This paper examines the question of what values might underlie a global regimen of law. It is concerned with the level of culture and learning that could prevail among a future global public. It begins by explaining how law is a central element in the project of globalization, and how legal influence touches on all areas of global order. The paper discusses the two predominant Western traditions of law, Anglophone and Civilian, the legal culture each represents, and the values implicit in their two different conceptions of legality. It reviews certain fundamental elements present in each tradition since their near simultaneous beginnings in the medieval world. It explores the relationship of both legal methods to the realm of public understanding, especially in their two differing versions of the university as a center of learning. In doing so, the paper also examines the contrasting roles of scholar and judge in each legal system. It then looks forward to probable difficulties in any attempt at combining the two traditions of law into a single global regime. The paper concludes by using America as a model to contemplate what values might shape an Anglophone legal culture, applicable to all peoples in all localities around the world. Finally, the paper summarizes the foregoing, and looks toward the possible redefinition of culture and learning in a global Rule of Law.

The article introduces and approach of the philosophical concept of legal culture from the perspective of a global vision on the structure and evolution of society as a whole, of the legal life as part of it. In this context, the underlined idea is that the sphere of legal culture contains, in addition to the knowledge of law - the information from the field of legal sciences, elements of common knowledge, beliefs, attitudes, mentalities, legal norms, traditions, the active customs in the operation and enforcement of laws, the functioning mechanisms of state institutions in connection with the behaviour of social action agents: natural persons and legal persons. The anatomy of the legal culture is analyzed, highlighting the idea that its core is the legal knowledge, the scientific information in the field of law, which contains truthful and verified assertions. The article questions the truth of the components of legal culture, starting from the premise that judicial systems that violate the truth are incapable of producing justice. The act of justice is guided entirely by the truth, by truthful information. The achievement of justice and equity in society, the efficient functioning of the judiciary depends, not as much on the level of development of legal knowledge, the law sciences, but on the unity and functional coherence of the legal culture subsystem in its entirety.

Opis:
The aim of this paper is to analyse the Albanian constitutional and legal framework on referenda, in general, focusing special attention to the abrogative referenda of a law or part thereof. Given the absence of any concrete case of an abrogative referenda held in Albania, which does not creates very much room for discussion in that regard, the paper, through a comparative approach on the referenda culture in other european states, aims at offering to the reader a more complete view on the mechanisms and guarantees enjoyed by voters and the effective way of their use, in order to give life to the direct democracy, but without replacing the representative one. In addition, part of the analyses will be the powers of the Constitutional Court for the ex ante constitutional review of the issue subject to a referendum, the review of constitutionality of the referndum and of its results. In this context, the paper will focus on the constitutional case-law as a tool for increasing the referenda culture and shaping the constitional order, as well as a source of standards and values. Another objective of the paper is to open a discussion on the need for the reception of referenda-related standards elaborated in those European countries, where the culture of helding a referenda and the case-law on the regard is enriched and may serve as a qualitative basis for further reference.
