The formulation of legal provisions by the administration does not have to take the form of administrative decisions. One of the legal forms of the administration is public-law contracts. This is one of the forms of administration which still requires a further scientific analysis. Contracts are useful instruments, and therefore it may be worth looking at their different types and construction. They may be classified according to the parties to the legal relationship created. There are two types of contracts, i.e. between administrative bodies and between an administrative body and an entity. The doctrine refers to contracts of the latter type as administrative and legal agreements. Such agreements have developed in the Polish legal order after the systemic changes. Unfortunately, the legislator has not provided their legal definition, they are regulated in special laws, most often by indicating contractual provisions constituting essentialia negotii. The doctrine does not explicitly define the character of the contracts concluded by the administrative body and its contractor, nor has the final characteristics of the content of contracts in the administration as a whole been made. There is still a lack of consensus as to the construction of public law contracts and the rules governing them. There is an urgent need to regulate the essence of administrative contracts, and in particular to indicate their construction and legal nature, in order to better protect legal entities entering into them. The purpose of public-law contracts is to improve the quality of administration, and increase the efficiency of administrative activities. More administrative contracts also mean higher decentralisation of the state. Moreover, the idea of extending the use of public-law contracts is consistent with the principle of the participatory role of citizens in achieving public effects. The Polish legislator may draw on the regulations of other countries, for instance Germany, where public-law contracts have received legal definitions.

The paper describes the development of criminal law as the originally private law sector and points to changes that ultimately have changed the nature of criminal law so that it is now considered to be a public law sector. Criminal law during the period of the high and late Middle Ages on the territory of Slovakia had the character of a public law sector. Recovery after committing the crime was left to the injured person or his family. The relationship between the injured (or his survivors) and the perpetrator was largely private in nature. The state originally did not interfere or interfere only at a minimum with this relationship. Only in the course of time has this element of a largely private legal relationship been also given a public-law element, only in the age of Modern Times the criminal-law relations had the character of public law. This article describes the changes that have occurred in the course of time in the area of criminal law, the ways of punishment, and the changes which have led to the transformation of criminal law into the public law sector

The article explores reasons of the abandonment by the Polish legislator of the public law model of the civil service. The discussed reasons were classified into two categories: normative and non-normative premises. The first group discusses the impact of international law on the activities of the Polish legislator and the disproportionately large number of publications on the doctrine of labor law as compared to the administrative law. In the second category, three groups of impact on the legislator’s activities are discussed, i.e. the political perspective (here: systemic, point-based, and episodic impact), clerical, and social perspectives. In conclusion, a return to public-law solutions is proposed.

The term ‘beneficiary’ used for the purposes of spending the EU aid funds was introduced into the Polish legal system before Poland became member of the European Union. Initially, the national legislator used this term only in the domestic regulations on the basis of which public funds were transferred. Over time, the legislator also introduced the definition of the beneficiary to national regulations adapted to the needs of the cohesion policy. It can be observed that the legislator, while initially providing own definitions of the beneficiary, recently has only referred to particular provisions of the directly applicable EU regulations. Obviously, national authorities must operate in an integrated legal system, in which there are many sources of binding law that define ‘beneficiaries of funds allocated to the implementation of the cohesion policy’. In this context, one can speak of the Europeanisation of national law with regard to the implemented policy.

The main point of this text is an attempt to present a few duties of the praetor and try to stipulate the origins of them. First of all it should be noted that the term praetor was not consistently used to describe only the jurisdictional magistrate, and it was used in relation, for example, to the consuls. This was probably because the sound etymological sense of the word (praeire: “to go before, to precede, to lead the way”). The appointment of praetor urbanus in 367 BC under leges Licniae Sextiae was not associated with the need to carry out a jurisdictional competence. The origins of the magistrate were strictly military in its nature, which since the end of the third century BC gave way to the area of jurisdiction. Raised considerations apply also to the praetor for foreigners (praetor peregrinus), who has not resolved disputes between the Romans and foreigners (peregrini), and his role was to ensure the military security of Italy. The jurisdictional competence of the pretorship as the most “famous” begins to emerge in the late third century BC, which is likely to be linked not only with the increase in the number of praetors, but mainly obviates external threat from the Carthage. It seems to indicate that the jurisdictional competence (civil and criminal) was not assigned to pretorship at the beginning of this office. It appears at least at the end of the third century BC and starts to become predominant among others which were associated with this office in ancient Rome.

