The problem of national minorities appears to be quite a controversial issue. This is so because it is considered by lawyers, sociologists, culture researchers, historians and political scientists. It is not a trivial matter in the controversies caused by this problem that it is related to a particularly sensitive political area that in political practice generates immense problems and brings about conflicts. The paper attempts to group the definitions developed by sociology and political science and to demonstrate the most controversial elements. The problem of national minorities is related to the notions of nation, nationality, ethnic minority and ethnographic minority. The main emphasis falls on the legal approach as the attempts at developing a legal definition (i.e. the definition stipulated by the act of law) are traced while acknowledging that such a definition has not been developed although numerous acts of international law concern the issues of minorities.

The problem of fugitives, migrants and internally displaced persons constitutes one of the more important issues in internal politics of individual states as well as in international relations. An attempt to establish the principles and set directions for such a policy is expressed in the Hague Declaration, adopted in 2002 as motioned for by the Dutch  local  chapter  of  the  Society  for  International  Development  (SID). The paper presents and reviews the contents of the Declaration, which emphasizes the responsibility of states for the situation of refugees and migrants and the need to establish the principles of such a policy. It also refers to the problems of regulated and non-regulated migration, the issue of assimilation, integration, the law of migrants to return and the duties of state institutions, local governments, religious organizations and social institutions in the reception countries. The Declaration addresses political and economic reasons for migration and it emphasizes that the work of fugitives and migrants does not only bring benefits to them, but also to the reception countries and families in the homeland. The Declaration pays particular attention to children and female refugees and to the need for specific regulations in this respect. It refers to human rights while observing the inertia and lack of concepts of specialized international agencies.

The crime of using insulting language protects human dignity (its external aspect) from such infringements that in terms of culturally determined and commonly accepted standards express contempt for an individual, irrespective of his or her feelings. The offence of using insulting or offensive language, refers to an act of disparagement, or offensive behavior towards somebody. An insult expressed via the mass media results in more serious consequences. The public nature of an act referred to in Art. 216, section 1 of Penal Code means that it was committed in a manner allowing it to be noted by a number of people that cannot be determined in advance. Therefore, a qualified type of insult involves one committed via the mass media. The ratio legis of this construction is rather obvious, as an insult committed via the mass media has a larger range, and a larger impact area.

Press law protects the informers of journalists and the persons who collaborate with them and give interviews. This protection not only prohibits the disclosure of details which could help identify the informers, but also imposes other requirements on the journalists with respect to all these people who have decided to speak to them or be interviewed. Particular requirements apply to the issue of authorization. The fundamental function of authorization is to protect the contents of a statement which is treated as an unprotected good by the regulations of copyright law or the civil code with respect to personal interests. At present, authorization is the only legal instrument enabling the author of a statement for publication to ensure its integrity and true meaning. The abandonment of authorization in the system of legal institutions would deprive the persons providing information of protection of their personal interest, i.e. the right to free speech.

Article 3a, introduced to press law, is of immense importance, which is underestimated in practice. In respect of the press access to public information, it makes a journalist’s rights equal with the rights of any subject who can apply for public information. The legislator, who amended the press law, failed to define the notion of‘public information’ referred to in the above-mentioned regulation.

The paper emphasizes that the European Court of Human Rights in Strasbourg has never differentiated standards of freedom of speech with regard to the medium used to present one’s views. The Court has thus vested the controlling function mass media can play both to the quality press and tabloids. On the other hand, however, the Court did not agree with a concept that was particularly strong in Polish journalism, that the red tops cannot be treated as seriously as the quality press. If this concept were to be accepted, the freedom, or rather irresponsibility, of the tabloid or sensational press addressed at a mass reader would be significantly larger than the field of freedom defined for the ‘serious’ mass media. Therefore, the sensational character of the press does not provide it with greater freedom, nor does it justify a more restrictive approach to its coverage.

Athorough analysis of mutual relations between freedom of speech and the protection of non-material values of individuals who perform public duties draws the author to the conclusion that a person performing public duties can easily become a subject of a more or less justified criticism of the public media; he or she can easily suffer damage to his or her honor or privacy. Each person holding a public post is practically helpless with regard to journalists who are not always willing to bear in mind the noble principles of conduct.
