The article discusses the problems of health service in prisons in relation to health of prisoners. It refers the results of conducted empirical studies which assumed that the ailments of the imprisoned, specific to their age, actual health service needs, expectations and needs related to health service of prisoners, are indicators of their health. A conception of prisoners’ social service by penitentiary administration without pressure on corrective influence formulated by Henryk Machel was the theoretical basis of the study. The study aimed to answer what was health of the prisoners examined, defined by their general health, needs and expectations concerning health service and to what degree they are answered by the health service in prison. The study was conducted in prisons under District Inspectorate of Prison Service in Poznań, i.e. remand institution in Poznań and prison institutions in Rawicz and in Wronki. All three institutions are of a closed type. The study was conducted between January 2011 and November 2012. It included analysis and explanation of acts of law concerning health service in prisons and questionnaires and interviews with prisoners and prison staff . 279 of them were suitable for further study. Structuralized interviews included 30 doctors and 30 prison carers. The results were analysed statistically. They show opinions of the respondents on the problem of health service in prisons. Young and middle age adults were the majority of the respondents (67,03%). There was a statistically significant relation between general health declared by the respondents and their age. The younger a prisoner was, the better his own general health declared, and vice versa p> 0,001, x2 = 23,245). The data show that half of prisoners declared that imprisonment contributed to deterioration of their health. This is in contrast with a relatively low number of diseases found by doctors after imprisonment. Among various ailments declared by prisoners, psoriasis and sleep deprivation were the most frequent ones. The most detrimental factor to health was prison stress. Its role was indicated by as much as 17 doctors (62,97% of all doctors in the study). Every fourth doctor indicated bad living and sanitary conditions in prison (25,93%). The same number concerned other factor, i.e. nicotinism among prisoners. This shows that many prisoners assume detrimental health habits in prison conditions. Results of the research show that, in practice, response to the need of health protection in penal institutions was very diverse. Health protection was a secondary issue and it was a part of various modules of prisoner treatment. They were characterized by various intensity of health service. It was established that the modules were as follows: control and security (63,36% indications in general). In practice, in penal institutions included in the study, this module occurred in two forms: social and health (providing security and order, prisoners’ control under prison rules, social service and above-standard health care), social (providing security and order, prisoners’ control under prison rules, social service and standard health care), security and rehabilitation (66,67% indications, providing security and order, providing a minimum level of social service and basic health care, rehabilitation). Only the first of the above forms allows to fit the problem of health care fully into penitentiary actions. The study allows for a conclusion that, in the face of the crisis of penitentiary rehabilitation, the role of health care of prisoners will increase – as a consequence of “non-rehabilitationˮ modules of prisoner treatment being more and more frequent. Health care, along with ensuring suitable living conditions and social service, may thus become a part of good penitentiary practice. Health care, and to be exact, medical cal care and medical services for the imprisoned must fit their actual needs. In general, the research has shown that the objective health condition of the imprisoned included in the study is better than their declarations. However, their health varied from a person to another, most of all related to age. The greatest health needs were declared by seniors and their expectations concerning health care and medical assistance ensured by the prison were greatest too. A practical model of prisoners' medical treatment must take this into account. I was established that penitentiary practice employs, most often, modules with basic medical treatment. This is due to the relatively modest prison infrastructure but also to limited budget. Thus, a security - control - pro-health treatment module seems to be a good penitentiary practice. It includes ensuring security to the prison and the imprisoned, order maintenance, above standard health care and social care according to European Prison Rules. Thus, a good practice must be of an eclectic character. Health care and health protection have an important place in such practice. From this point of view, the research shows a diversified picture of penitentiary reality. On the whole, it is relatively positive.