Przedmiotem niniejszego opracowania jest przeprowadzenie interpretacji sformułowania autorstwa Ulpiana, pochodzącego z 11 księgi komentarza do edyktu pretora, tj. Non capitur, qui ius publicum sequitur (D. 50.17.116.1). W literaturze romanistycznej sformułowanie to zasadniczo jest traktowane dość marginalnie. Odniesienia do niego znajdują się najczęściej w przypisach, w celu egzemplifikacji jakiegoś toku myślowego, jednak bez pogłębionej analizy. Kluczowe dla procesu interpretacji tego sformułowania będzie miało wyjaśnienie znaczenia użytego w tekście zwrotu ius publicum. Można wstępnie przyjąć założenie, że Ulpian, posługując się zwrotem ius publicum, nie miał na myśli prawa publicznego w znaczeniu ustrojowym, lecz ugruntowane i powszechnie stosowane przepisy prawa prywatnego, niezależnie od źródła ich pochodzenia (jurysprudencja, edykt pretorski czy konstytucje cesarskie). Zatem hipotezą badawczą może być twierdzenie, według którego stosowanie przepisów prawa prywatnego powszechnie obowiązującego nie może być podstawą do postawienia w konkretnym przypadku zarzutu podstępnego czy nieuczciwego działania. Tak bowiem należy tłumaczyć wieloznaczny czasownik capitur pochodzący od capio, cepi, ceptum. W konsekwencji temu, kto wykonuje prawo, nie można przypisać złej wiary. Zasada ta ma ogromne znaczenie w przypadku określenia odpowiedzialności osób wykonujących zadania publiczne zgodnie z przepisami prawa i przewidzianych procedur
The subject of this study is to interpret the provision of Ulpian from the 11th book of the commentary to the praetor’s edictie. Non capitur, qui ius publicum sequitur (D. 50.17.116.1). In Romanist literature, this provision is basically treated quite marginally. References to this provision are usually found in the footnotes, in order to exemplify some thought, but without an in-depth analysis. The explanation of the meaning of ius publicum used in the text will be crucial for the process of interpretation of this provision. One can initially assume that Ulpian using the phrase ius publicum did not mean public law from the systemic point of view, but the well-established and universally applied provisions of private law, regardless of their origin (jurisprudence, the praetor’s edict or the emperors’ constitutions). Thus, the research hypothesis may be the statement that the application of the legal provisions of private law can not be the basis for the submission of an insidious or unfair act in a particular case. This is how the ambiguous verb capitur (from capio, cepi, ceptum) should be translated. Consequently, whoever exercises the law can not be impute bad faith. This principle has a great importance when determining the responsibility of persons performing public tasks in accordance with the law and the procedures envisaged.

The aim of the paper is to analyse controversial situations in the Polish judicial practice relating to performing incidental paid activities in times of sick leave, both by the insured – employees and persons not being employees, especially entrepreneurs. According to the Author’s opinion only social activities or incidental and mainly formal occupational activities can be qualified as the exceptions from the rule of the loss of the right to sickness benefit. Such view is justified by the public character and formality of the system of social security. Situations resulting in a possible loss of sickness benefit should be assessed each time in the context of the principle of proportionality.

The article discusses some problems of public law, contained in the text of hand written document called A Rite of Confession from the collection of library of the nunnery of the Holy Trinity and the Savior in Wojnowo (Poland). Because the Old Believers did not recognize the jurisdiction of state authorities, considering the authorities as the embodiment of the Antichrist, all aspects of social life of the Old Believer’s community were governed by the provisions of ancient Byzantine canon law from Nomocanon and by traditional norms of ethics. The penalty for each offense was determined by confessor and could be defined by dint of the text of A Rite of Confession.

