    This scientific study is part of research no. 130 Metenko Jozef, Methods of research and development of police activities, research no. 201 Metenko Jozef, Strengthening of European coordination in the field of national security research programmes for major events, research no.182 Metenko Jozef, Administrative practice for dialogue and communication, as the strategic principles of police activities for political manifestation and research no. 173 Metenko Jozef, Coordination of national research and policy to ensure security in major events in Europe. The scientific study deals with the issue of police interventions into fundamental rights and freedoms as a result of police activities connected to the execution of tasks and duties of police officers, and also with other provisions of the Act on the Police Force. The authors consider the rule of law to be synonymous with constitutional or legitimate governance and which also characterises the exercise of state authority on the basis of constitutionally issued laws. The authors associate police interventions with the protective function of the state, establish conditions for interference with fundamental rights and freedoms from the perspective of police activity which compliance with, or breaching of, indicates whether the particular rights and freedoms are violated or not by the intervention. Subsequently, the authors identified the concepts of prevention and prophylaxis, which they interpret on the basis of chosen international scientific results and conclusions.

    Celem artykułu jest odpowiedź na dwa pytania: W jaki sposób w nowych demokracjach opancerzonych dochodzi do ograniczenia prawa do zgromadzeń? Co wynika z takiego sposobu ograniczenia prawa do zgromadzeń dla istoty nowych demokracji opancerzonych? Przedmiotem zainteresowania Autora był Marsz Niepodległości, zorganizowany w 2019 r. we Wrocławiu. Postawiona została następująca hipoteza: limitacji prawa do zgromadzeń, gwarantowana w systemach legislacyjnych współczesnych demokracji, ma służyć realizacji nadrzędnego celu militant democracy. W procesie tym wyjątkową rolę spełniają funkcjonariusze Policji, odpowiadający za skuteczną realizację decyzji właściwych władz. W poszczególnych częściach Autor omawia m.in.: istotę prawa do zgromadzeń i jego miejsce w prawie międzynarodowym i polskim porządku prawnym, limitacje tego prawa, a także proces rozwiązania wrocławskiego Marszu Niepodległości w 2019 r.
    The aim of article is this paper is to answer two questions: How in new militant democracy authority banning the right to assemble? What results from this kind of limitation right to assemble for the essence of new militant democracy? An object of interest for an Author is Independence Day March in Wrocław, 2019. The research process proposes a hypothesis that banning the right to assemble, including in systems of legislation in modern democracies will reach the principle goal of militant democracy. In this process, we can indicate the special role of police officers, who are responsible for achieving local authority’s decisions. In each part of the paper, the author discusses the essence of the right to assemble and its function in international law and polish legislation order, limitation of this right and process of quit Independence Day March in Wrocław, 2019.

    Objectives: The aim of the present study was to determine the physical activity levels of active duty police officers and police academy cadets in different life domains and intensities. These parameters were treated as potential quantifiers that could be used when assessing individuals preparing for work as future police officers. Material and Methods: The study recruited 153 active police officers and 176 cadets attending a police academy and administered a diagnostic survey, the long-form version of the International Physical Activity Questionnaire, while in the statistical analysis the Student's t-test for independent groups was applied. Results: It was determined that police officers present high physical activity levels within the work domain, which are developed from initial training at a police academy and then throughout their police career. Conclusions: Such data are important in the light of the role police officers play in public safety as well as the prominence of physical activity within a particular profession and how it can be targeted and tailored to their needs.

    Mobile police officers perform many of their daily duties in their vehicles. Combined workspace inflexibility and prolonged driving create potential musculoskeletal injury risks. Limited research exists that quantitatively describes postural and load exposures associated with mobile police work. The purpose of this study was to characterize officer activity during a typical workday and identify opportunities for ergonomic intervention. Digital video of traffic officers (N = 10) was used to classify postures according to work activity. Cumulative time in 10 activities was calculated, and a time-history of driver activity documented. Most (55.5 ± 13.4%) time was out of the vehicle, and 22.3 ± 10.5% was spent in single-arm driving. On paper documentation and mobile data terminal use were identified as in-car activities that may benefit from targeted interventions. The primary contribution of this study is characterization of daily mobile police activity and the identification of possible intervention strategies to mitigate physical exposure levels.