This article focuses on the dilemmas of working in prisons with people serving the two most severe sentences, viz. 25 years imprisonment and life imprisonment. The author examines this from two angles. The first concerns the doctrinal and theoretical controversies surrounding the aims and purposes of serving long sentences. The author reviews the most prominent viewpoints in this area while pointing out the associated problems and dilemmas. The second is an attempt to relate the theoretical controversies surrounding the aims and purposes of the long prison sentences to the realities of prison practice, based as it is on three uniform systems of executing prison sentences, viz. standard (1 month to 15 years), 25 years and life. The author reports the results of his empirical research in this area. The author devotes special attention to the dilemmas that arise when a prisoner serving a very long sentence participates in a program of planned activities, some of which are ethical in nature. He keeps this in mind when attempting to evaluate prison practice. The fundamental question he poses should prompt a debate on the adequacy of this use of the rehabilitation model of executing a prison sentence and its consistency with the aims and purposes of this type of punishment, generally considered to be the best and most versatile. The author takes up the debate and examines the essence and the arguments of the controversy surrounding the purposes of long prison sentences. He considers which of the aims and purposes that appear in the prison literature are suitable for use in executing these sentences. The author consequently questions the purpose and moral acceptability of correctional activities. He points out that the main purpose of long sentences is to remove prisoners from society, which is difficult to reconcile with their corrective and rehabilitative functions. This illustrates the ethical ambiguity of correctional measures. The author later discusses the results of his own empirical studies, undertaken from this theoretical perspective. These focused on the following: 1. working with prisoners serving very long sentences in practice, and in particular, the sentencing regimen to which they are subjected; 2. the tasks and goals that prison staff set themselves in this connection; 3. whether and to what extent the designated ethical dilemmas are recognised in day-to-day prison work. This study comprised a diagnostic survey (a questionnaire and structured interviews), indirect observation (examining prison documents e.g. the personal files of prisoners serving very long sentences, prison work programs, prison regulations etc.). The questionnaire was completed by 71 prisoners serving the most severe sentences, including 15 life prisoners. Sixty two questionnaires were suitable for compilation. More than 5 interviews were conducted with life prisoners and 11 were conducted with prisoners serving 25-year sentences.

The prison system being organised since August 1944, became a part of the Ministry of Public Security. Such a solution, dictated by political considerations, copied the Soviet model, which treated the prison guard as a part of the armed organ of the government. Identification of prison staff with the Ministry of Safety was expressed in the wording of official vows made by the guards which started: "I, a public safety officer". This unity was stressed for decades in prison staff politics, in employee certificates, and in the assessment of the implementation of tasks assigned to prison guards. The primary task put in words on the 4th of October 1944 by Boleslaw Bierut was "to render harmless those who oppose the program of PKWN [the communist Committee of National Liberation]." This directive and the subsequent resolutions and decisions of the party (PPR, PZPR) and ministries (MBP, MSW) requiring repressive treatment of political prisoners was noted in the subordinate units as a political and official license for brutality and sadism towards such prisoners. Since the beginning of the postwar system of prison system detention centres, prison and labor camps were places of repression and extermination of the citizens who were considered political opponents. Apart from the repressive measures the prison system also performed an oppressive function towards society, which was to serve the pacification pro-independence feelings. Since November 1944, the prisoners started to be classified into one of the following groups: common criminals, Volksdeutsches, persons cooperating with Germans, anti-state. Since February 1945, the term "anti-state prisoner" started to define an accused (convicted) associated with the AK and NSZ [anti-communist military organizations], war criminals and collaborators. Putting the former soldiers of the AK, NSZ, and BCH with the rest of prisoners stigmatised them, and was a part of an affliction and persecution. In practice, their status was lower (worse) than the status of other prisoners, particularly Germans. In the fifties, the rules for classification of the convicted changed twice, each time worsening the situation of political prisoners. Based on the principle of so-called unity of jurisdiction and performance required tougher sentences along with accordingly tougher prison treatment. Types of prisons corresponded to prisoners’ classification. In April 1945, eight major prisons were singled out, where the political prisoners were consigned after judgment. In January 1946, two large prison units were given the status of the central prisons, namely the facilities in Rawicz and Wronki. They retained the status of objects for political prisoners until 1956. The essential precondition for the problem and repressive and exterminative nature of these prisons was appointment of the positions of a chief, his deputy, and heads of special (operational) and political-educational departments.

