    Opis:
    Przedmiotem rozważań w niniejszym artykule jest problematyka przekształcenia prawa użytkowania wieczystego w prawo własności. Z dniem 1 stycznia 2019 r.  dokonano uwłaszczenia użytkowników wieczystych gruntów zabudowanych na cele mieszkaniowe. O ile sama reforma uwłaszczeniowa była oczekiwana już od dawna, o tyle niektóre z jej rozwiązań wywołują w praktyce poważne problemy interpretacyjne. Omówienia wymaga przede wszystkim zakres przedmiotowy ustawy wraz z oceną, czy wprowadzone regulacje realizują aspekt powszechnego i kompleksowego uwłaszczenia użytkowników wieczystych. Wskazane zostaną także te zagadnienia dotyczące  uwłaszczenia, które, w ocenie autora, najczęściej będą generowały problemy przy wydawaniu przez organ zaświadczenia potwierdzającego przekształcenie użytkowania wieczystego w prawo własności.
    The subject of this article is the issue of transforming the perpetual usufruct right into ownership. As of January 1, 2019 perpetual usufructuaries of built-up land for housing purposes have been appropriated by ownership. While the enfranchisement reform has been awaited for a long time, some of its solutions cause in practice serious interpretation problems. First of all, the subject matter of the Act requires discussion, including an assessment of whether the introduced regulations implement the aspect of universal and comprehensive enfranchisement of perpetual users.   Issues regarding enfranchisement will also be indicated, which, in the author's opinion, will most often cause problems when the authority issues a certificate confirming the transformation of perpetual usufruct into ownership.

    Opis:
    The admissibility to renounce the perpetual usufruct can be deducted on the basis of the art. 233 of the Civil Code from the nature of this right and thus neither special regulation nor application of any other provision of the existing law are required. The essence of the perpetual usufruct, as a result from Article 233 of the Civil Code, means that it is permissible to renounce of a perpetual usufruct. There is no need to create a separate legal regulation on this matter or to refer to other legislation. Article 246 of the Civil Code shall apply accordingly to the perpetual usufruct. The renunciation of a perpetual usufruct is made to the owner by unilateral declaration of intent. In accordance with Art. 31 §1 of the Act of land register and mortgage, unilateral declaration of intent should be made in writing with a notarized signature. The statement of the landlord is not relevant. In accordance with Art. 246 §2 of the Civil Code, unilateral declaration of intent become effective when a perpetual usufruct is cancelled from a land register. As a consequence the perpetual usufruct is deemed to be expired. The extinction of a perpetual usufruct causes also expiry of ownership right to the buildings and structures erected on the land or purchased and other’s burden
