliare nelle chiese particolari. Dopo la promulgazione, nel 1983, del nuovo Codice di Diritto Canonico, i Sinodi diocesani, a loro volta, hanno adattato il diritto diocesano alle norme del codice. Quando quel periodo di ricezione della legge di codice dalla legislazione diocesana ha raggiunto il suo risultato, le risoluzioni finali dei sinodi diocesani successivi, di regola di ampie dimensioni, non soddisfano — in larga misura — i requisiti dei documenti della Santa Sede: l’Istruzione della Congregazione per i vescovi e la Congregazione per l’evangelizzazione delle nazioni del 1997 e anche il Direttorio della Congregazione per i vescovi Apostolorum successores del 2004. L’autore dell’articolo insiste sul bisogno di seguire le disposizioni di queste enunciazioni, affinché i sinodi diocesani possano essere uno strumento efficace per il rinnovamento della Chiesa particolare.

W 2020 roku Międzynarodowa Komisja Teologiczna wydała ważny dokument: “La reciprocità tra fede e sacramenti nell’economia sacramentale”.Dokument ten jest prezentacją 6-letnich prac eksperckich nad zgłębieniem relacji między wiarą a sakramentami. Oferowane tu oryginalne teologiczne uzasadnienie szczególnej roli wiary w ważności i owocności każdego sakramentu kulminuje niejako skupieniem uwagi na „obszarze” newralgicznym eklezjalnie (Ecclesia domestica) – co zapowiadają już wstępne deklaracje, zamieszczone pod „krzyczącym” podtytułem: “Fede e sacramenti: una reciprocità in crisi”. Mowa o poważnej naukowej propozycji dalszej reintegracji doktryny de sacramento matrimonii, z węzłowym ujęciem problematyki sakramentalnej godności małżeństwa – studium mocno wyczekiwane, bo wpisane w kontekst dwóch pamiętnych zgromadzeń Synodu Biskupów z lat 2014 i 2015. Przyjęcie hipotezy o zasadności tytułowej cezury (2015-), wyznaczającej “erę posynodalną”, dyktowało autorowi niniejszego opracowania – konsekwentnie – dogłębne zbadanie: jak Międzynarodowa Komisja Teologiczna zrealizowała in concreto synodalne apele biskupów z 2014 roku – apel pierwszy (z Instrumentum laboris della III Assemblea Generale Straordinaria del Sinodo dei Vescovi): “si indica la necessità di approfondire la questione del rapporto tra fede e sacramento del matrimonio”; i apel późniejszy (z Relatio Synodi della III Assemblea Generale Straordinaria del Sinodo dei Vescovi): “andrebbe considerata la possibilità di dare rilevanza al ruolo della fede dei nubendi in ordine alla validità del sacramento del matrimonio, tenendo fermo che tra battezzati tutti i matrimoni validi sono sacramento”. W uwagach końcowych autor nie uchylił się od próby odpowiedzi na nurtujące kanonistę pytanie: czy można przyjąć, że efektem 6-letnich prac Komisji jest – ważne dla kanonistyki i przede wszystkim pomocne dla jednolitego orzecznictwa – wyjaśnienie questio dubia: “ochrzczonych niewierzących” a sakrament małżeństwa?
In 2020 the International Theological Commission published an important document: The Reciprocity Between Faith and Sacraments in the Sacramental Economy. The document is a presentation of six years of expert work on exploring the relationship between faith and the sacraments. The original theological justification, offered here, of the specific role of faith in the validity and fruitfulness of each sacrament culminates, in some ways, in a focus on an ecclesiastically sensitive “area” (Ecclesia domestica) — which is already foreshadowed by the initial declarations under the “emphatic” subtitle: Faith and the Sacraments: A Reciprocity in Crisis. What is addressed here is a serious scholarly proposal for further reintegration of the doctrine of de sacramento matrimonii, with a nodal understanding of the issue of the sacramental dignity of marriage — a study strongly awaited since it is set in the context of the two memorable assemblies of the Synod of Bishops, of 2014 and 2015.Adopting the hypothesis of justifiability of the title demarcation line (2015—), marking the “post-synodal era,” bestowed upon the author of this study — consequently — a need to comprehensively examine how the International Theological Commission implemented in concreto the synodal appeals of bishops in 2014 — the first appeal (from Instrumentum laboris of the Third Extraordinary General Assembly of the Synod of Bishops): “there is a need to deepen the question of the relationship between faith and the Sacrament of Matrimony”; and a later appeal (from Relatio Synodi of the Third Extraordinary General Assembly of the Synod of Bishops): “it is necessary to consider the possibility of giving importance to the faith of the nupturients in ascertaining the validity of the Sacrament of Marriage, all the while maintaining that the marriage of two baptized Christians is always a sacrament.” In the concluding remarks the author answers the question that preoccupies the canonist: Can it be assumed that the result of the Commission’s six-year long work is — important for the canonical doctrine and, above all, helpful for the consistent jurisprudence — a clarification of the questio dubia: “baptized non-believers” and the sacrament of marriage?

Opis:
The aim of the article is to verify the hypothesis that the institutions of diocesan synod in the perspective of the Roman Catholic Church and that of the Evangelical Church of the Augsburg Confession in the Republic of Poland are very similar. The method to achieve the aim is the comparable analysis of the legal provisions of the fundamental laws of the Churches which refer to diocesan synod. The general conclusion is that the institutions of diocesan synod seen in the two perspectives are completely incompatible. They are different institutions.
Le but de l’article est de vérifier l’hypothèse selon laquelle, en République de Pologne, la perspective de l’Église catholique romaine et celle de l’Église évangélique d’Augsbourg concernant l’institution du synode diocésain sont similaires. La manière d’atteindre cet objectif consiste à proposer une analyse comparative des dispositions des règles fonda mentales de ces Églises qui s’appliquent au synode diocésain. La conclusion générale est que l’institution du synode diocésain présentée des deux points de vue est totalement incompatible. Ce sont des institutions différentes.
Lo scopo del presente articolo è di verificare l’ipotesi che nella Repubblica di Polonia, la prospettiva della Chiesa cattolica romana e di quella evangelica-augusta riguardante l’istituzione del sinodo diocesano siano simili. La via per raggiungere questo obiettivo consiste in un’analisi comparata delle disposizioni delle regole fondamentali di queste Chiese che si applicano al sinodo diocesano. La conclusione generale della ricerca svolta è che l’istituzione del sinodo diocesano presentata da entrambe le prospettive è del tutto incompatibile. Sono istituzioni diverse.