A series of mysterious deaths in prisons made the issue of persecution organs functioning, but first and foremost question the effectiveness of controls within the prison system, returned to the newspapers’ headines. In the large part the debate has been concerned with the safety of persons who may have important information regarding ongoing criminal proceedings. Opinions are divergent, and their authors often refer back to fundamental issues. The most important and arousing the strongest emotions ones among them are as follows: where is the limit of permitted prision isolation, and how should the special units for specific categories of offenders operate? The presented study is the result of research entitled “Wstępna ocena funkcjonowania oddziałów dla więźniów niebezpiecznych” (“Introductory assessment of wards for particularly dangerous criminals”) which I carried out in 2007-2008. In the research, I examined the subject of the borders of the prison isolation, with particular emphasis on the effects of its escalation, for those who are the subjects, and for those who are executors of enhanced isolation alike. The research consisted of 10 case studies carried out on prisoners, who stayed in the special prison units with a very high degree of isolation for the longest time. Their period of stay ranged from 7 to 14 years. Penitentiary records of these individuals and the material gathered during the in-depth interviews were analysed. In addition to the presentation of the data collected during the research also contains an attempt to present a useful analytic scheme to describe and understand the functioning of this segment of the prison system, which is responsible for the isolation and control of the most dangerous criminal offenders and the most recalcitrant prisoners. The unit analysed was, so-called N ward, treated as an element of the prison culture and culture in general. The primary data source is the materials and documents related to the functioning of this segment of the prison system and the awareness of individuals participating in this social phenomenon. The latter is consistent with the assumptions of humanist criminology, in which an individual experience is a key vehicle for knowledge of the culture, and the knowledge should be searched there. The essence of this approach to the study of social phenomena is a recommendation by F. Znaniecki to study it with “the humanistic factor.” The study reconstructed the origins of wards with a high degree of isolation and it systemic rationalisation. The information collected, justify the hypothesis that the system of N wards in Poland was not prepared well enough. Ultimately there are 16 branches and with over more than 400 specially protected places of imprisonment created, despite the considerable cost, only because they were presented to decision-makers as one of the key instruments to combat the organized crime.

The article discusses studies on models of incarceration in Polish prisons. The object of the study was to determine if resocialisation model of this punishment dominates in practice, or other models, including official-formal of ostensible resocialisation, dominate and what are the factors determining this. Analysis of this problem was based on opinions by prison personnel and convicts from three prisons in the district of Greater Poland Voivodeship. Disscussion is opened by a critical reflection how much the resocialisation model suits modern penitentiary policy and to what degree it is reflected in current executory provisions of law. Discussion stars with a polemics with an opinion, quite common in Polish penitentiary literature, that incarceration should be based on this particular model as it is better than other ones. Resocialisation model does not take into account diversified needs of influence on prisoners. Some of them do not need improvement (e.g. unintentional, accidental perpetrators). Others, because of their already shaped negative personality traits will never be fit to come back to the society (e.g. perpetrators of most grave crimes of the highest degree of demorali-zation). In the end of theoretical discussion of various model of work with convicts during incarceration, the author draws one’s attention to the fact that provisions of executory criminal law can reflect resocialisation conceptions only to a limited degree. Practical model of penitentiary influence is hence not a uniform and clear pedagogical model but has an eclectic character. It is demonstrated that from such point of view, assessment of work of prisons based on the criterion if and how much they resocialise, is based on wrong premises. They are criticized in the article. In the second part of the article the author discusses the results of the empirical studies. It starts with the description of used research method and a general characteristic of the re-spondent group. The research was conducted in June and July 2010. It consisted in collecting opinions in questionnaires and in focus interviews with prisoners and prison staff. The groups were chosen in a random manner (132 prison officers and 350 prisoners) and they were representative for the population of the imprisoned in the regional authority of detention centres. Presentation of the most significant conclusions of the research starts with the fact that vast majority of convicts were imprisoned in a normal system had in practice a decisive influence on content and type of penitentiary influence. This system does not require corrective influence and thus penitentiary work concentrated on ensuring that the imprisoned are placed in conditions at least compliant with recommendations of European Prison Rules. In practice these conditions are included in prison rules. Most of all, they concern living space and prison regimen conditions without focus on education and correction work.