Primary elections are a new element in the ‘periodical table’ of Hungarian politics and were already used for the selection candidates in some instances in 2019. In preparation for the upcoming parliamentary elections in 2022, a cooperation scheme is taking shape among opposition parties, involving all currently decisive players on that political side. Entailing a scope broader than ever before, this cooperation also involves the organisation of primary elections for selecting the candidate for the Prime Minister and the candidates in single-member constituencies. The primaries are organised by the six opposition parties running together in the 2022 Hungarian parliamentary election. If held, it would be the first countrywide primary election in Hungary. This study looks beyond the specific solutions that may be applied in relation to the upcoming primaries. It provides a working definition of the term itself, briefly reviews the international and Hungarian antecedents of primaries, also outlining the reasons why this solution came to the fore in Hungary. Then the study sets out to predict the ‘evolutionary trajectory’ along which primary elections will become institutionalised here, spelling out the potential phases of development. In the latter context, this paper touches on the private law and public law implications of primaries and raises a scenario in which government parties also begin to apply this new political tool.

The active development of technology enbled mankind to realize new programs for the exploration of previously inaccessible areas of the universe hundreds of thousands of kilometers away. The emergence of this new field created the need to ensure its special legal regulation, which would correspond to the specific characteristics of this business. But now we have entered into a phase of re-evaluation of existing legislation of space and we must realise that alongside countries operating in space an has arisen entirely new entity - the private sector. Therefore it is necessary to ask ourselves whether the privatization and commercialization of outer space is legally possible and if it is not pre-cluded by existing treaties. The draft of the latest US Commercial Space Act is undoubt-edly a great advance for key areas of the private sector activity such as remote sensing and new space missions. It provides a sense of confidence for entrepreneurs by strictly regulating issues related to the supervision of private sector entities. However, on the in-ternational scene the question has arisen of whether this act is contrary to international law, especially principles contained in existing space law treaties.

The qualification of compensation claims for expropriation of real estate to the public law sphere or the private law sphere raised many legal doubts in interwar Poland and has remained not fully resolved until the present date. This qualification is particularly relevant in view of the limitation period regarding the compensation claim. Under administrative law, contrary to the claims of a civil law character, there is no limitation of claims, unless the law provides otherwise. In this article, some exemplary legislative acts that constitute the grounds for expropriation of real estate procedures and possible claims for compensation are analysed, starting from the law on expropriation proceedings contained in the ordinance of 1934, through post-war decreesand amendments, to the Act on Property Management currently in force. Further, on the basis of the decisions delivered by common courts and administrative courts as well as opinions of high standing legal scholars, the author attempts to justify his stance on the public law nature of compensation claims for expropriation of real estate.
Kwestia zakwalifikowania roszczenia do ustalenia odszkodowania za wywłaszczenie nieruchomości do sfery publiczno- lub prywatnoprawnej na gruncie prawa polskiego budziła wątpliwości doktryny już w okresie międzywojennym i pozostała nierozwikłana jednoznacznie do dziś. Jest ona szczególnie istotna z punktu widzenia przedawnienia przedmiotowego roszczenia odszkodowawczego. Na gruncie prawa administracyjnego bowiem, w przeciwieństwie do roszczeń o charakterze cywilnoprawnym, roszczenia co do zasady nie ulegają przedawnieniu, chyba że ustawa stanowi inaczej. W niniejszym artykule autor poddaje analizie przykładowe akty prawne, będące podstawą do przeprowadzenia procedury wywłaszczania nieruchomości oraz ewentualnych roszczeń odszkodowawczych, począwszy od rozporządzenia Prawo o postępowaniu wywłaszczeniowem z 1934 r., przez powojenne dekrety i ich nowelizacje, na obecnie obowiązującej ustawie o gospodarce nieruchomościami skończywszy. Jednocześnie w oparciu o orzecznictwo sądów powszechnych i administracyjnych oraz wypowiedzi wybitnych przedstawicieli doktryny autor podejmuje próbę uzasadnienia swojego stanowiska w zakresie publicznoprawnego charakteru roszczeń odszkodowawczych za wywłaszczenie nieruchomości.