    The ‘civil law’ fi eld, which is part of the curricula of university courses of law and administration, as well as of other courses of many higher education institutions (at both master’s and bachelor’s levels), has also found its place in the curriculum of the Police Academy in Szczytno. The basis of such a solution is the assumption that the knowledge of civil law issues, although it does not belong to the basic ‘tools of work’ of police offi cers and other law enforcers, appears to be useful in some of the positions in the service. Moreover, many civil law concepts occur in the structure of criminal law institutions, and show links with legal regulations relating directly to the tasks of the Police (other services) and the official status of officers. For this reason, they are an inspiring subject matter to be researched and published on, which is done, among others, in the periodicals of the Police Academy in Szczytno.

    The main objective of the article is to present the results of the evaluation carried out among participants of a specialist training course for police operations commanders which was offered by the Police Academy in Szczytno in 2014–2019. The course in question uses a police operations simulator as a modern technology tool for responding to emergencies. Both the functionality of the simulator and a modern form of simulation training, which has replaced the previous theoretical work based on paper maps, have completely changed the methods employed for in-service training, thanks to which teaching outcomes can be achieved more effectively, and police offi cers’ skills can be developed and refi ned with practice. The use of the police operations simulator for training purposes improves police command and control systems and increases the level of in-service training received by commanding offi cers, which in turn results in an effective management of human and material resources while carrying out police operations targeted at the maintenance of public order and safety at major events, including sports events, public gatherings and ceremonies, and any different forms of disturbance to public order. Evaluated have been the following issues: assessment of the training course curriculum, the knowledge and practical skills acquired during the course, and the level of satisfaction of the respondents with their participation in the course. Of key importance has been to identify the extent to which the Police Academy’s training efforts and research projects in the area of internal security affect the development of the system of in-service training offered to police officers.

    Jednym z elementów weryfikacji zasadności kierowania wniosków o zarządzenie kontroli operacyjnej jest zgoda komendanta głównego Policji, komendanta Centralnego Biura Śledczego Policji lub komendanta wojewódzkiego Policji. Zgodnie z literalnym brzmieniem art. 19 ust. 1 ustawy o Policji taki wniosek powinien podpisać odpowiednio komendant główny Policji, komendant CBŚP lub komendant wojewódzki Policji.Aktualnie przekazanie uprawnień komendanta głównego Policji dotyczących wnioskowania o kontrolę operacyjną na jego zastępców jest w pełni zrozumiałe. W przypadku zastąpienia organu policyjnego umocowanego do określonych działań na poziomie ustawy powinna być jednak zastosowana konstrukcja nie „zwykłego” upoważnienia, a przedstawicielstwa administracyjnego, z powołaniem się na art. 268a kodeksu postępowania administracyjnego. Konsekwentnie natomiast należałoby się skłaniać ku takiemu rozwiązaniu, aby upoważnienie do działania w tym zakresie także przez zastępującego organ Policji miało swoje uregulowanie w ustawie kompetencyjnej.
    The scope of powers of Police bodies which are authorized to applying for covert activities”. The one element of controlling the validity of the requests for covert activity is the approval of the Chief Commander of the Police, Commander of the Police Central Bureau of Investigation, Regional Police Commander. According to the wording of Art. 19 paragraph 1 of the Police Act, a written request should be signed by the Chief Commander of the Police, Commander of the Police Central Bureau of Investigation or Regional Police Commander. Presently, the delegation of powers of the Chief Commander of the Police in the area of requesting for covert activity to his deputies is necessary and understandable. However, in case of replacement of the police body which is authorized to specific activities by statute, should be applied the structure of administrative proxy, in reference to Art. 268a k.p.a. Consistently, it should be supported such a solution that the authorization in this field is regulated by statute.

    Decyzja zakazująca podjęcia lub wykonywania działalności gospodarczej należy do środków prewencyjnych niemieckiego systemu prawnego. Wydawany jest w celu ochrony bezpieczeństwa obrotu gospodarczego lub innych ważnych interesów społecznych. Warunkuje go kumulatywne wypełnienie następujących przesłanek: istnienie obiektywnie stwierdzalnych i weryfikowalnych okoliczności implikujących niewiarygodność (w sensie gospodarczym) przedsiębiorcy (utratę reputacji, czy brak zdolności finansowej) lub osoby przez niego umocowanej do prowadzenia na jego rachunek tej działalności oraz konieczność wydania takiego zakazu w celu ochrony interesu społecznego. Zakres pojęciowy terminu niewiarygodność gospodarcza obejmuje ogół okoliczności związanych z prowadzeniem działalności gospodarczej, które nie pozwalają na wyprowadzenie wniosku o możliwości prawidłowego uczestniczenia przedsiębiorcy w obrocie prawnogospodarczym.
    The prohibition of an economic activity is one of the preventive measures of the German legal system. It is issued in order to protect the security of business transactions or other important interests of society. Mentioned promulgation is conditioned by cumulative fulfillment of the following reasons: 1.the existence of objective and verifiable circumstances that imply unreliability (in economic terms) of the entrepreneur or a person empowered by him to carry on his bill in this economic activity, and 2. the need to issue such a ban in order to protect the public interest. The scope of the term economic unreliability includes all the circumstances related to this entrepreneurial activity, which do not allow to conclude the proper participation in the legal and trade processes.