This article presents the context that led to the establishment of the probation system in Romania, on the background of undertaking of some reforms of the criminal sanctions system. The necessity of achieving them was represented by the difficulties faced by the penitentiary system before and after 1989, but also by the need to align the administration of penalties to the requirements imposed by the country‘s accession to the Council of Europe and the European Union. Eighteen years after the creation of the probation system within the Ministry of Justice, it can be stated that, this endeavor constitutes a success, but it is absolutely necessary to continue the efforts towards its consolidation. In addition, these measures have to be accompanied by a change of vision in relation to how other community members can be involved in the process of social reintegration of persons in conflict with the criminal law.
This article presents the context that led to the establishment of the probation system in Romania in relation to some reforms of the criminal sanctioning system. These reforms were necessary because of the difficulties faced by the penitentiary system before and after 1989, as well as the need to align the administration of penalties with the requirements imposed by the country’s accession to the Council of Europe and the European Union. Eighteen years after the creation of the probation system within the Ministry of Justice, it can be stated that this endeavour constitutes a success, but it is absolutely necessary to continue the efforts towards consolidating it. In addition, these measures have to be accompanied by a change of vision in relation to how other community members can be involved in the process of social reintegration of individuals who have broken the law.   W artykule został przedstawiony proces wdrożenia systemu probacyjnego w Rumunii w kontekście reform dotyczących zmian systemu sankcji karnych. Z uwagi na trudności, z jakimi borykał się system penitencjarny w Rumunii przed rokiem 1989 i po tym roku, wprowadzenie takich zmian było konieczne. Przemawiała za tym także potrzeba dostosowania systemu karnego do wymogów nałożonych na państwa członkowskie przez Radę Europy i Unię Europejską. Z perspektywy 18 lat od wdrożenia systemu probacyjnego w ramach Ministerstwa Sprawiedliwości przedsięwzięcie to jest uznawane za sukces. Konieczne wydaje się jednak kontynuowanie dotychczasowego wysiłku, by system ten dodatkowo umocnić. Wykonywaniu środków probacyjnych musi bowiem towarzyszyć zmiana co do postrzegania przez członków społeczeństwa konieczności ich zaangażowania w proces reintegracji społecznej osób, które weszły w konflikt z prawem.

 In the activities carried out towards prisoners, concern for their safety is the key role in the implemented system of pre-suicidal prevention. The manuscript describes a list of risk factors identified in the literature that may be important in the correct estimation of the suicide risk assessment. Therefore, the preventive procedures developed in the polish prison system, are focused on monitoring and early identification of suicidal risk factors for inmates. Diagnosis and classification of inmates to the risk group triggers a series of preventive actions taken in prison. Their implementation contributes to limiting the occurrence of the phenomenon of suicides in penitentiary isolation. The subject of the research described in the manuscript is the characteristics of successful suicides in isolation in 2015–2019. The analysis of data from the group of suicides (N = 114) in terms of suicidal risk indicators allowed to identify many aspects of the suicidal process in penitentiary isolation in Poland. Many presented variables were estimated, including temporality of the phenomenon, selected penitentiary characteristics of suicides and data on responsibility for the occurrence of the event. The obtained results provide useful data that may be used to improve the diagnosis system and early identification of prisoners at risk of suicide.

