    Apostolic Letter motu proprio Mitis Iudex Dominus Iesus by Holy Father Francis which reforms the canons of the Canon Law concerning nullity of marriage process was issued on 8 September 2015. Its aim is to provide proper justice in the Church and it meets the need of simplifying the marriage nullity process, while giving protection of the unity of faith and of marriage discipline. This article is an attempt to present basic presumptions and novelties of the process reform which was introduced by Francis.

    Every marriage annulment process, regardless of its form, starts from summons. A judge cannot examine any case until the petition is put forward by the one who can challenge the validity of marriage. Spouses and a promotor of justice have an unchangeable right to challenge the validity of marriage in some circumstances. This article is an attempt to define and determine the circumstances in which the parties can file for a shortened process, or the so called bishop process.

    Opis:
    Autism Spectrum Disorder is one of the most common diagnosis among children and teenagers. It is also increasing. The number of adults with such a diagnosis is rising. Some of them stay at home and they are completely dependent on their relatives, the others live normally and try to integrate into the society. It is not easy considering the difficulties related to autism they meet. In this article we present diagnostic criteria, how people with ASD function and how autism affects their ability to establish close relationships, including marriage according to can. 1095CIC/83. Their lifestyle depends on many different factors and may be varied. There are no identical situations and no identical solutions. Each case has to be considered individually. The aim of the article is to present for both lawyers and experts how ASD affects the ability to establish close relationships and to increase their awareness when they conduct marriage annulment cases.

    Opis:
    Pope Francis issued two Apostolic Letters motu proprio on Tuesday, in which he introduced reforms to the legal structures of the Church, which deal with questions of marital nullity. One of the Letters motu proprio, known by its Latin title, Mitis Iudex Dominus Iesus – or “The Lord Jesus, Clement Judge” – reforms the Code of Canon Law (CIC) governing the Lat-in Church, while the other, Mitis et misericors Iesus or “Clement and merciful Jesus” – reforms the Code of Canon Law for Oriental Churches (CCEO). The Holy Father in the preface explains that the reforms are guided by eight specific criteria. Indeed, the prefatory remarks make clear from the very start that the single most important principle guiding the Holy Father’s action and the work of reform undertaken, is that of salus animarum – the salvation of souls – which is the suprema Ecclesiae lex – the supreme law of the Church.

    Pope Francis promulgated the new law in m.p. Mitis Iudex Dominus Iesus on the canonical marriage process. He introduced a shortened trial before the bishop. The application of law shows that this type of process is rarely used. What is the reason? Are we dealing with the problem of law interpretation or application? The author analyzes the issues. In his conclusions he indicates that the greatest difficulty is to determine the facts that affect the possibility of applying can. 1683 Code of Canon Law (MIDI).
