    Opis:
    The Arctic area with its harsh climate and austere icecap has not raised any great international passions in the past. However, enduring global warming has opened new views on exploitation of that area. If the climate gets steadily warmer in the future, it could mean the opening of the Northwest Passage for ship routes. On the other hand, it is estimated that the region has got remarkable gas reserves, which could amount to as much as 30 % of the world’s undiscovered reserves, as well as oil, which encompasses some 13 % of world’s undiscovered stocks. As for now, any serious international conflicts in this area are not likely, even though there are real expectations and claims imposed by several nations. The current peaceful cooperation is supported by feasible treaties that are already in place. Until lately, the work of the Arctic Council has not raised any great international attentiveness, but the expected development in the area has activated stronger interest from many countries, and not only those from the Arctic region. There are several regional disputes among the five states, USA, Canada, Russia, Norway and Denmark about the Arctic Ocean. As expert opinion still differs quite significantly about the resources available in the Arctic region and about the feasibility of the Northwest and Northeast routes, it is hard to say if there are any practical economic gains to be achieved. Although cooperation between the nations has been peaceful, the military presence in the area is increasing. Moreover, it remains to be seen how the recent Ukrainian crisis will affect the development in the area.

    Opis:
    This article describes the legal character and status of the Arctic Council, focusing on the Council’s structure and powers in regional cooperation in the Arctic and elaborating on the decision-making process and the role of the indigenous peoples, both currently and from the point of view of suggested new legislation. The Arctic Council is also presented as a body in the tangible world, where other states and organisations may have a certain extent of influence over the Council’s capabilities. China and the European Union are good examples of such external agents. The aim of this article is to analyse the role of the indigenous peoples and their organisations in the Arctic Council. Te presence of representative bodies of the indigenous peoples within the frameworkof the Arctic Council is considered significant. I hold the view that an extensive range of powers should be granted to the organisations representing the indigenous peoples within the Arctic Council. My article elaborates on the details of these powers and their significance.
    Artykuł opisuje charakter prawny i status Rady Arktycznej. Praca jest skupiona na strukturze i kompetencjach Rady w sferze współpracy regionalnej dla Arktyki. Artykuł opisuje proces podejmowania decyzji przez Radę i rolę odgrywaną obecnie przez organizacje ludów tubylczych oraz de lege ferenda. Rada Arktyczna jest przedstawiona jako instytucja poddana zmianom geopolitycznym i prawnym. Mają one do pewnego stopnia wpływ na funkcjonowanie i możności Rady. Dobrymi przykładami państwa i instytucji wywierających wpływ są Chiny i Unia Europejska. Celem artykułu jest analiza roli ludów tubylczych i ich organizacji w strukturze Rady Arktycznej. Obecność instytucji uprawnionych do reprezentacji ludów tubylczych w ramach Rady jest szczególna. Autor stoi na stanowisku wspierającym obecność tych organizacji w stopniu wysokim i przyznania tym organizacjom szerokich kompetencji w strukturze Rady. Artykuł opisuje te kompetencje oraz ich szczególność.

    The Arctic Council is the most important forum of cooperation in the Arctic and an excellent example of regional cooperation, both at the intergovernmental and social level. Moreover, its importance for the region must be appreciated through the change in the image of the Arctic brought about by the Council, and drawing attention of the international community to the Arctic’s problems, with a special emphasis on climate changes. Through organizations and institutions dealing with the Arctic matters, it has been trying to secure for the North an order based on sustainable development, environment protection, and a stable social system.
    Rada Arktyczna jest najważniejszym forum współpracy w Arktyce, stanowiącym doskonały przykład współpracy regionalnej, zarówno na szczeblu międzyrządowym, jak i społecznym. Jej znaczenie dla Regionu wyraża się również poprzez zmianę jego wizerunku i większe zainteresowanie społeczności międzynarodowej problemami Arktyki, szczególnie tymi dotyczącymi zmian klimatu. Poprzez organizacje i instytucje zajmujące się sprawami arktycznymi, Rada stara się zapewnić na Północy porządek oparty na zrównoważonym rozwoju, ochronie środowiska naturalnego i stabilnym systemie społecznym.

    There is a growing interest in new transportation routes that combine benefits of shorter distances, cost-effective transits and routes not troubled by maritime security concerns. The Northwest Passage offers a package of routes through the Canadian maritime zone; it is 9,000 km shorter than the Panama Canal route and 17,000 km shorter than the Cape Horn route. The Northern Sea Route shortens a Hamburg-Yokohama voyage by 4,800 miles, in comparison with the Suez Canal route. The transpolar route, if it materializes with an ice-free Central Arctic Ocean route, would shorten distances even further. Given the increase in regional and international navigation and shipping in the region, it is therefore not surprising that in recent years Arctic States and international bodies focused on the needs of enhanced safety and environmental standards for polar shipping. In addition to the dedicated domestic polar shipping regulation, primarily in Canada and the Russian Federation, the Arctic Council and International Maritime Organization (IMO) have launched important initiatives. The most important is establishing of international rules for ships operating in polar waters- The Polar Code.
    Jednym ze skutków zmian klimatycznych i topnienia lodów arktycznych jest otwarcie nowych szlaków żeglugowych, które skracają drogę z Dalekiego Wschodu do państw basenu północnego Atlantyku nawet o 40%. Transport morski wodami arktycznymi mimo wciąż trudnych warunków nawigacji i komunikacji rozwija się dynamicznie. Brak wystarczających regulacji prawnych dla regionu i duże zagrożenie dla środowiska naturalnego stały się przyczyną do prac nad normami regulującymi żeglugę na obszarach polarnych. Z dniem 1 stycznia 2017 roku w życie wszedł opracowany przez Międzynarodową Organizację Morską Międzynarodowy Kodeks dla Statków Uprawiających Żeglugę na Wodach Polarnych, zwany Kodeksem Polarnym. Celem Kodeksu Polarnego jest zapewnienie bezpieczeństwa i ochrona środowiska morskiego.