W oddziaływaniach prowadzonych wobec osób pozbawionych wolności, troska o ich bezpieczeństwo jest kluczową rolą w systemie prewencji presuicydalnej. W artykule opisano listę czynników ryzyka zidentyfikowanych w literaturze, które mogą mieć znaczenie dla prawidłowego oszacowania oceny ryzyka samobójstwa. Procedury prewencji samobójczej opracowane w polskim systemie więziennictwa koncentrują się na monitorowaniu i wczesnej identyfikacji czynników ryzyka samobójstwa osadzonych. Diagnoza i kwalifikacja osadzonego do grupy ryzyka, powoduje podjęcie w zakładzie karnym szeregu działań zapobiegawczych ukierunkowanych na ochronę ich życia. Ich realizacja przyczynia się do ograniczenia zjawiska samobójstw w izolacji penitencjarnej. Przedmiotem badań opisanych w pracy jest charakterystyka udanych samobójstw w izolacji w latach 2015–2019. Analiza danych z grupy samobójców (N = 114) pod kątem wskaźników ryzyka samobójstwa pozwoliła na zidentyfikowanie wielu aspektów procesu samobójczego w izolacji penitencjarnej w Polsce. Oszacowano wiele cech charakterystycznych (zmiennych) dla skutecznych samobójstw w polskich więzieniach, w tym czasowość zjawiska, wybrane cechy penitencjarne samobójstw oraz dane dotyczące odpowiedzialności za zajście zdarzenia. Uzyskane wyniki dostarczają użytecznych danych, które mogą posłużyć do usprawnienia systemu diagnostycznego i wczesnej identyfikacji skazanych zagrożonych samobójstwem.

Taken over by the Nazi in September 1939, Polish prisons became not only the gallows of many thousands of Poles but also the site of heroic struggle against the invaders ‒ a struggle in which both the inmates and the Polish prison staff were involved. Warsaw prisons, especially the Pawiak prison, became symbols of martyrdom of the Polish nation and of persistent struggle fought by soldiers of the underground Polish State. The Polish prison staff were obliged to stay in service during the Nazi occupation of Poland for two reasons. The first one resulted from the Nazi authorities’ order that all Polish employees should resume work; acts of sabotage carried severe sanctions. The other reason was related to the policy of the Penal Department, revived by the invaders in the territory of Nazi-occupied Poland and renamed the Central Prison Administration in 1940. Its rudimentary powers included, among other things, the staffing of prisons in the Warsaw district. In October 1939, the institution summoned the prison staff to resume work: this staff policy was designed to improve the psychological situation of inmates, to facilitate material assistance to prisoners, the political ones in particular, and to help create in the future, basing on the Polish staff, the structures of prison intelligence service of underground organizations. The actual decisions of individual members of the prison staff were prompted by a variety of motivations: a fear of the consequences of sabotaging the Nazi orders; a sense of being subordinated to Polish prison administration; and a need to secure one’s own source of maintenance. Many functionaries were also ideologically motivated: by a wish to help imprisoned Poles or subordination to suggestions or orders coming from persons involved in the arising structures of anti-Nazi conspiracy. Having made up his mind to work in a prison under Nazi administration, each and every member of the prison staff faced the problem of defining his attitude towards prisoners in general, and political prisoners in particular. Under Nazi occupation, the actual contents of the notion of “political prisoner” did not correspond with its former statutory definition. The need for a different attitude to political prisoners, against the prison regulations and the orders of Nazi authorities, resulted from the situation of occupation, the ever-intensifying terror, the Nazis’ attitude tu prisoners and to Polish staff, the pressure from society, and the cxpectations formulated in this rcspect by the first underground organizations. In this situation, most of the Polish prison staff developed a protective attitude to political prisoners, aimed at the greatest possible liberalization of provisions of the prison rules and, to an extent determined by reasons of their own safety, actually sabotaged Nazi instructions. Such attitudes could be found as early as October 1939 in a prison in Daniłowiczowska street and in “Serbia” (women’s ward of the Pawiak prison); they persisted till the closing of Polish prisons, whatever the restrictions