    The article is an attempt to look at the current local security’s shape, its contemporary conditions, possibilities and limitations. The influence of the socio-political environment on the condition of local security is a regular phenomenon, provided that this environment creates optimal conditions for the shape of the security of local communities. Factors changing this environment are often beyond local communities that have no impact on this environment. In Polish conditions, ‘locality’ is related to the activities of local government units. Municipalities and counties are local self-government communities. These units have the greatest impact on the formation and activity of smaller formal and informal local communities. The author’s intention is to note these positive and negative conditions of local security, with an indication of the entities exerting the greatest influence on local security.

    The aim of this work is to try to draw attention to the relationship between physical activity in one’s free time and the reduction of all kinds of stress symptoms. The authors assume to have worked out theoretical and empirical assumptions that will allow to find effective answers to the question posed: “Is the activity in sports and recreational activities of officers of the Provincial Police Headquarters in Poznań in free time a sufficiently effective form of fighting stress?” Dur-ing the theoretical research the method of analysis and criticism of the literature, scientific re-search, monographic analysis and content analysis were used. Whereas, during the empirical re-search, a method of a diagnostic survey was applied, using a questionnaire consisting of 17 closed questions as a tool. The research was carried out by the authors at the turn of September and Oc-tober 2017, on a group of 250 officers, from five of selected groups of officers from the Provin-cial Police Headquarters in Poznań. Correlations between variables were verified with the Spear-man rank correlation coefficient. Analyses were performed with the SPSS program. The daily diet is of great importance in the encounter with stress, and it is from changes in the dietary habits that the struggle should begin. Thanks to a proper diet, the body eases the effects of stress much more effectively and strengthens resistance to stress. The reflections discussed in the article illustrate the view that the words of Hippocrates – “Let food be thy medicine, and medicine be thy food” (Wikipedia 2018) – are still valid.
    Celem niniejszej pracy jest próba zwrócenia uwagi na występujące zależności między aktywnością fizyczną w czasie wolnym a redukcją wszelkiego rodzaju objawów stresu. Zakłada się wypracowanie założeń teoretycznych oraz empirycznych, które pozwolą znaleźć skuteczne odpowiedzi na postawione pytanie: Czy aktywność w zajęciach sportowo-rekreacyjnych funkcjonariuszy Komendy Wojewódzkiej Policji w Poznaniu w czasie wolnym jest wystarczająco skuteczną formą walki ze stresem? Podczas prowadzonych badań teoretycznych posłużono się metodą analizy i krytyki piśmiennictwa, badań naukowych, monograficzną oraz analizą treści. Z kolei w trakcie prowadzenia badań empirycznych wykorzystano metodę sondażu diagnostycznego, wykorzystując jako narzędzie kwestionariusz ankiety składających się z 17 zamkniętych pytań. Badania przeprowadzone zostały przez autorów na przełomie września oraz października 2017, na grupie 250 funkcjonariuszy, z pięciu z wybranych grup funkcjonariuszy z Komendy Wojewódzkiej Policji w Poznaniu. Korelacje pomiędzy zmiennymi sprawdzono za pomocą współczynnika korelacji rang Spearmana. Analiz dokonywano za pomocą programu SPSS. Ogromne znaczenie w walce ze stresem ma nasza codzienna dieta, i to od wprowadzenia zmian właśnie w niej należy tę walkę rozpocząć. Dzięki odpowiedniej diecie organizm o wiele efektywniej łagodzi skutki stresu oraz wzmacnia odporność na stres. Omówione w pracy refleksje wyrażały pogląd, że słowa Hipokratesa – „Niech pożywienie będzie lekarstwem, a lekarstwo pożywieniem” (Wikipedia 2018) – są cały czas aktualne. Wyraźna staje się zależność stosunku, a raczej prawidłowych parytetów, między zdrowym i zbilansowanym odżywianiem a negatywnie oddziałującymi skutkami stresu.
