    Burma/Myanmar seems to be a perfect ground for transitional justice with both long-failed transitions to democracy that seemed to succeed in 2015 finally and smouldering civil war taking place there since 1948 (since the 1990s limited to Borderlands). Unfortunately, the political realities in Burma/Myanmar make it unlikely, if not impossible, for transitional justice to be applicable in Burma/Myanmar. The victorious in 2015 elections democratic opposition party, National League for Democracy (NLD) came to power thanks to the political deal with the former military government and is consequently being forced to cohabitate politically with the army that still holds critical political checks over the government. It made NLD’s leader, Aung San Suu Kyi to conduct moderate domestic policy without trying to charge the generals for their former crimes. In this circumstances, transitional justice is unwanted by mainstream political actors (NLD, the army) and seen as threatening to peace by many in the Myanmar society. This approach firmly places Burma/Myanmar on one side of the ‘peace vs justice’ dilemma. It answers the “torturer problem”, one of the central problems of transitional justice – how to deal with members of the previous regime which violated human rights – in ‘old fashion’ way, by granting them full amnesty. As such Burma/Myanmar case also falsifies an optimistic claim that transitional justice is necessary for political reforms.

    Germany is an example of a country which has been implementing transitional justice for decades and is still active in this field. What is more, contemporary Germans have recently come to terms with their not-so-distant past and their negligence in this area by showing the falsehood, backwardness, and injustice as negative foundations of the young Federal Republic. This article evokes the person of Fritz Bauer, the prosecutor in the state of Hessen. His struggle for human dignity and the memory of his achievements after his death exemplify an accomplished case of transitional justice and the memory of it. During his lifetime he contributed to bringing to trial numerous Nazi criminals, even at the cost of habitual threats and disregard. Forgotten for a few decades, Bauer and his legacy have been recently rediscovered and studied. Eventually, Bauer became a movie character and was finally brought back to the collective memory of Germans. The belated, but a well-deserved wave of popularity of Fritz Bauer in the German culture memory proves that reflections on the transitional justice are still topical and important.

    Opis:
    The article is an analysis of the regulations regarding the reduction of pensions of former officers of the People’s Republic of Poland’s security services as an element of state politics of memory, presenting the Uniformed Services Pension Amendment Acts of 2009 and 2016 from the perspective of transitional justice. Whilst investigating the admissibility of using such a retribution mechanism, the author draws attention to the purpose of this type of regulation. Reducing pensions has, in fact, two goals – a retrospective one and a prospective one. The retrospective goal is about administering historical justice by penalizing a specific group of people using various mechanisms (in this case administrative sanctions). In the prospective aspect, it is an element of institutionalizing memory and building a specific political narrative. As a consequence, apart from commemorative practices, it aims to produce and disseminate knowledge in public space, while clearly rejecting the past regime. In relation to the Uniformed Services Pension Amendment Acts, while the Act of 2009 was to some extent aimed at the retrospective goal, the 2016 Act is primarily an element of politics of memory used by authorities to control the recollection of past events by explicitly condemning the previous system and all persons in any way related to it. For this reason, the author focuses on the mechanism of reducing pensions as one of the elements of politics of memory in Poland.
    Artykuł stanowi analizę regulacji dotyczących obniżenia uposażenia emerytalnego byłym funkcjonariuszom organów bezpieczeństwa PRL jako elementów polityki pamięci państwa, przedstawiając tzw. ustawy dezubekizacyjne z 2009 i 2016 r. z perspektywy sprawiedliwości tranzycyjnej. Nawiązując do dopuszczalności zastosowania takiego mechanizmu rozliczeń w artykule autor wskazuje przede wszystkim na cel tego typu regulacji. Obniżanie emerytur ma w istocie dwa cele – retrospektywny i prospektywny. W płaszczyźnie retrospektywnej przede wszystkim chodzi o wymierzenie sprawiedliwości dziejowej poprzez swego rodzaju rozliczenie określonej grupy osób z zastosowaniem różnych mechanizmów (w tym wypadku sankcji administracyjnych). W aspekcie prospektywnym jest to element instytucjonalizacji pamięci i budowania określonej narracji politycznej. W konsekwencji, obok komemoratywnych praktyk, ma na celu wytwarzanie i upowszechnianie wiedzy w przestrzeni publicznej, przy jednoczesnym jednoznacznym odcięciu się od minionego reżimu. W odniesieniu do tzw. ustaw dezubekizacyjnych, to o ile ustawa z 2009 roku była w jakimś stopniu nakierowana na cel retrospektywny, o tyle ta z 2016 jest przede wszystkim elementem polityki pamięci, mającym na celu ukształtowanie przez władzę określonej narracji o przeszłych wydarzeniach poprzez jednoznacznie potępienie poprzedniego ustroju oraz wszystkich osób w jakikolwiek sposób z nim związanych. Z tego względu autor skupia się na mechanizmie obniżania emerytur jako jednym z elementów polityki pamięci w Polsce.