imposed on Polish prison staff during the occupation. The most widespread form of assisting prisoners was to pass on news from inmates to their families or other persons and vice versa. The staff also secretly supplied inmates with food, medication, cigarettes, and books. Also religious practices were permitted against the regulations, and imprisoned priests could say masses and render religious assistance and services to their fellow inmatess. This attitude of Polish prison staff was reinforced by the activities of newly- formed underground organizations which tried to get in touch with the inmates by winning over the Polish staff members. Organized intelligence in Warsaw prisons started in early November 1939 when the Headquarters of Poland’s Victory Service were notified by a prison staff member of the imprisonment of the Mayor of Warsaw Stefan Starzyński in the Daniłowiczowska street prison. Having received this signal, an Headquarters oflicer Emil Kumor started winning over the staff of the succession of prisons in which the Mayor of Warsaw was kept. Regular activities towards the building of prison intelligence structures were started late in November 1939 by the head of Information and Propaganda Department of Poland’s Victory Service Warsaw Headquarters, Zygmunt Hempel. In each of the prisons, he managed to win over an officer of the prison staff; sworn under the organization’s bylaws, those officers, were charged with the task of forming prison intelligence networks in their respective institutions. A special stress on the building and functioning of this type of network for communication with inmates was laid in the Pawiak prison, a security police jail. The prison intelligence network included internal network (function holders among the inmates, members of prison staff); external liaisons (prison staff); and external network (persons in charge of contact points, liaisons). This communication network was io acquire information about the circumstances of detention, the course of inquiry, the degree to which the entire organization was endangered, etc. Instructed by the organization, the intelligence network members among the prison staff passed on information, supplied food, medication (poison in some cases), things to help organize an escape, and underground press. They also prepared copies of lists of new admissions and of persons transported to concentration camps, executed, or murdered. They warned prisoners against Nazi agents and other dangers, and facilitated contacts between partners. Till mid-1942, there operated in Polish prisons, the Pawiak prison in particular, numerous structures of communication between inmates and underground organizations; they were independent of one another and varied as to the degree of organization. Acting as their liaisons were many a time the same members of prison staff; many of them only learned after 1945 for which underground organization they had been working. Beside performing the organizational tasks, those same functionaries often undertook, for humanitarian reasons, to establish illegal contacts with individual prisoners upon request of those persons’ families. Ultil mid-1942, the underground communication with inmates was spontaneous, largely improvised, and chaotic, and those involved in it tended to ignore even the basic principles of safety. Nazi counteraction took place as early as July 1940 when the first group of prison staff were arested and transported to the Auschwitz concentration camp. They were accused of helping the prisoners and involvement in the underground activities of one of the organizations that struggled for the country’s independence. Thereafter, the prison staff were more and more often put under surveillance, searched, and detained. In the winter of 1941/1942, the Nazi succeeded to introduce their agent, Józef Hammer, into the prison intelligence structures of the Armed Struggle Union. Hammer established co-operation with a group of the most ideologically motivated prison staff; through their activity, the Nazi intelligence gained access to materials possessed by underground organizations. As a result of this activity, 33 functionaries of the prison staff were arrested in March 1942; most of them were subsequently killed in concentration camps. In April, furher 9 officers were executed. The repressive measures towards Po1ish prison staff continued in 1943, when further arrests and executions took place, and in the early half of 1944 when Polish functionaries were dismissed (the Pawiak prison). The staff of prisons in Daniłowiczowska and Rakowiecka streets were much less affected by the Nazi repressions as there were practically no political prisoners in  those two institutions. On 30 June 1942, the death penalty imposed on Józef Hammer in an underground trial was executed; it took the counter-espionage of the Home Army  Headquarters a mere several weeks to clear his associates of the charge of intentional co-operation with the provocateur. Instead, it was manifested in an  inquiry that the men  had been completely devoted to the cause of struggle against the invaders and motivated by patriotic reasons. The underground movement’s battle against the Nazi for channels of com- munication with prisoners finally won, the period of consolidation of the prison  intelligence headquarters started, especially in the Pawiak prison. As a result of actions undertaken by the Home Army Headquarters, the whole of this sphere was taken over by its counter- espionage division. By way of the sole exception, the Home Representation of Polish Ęmigr Government were permitted to organize their own network for communication with prisoners. Starting from mid-1942, the internal and external networks were reorganized and adjusted to new conditions resulted from Nazi policies, reflected first and foremost in intensified repressions of Polish prison staff. Heads of the Home Army Headquarters counter-espionage division compared the participation of that staff in anti- Nazi prison conspiracy to going to the front; they stated at the same time that the prison staff actually encountered a more dangerous situation. In their case, the enemy was the Nazi political  police; they paid with their own life and health for any mistake, unguarded moment, or forgetfulness of dangers. If we take just the staff of the Pawiak prison into consideration, 62 of its members were arrested, l0 of them were executed , and a few only of the 45 confined to concentration camps managed to survive the gehenna.

Osoby pozbawione wolności w jednostkach penitencjarnych zaliczane są do grup szczególnie narażonych na zakażenie SARS-CoV-2. Jednym z podstawowych sposobów ograniczania rozwoju epidemii w tych instytucjach jest zmniejszenie liczby więźniów. Pierwszy przypadek COVID-19 zdiagnozowano w Polsce 4 marca 2020 r. Inaczej niż w niektórych krajach europejskich, po wybuchu pandemii COVID-19 nie zastosowano prewencyjnego zwolnienia osób skazanych lub tymczasowo aresztowanych i skazanych w celu ograniczenia rozprzestrzeniania się SARS-CoV-2 na terenie więzień. W marcu 2020 r. parlament uchwalił przepisy prawne, które wprowadziły szczególny rodzaj przerwy w wykonaniu kary pozbawienia wolności z powodu zagrożenia epidemicznego i rozszerzyły podstawy stosowania dozoru elektronicznego jako alternatywnego sposobu odbywania kary pozbawienia wolności. Nowe rozwiązania nie przyczyniły się do istotnego wzrostu liczby więźniów zwalnianych z zakładów karnych. Ponad 10–procentowy spadek populacji więziennej w Polsce w okresie od marca do grudnia 2020 r. wynikał głównie z mniejszej liczby osób przyjmowanych do jednostek penitencjarnych. W artykule dyskutowane są ograniczenia dotyczące stosowania poszczególnych środków w celu zmniejszenia liczby uwięzionych.
Persons deprived of their liberty in penitentiary institutions are among the groups most exposed to SARS-CoV-2 infection. One of basic ways to limit the development of the epidemic in these institutions is to reduce the number of prisoners. The first case of COVID-19 was diagnosed in Poland on 4 March 2020. Unlike in some European countries, after the outbreak of the COVID-19 pandemic, there was no preventive release of prisoners in order to limit the spread of SARS-CoV-2 in prisons. In March 2020, the Polish parliament passed legal provisions which introduced a special break in the enforcement of prison sentences due to the epidemic threat and widened the possible use of electronic monitoring as an alternative way to serve prison terms. These new solutions did not contribute to a significant increase in the number of prisoners released from prisons. In the period from March to December 2020, the prison population in Poland dropped by more than 10%, however, this mainly resulted from a reduced number of admissions to penitentiary institutions. The article discusses the limitations of the use of particular measures in order to reduce the overall number of prisoners.

The many restrictions in force in a closed institution make prisons taxing and oppressive places for their inmates. Imprisonment is associated with a great deal of internal conflict and a deprivation of needs. This increases stress and psychological discomfort. This situation is often beyond the adaptation skills of convicts, prompting them to engage in a set of behavioural patterns known as prisonisation. In the process, prisoners accept norms and values that are specific to prison communities, including deviant attitudes and rituals that stand in opposition to the goals of rehabilitation and express rebellion against the institution of prison. People addicted to narcotics and psychotropic drugs have an additional motivation, viz. the possibility of obtaining drugs, to live the “double life” of prison. Research shows that incorporating specialized addiction treatment into prison programs is conducive to rehabilitation. This raises the question as to whether this therapy could effectively control prisonisation as well. The author’s own survey of prisoners who were treated shows that their hierarchy of values were significantly different six months later. This change can be regarded as developmental and indicative of successful rehabilitation. This could serve as evidence that positive therapeutic results encourage prison inmates to find constructive ways of dealing with imprisonment, reducing stress, reflecting on their conduct and understanding that their time in prison is a consequence of their actions. In this context, addiction therapy in prison may well be an effective means of preventing prisonisation.

The article discusses the right to religious observance as one possible form of exercising one’s freedom of conscience for persons in temporary detention or serving a sentence of (unconditional) imprisonment. Detention involves a range of (usually justified) restrictions and deprivations, some of which apply to the sphere of religious practices. We must not forget that freedom of conscience and religion is not only internal to a person, but also relates to his or her actions in their semi-private and public space and, as such, must be regulated, particularly in conditions of detention. Importantly, the article does not focus on the influence of religious life on the rehabilitation of inmates but on whether their right to religious freedom is respected. The aim was not to find out whether inmates needed religious practices and services in prison, but to assert that they had a right to them, while the state had a duty to respect that right.We departed from the assumption that religious practices were a matter of public or private cult and included performing certain actions dictated or forbidden by the laws of a given religious community. The question was to what extent these practices were subjected to limitation, which practices were concerned and to what extent the observed limitations were justified. The answer drew on existing legal provisions and on the subjective feelings of inmates themselves. It should be recalled that in 1991, the Polish Ombudsman determined that the right of inmates to practice Catholicism was essentially ensured and properly implemented in prisons. The only shortcoming, as judged at the time, was the lack of a sufficiently high-level normative act regulating all matters pertaining to religious practice in detention in a comprehensive way. It seemed necessary to check whether these findings were still valid. Thus the first part of the article provides an overview of the existing legal provisions defining the scope of religious practices that can be undertaken by inmates, including international regulations, the Polish constitution, acts of law and other relevant regulations. Different groups of inmates were examined, including those in temporary detention, those serving sentences and considered particularly dangerous as well as those subjected to the disciplinary measure of being placed in an isolation cell for a period of up to 28 days. We found that not all restrictions on the exercise of religious freedom in prison, as provided for under the Polish law, were justified. Our assessment of the said restrictions, both when it came to law making and application, took into account the goals and purpose of imprisonment and temporary detention in light of the constitutional criterion of proportionality. In the second part, we present the findings of a survey conducted in two penitentiary facilities among inmates declaring themselves Roman Catholic. The aim was to find out how the inmates viewed their rights when it came to religious practices, to what extent those practices were available to them and whether they felt any deficits in this area. At the general level, we found that the inmates declared significant activity in the religious area and rarely attributed obstacles to the exercise of religious rights to legal provisions or the rules in a given penitentiary facility. The unavailability of particular religious practices was also reported to be low. There were more answers indicating lack of permission to take part in Church ceremonies outside the prison (for example the funeral of a loved one). This is probably the weakest area when it comes to ensuring the exercise of inmates’ religious freedoms. Our analysis of the legal framework and the survey carried out in penitentiary facilities allowed us to formulate certain tentative conclusions (including de lege ferenda). The normative provisions do not impose many legal limitations on inmates’ access to religious practices and services. Yet respecting the right to freedom of religion is not only about not creating unnecessary barriers; it also consists in defining a minimum set of rights conferred on each inmate, on which they can call the prison authorities to account if need be.
