The suggested amendment to the Labour Code aims to introduce a provision obliging employers to include periods of non-agricultural activity in the periods on which employee benefits or rights depend. The provision is to be placed in the chapter declaring fundamental principles of labour law. The author states that there is no systemic justification for including this type of norm among the basic principles of labour law, without taking into account the currently used differentiation of the position of employees in specific situations. In her opinion, the proposed regulation raises doubts from the perspective of the constitutional principle of equality, especially in the context of adequacy and proportionality to the assumed goal.

The labour inspector’s statement constitutes a non-statutory form of enforcing labour rights. In this context, we can see a variety of problems related both to the impact of the legal measure itself, appealing against it, as well as to the role it plays in ensuring compliance with employment rights. The jurisprudence and literature to date indicates explicitly that the employer’s failure to comply with the content of the labour inspector’s speech does not give rise to any negative legal consequences. Nevertheless, employers who do not agree with the solutions recommended by the authority through the labour inspector’s speech perceive this specific measure as a special type of decision. The decision itself, in turn, seems to be a natural manifestation of the state, the authority indicating to the subject of law the individual directions of its behaviour. However, this is, in fact, a different act. The article doubts the implementation of the model of labour supervision and control assumed by the legislator in the light of the measure outlined in the labour inspector’s speech. As a result, allowing this measure to be left to the inspector’s discretionary use may lead to the reinforcement of the feeling of a lack of efficiency on the part of the state bodies in the field of protection of workers’ rights, especially that the cases of its use are an open catalogue, which includes issues such as working time or the employment of young people. In order to better understand these trends, two examples are discussed where the National Labour Inspectorate had an impact on situations of a gross violation of labour law standards. A de lege ferenda direction has also been indicated, which means the creation of the institution of “re-inspection” of the employer. The existence of a non-authoritative “recommendation”, which is a statement by the labour inspector, is in fact a manifestation of the implementation of Article 17, paragraph 2 of the ILO Convention No. 81, which would not be incompatible with the consequence in the form of addressing a statement.

Poland is one of the European countries undergoing intensive legal and economic changes (increased retirement age, changes in the labour market) aimed at reducing the negative consequences of population aging and shrinking labour force. The changes in the demographic structure, as evidenced by low birth rate and increasing life expectancy are causing increased pressure on public pension expenditures. Implementation of the procedures intended to increase the retirement age requires obligatory coordination with the measures taken by the state in the area of labour market to support economic activity of individuals within the pre-retirement age bracket. This translates into the need to make the best use of the existing labour market instruments, employment services, and to support effective cooperation between labour market participants – mainly employers, but prospective employees as well.

The main purpose of this paper is to analyse the interdependence between labour productivity and the occupational structure of human capital in a spatial cross-section. Research indicates (see Fischer 2009) the possibility to assess the impact of the quality of human capital (measured by means of the level of education) on labour productivity in a spatial cross-section. This study attempts to thoroughly analyse the issue, assuming that apart from the level of education, the course of education (occupation) can also be a significant factor determining labour productivity in a spatial cross-section. The data used in this paper concerning labour force structure in major occupational groups in a regional cross-section comes from a Labour Force Survey. The data source specificity enables the assessment of labour force occupational specialisation at the regional level and the estimation of this specialisation at the subregional or county level. An in-depth analysis of the occupational structure of the labour market in a spatial cross-section is an important theoretical and practical area of study necessary for the development of effective labour market policies and the education system.

Self-report Labour Anxiety Questionnaire (KLP II) was developed to asses the level of labour anxiety in pregnant women. This short tool consists of 9 items, which include attitudes toward labour and fear of labour. The questionnaire was valided on 53 pregnant women. The results of the study indicate that the Labour Anxiety Questionnaire (KLP II) is reliable and valid method to identify pregnant women with high level of labour anxiety.

The autoress presents the results of her research of the labour migration in the Ukraine under transformation of economic and social relations. The principal attention is paid to the status positions of labour migrants in the social hierarchy of Ukrainian society, the system of their values and life strategies, the style and a mode of life, the behaviour at the labour market, public feelings. The foreign policy orientations and home politics priorities of labour migrants, their market intentions and expectations, self-appraisal of the participation level in decision-making and protest potential are examined as well. Labour productivity is a key factor of economic growth and change in living standards and plays an important role as a measure of the competitiveness of countries. Both the increase and decrease in productivity affects the functioning of all forms of economic activity. The lack of awareness of this fact may have a negative effect on the fate of investments. This is particularly evident in the case of industrial companies. The purpose of this article was to examine the external and internal determinants defining performance in Poland and the analysis and evaluation of selected countries. The period under research was 2001–2014, although at times this time period was extended to earlier years or shortened, depending on the availability of data. Analysis of theoretical and empirical research results both for EU and OECD countries has shown that awareness of the direction in which productivity is moving, is essential for the functioning of national economies. Productivity can be moulded, so it is important to understand that it is dependent on the conditions offered by the employer. It is difficult to explicitly specify its degree of impact. Any change positive or negative experienced by employees will have a larger or smaller effect on productivity. In the analysed period, it was found that there is a high productivity in Poland; however, this is not equivalent to high value of goods produced by workers. Despite the apparent significant improvement in the indicators since 1989, Poland has a long way to go before levelling with the richest countries in the European Union and the OECD

The aim of this paper is to discuss the regional labour market policy response to demographic ageing in Sweden and its consequences on the labour supply of young adults. Regions with ageing problems already experience significant problems at the labour market. The overall conclusion is that labour market policies in Sweden addressing the consequences of ageing fail to include young adults and the policies do not address regional heterogeneity regarding e.g. ageing and youth unemployment.

Fighting unemployment in the EU has been and still is the most serious challenge to economic policy. Poland’s entry into the EU meant not only the opening of European labour markets to Poles, but also significant transformations that made our market more flexible and which have helped alleviate the effects of the global financial crisis. The new situation is a new challenge with regards to increasing productivity and the ability of the economy to create new jobs. Unfortunately, apart from the positive effects of the transformation, unfavorable phenomena have emerged including the too-frequent use of fi xed-term contracts by employers. This unfavorable phenomenon lessens an employer’s motivation to invest in an employee and to improve his or her qualifi cations and in the longer term worsens the socio-economic situation. The author of this article has attempted to assess the functioning of the labour market, taking into account the years 2012–2016. The choice of this particular period is directly related to the pace of the economic changes that took place at that time and the incubation of new, unidentified problems such as the following; the impact of EU funds on increasing the competitiveness of employers in the employment process and the phenomenon of the economic and financial recession, which at the turn of caused a signifi cant rise in unemployment and a decrease in employment.

In the publication, there was conducted the analysis of labour market policy in the United Kingdom in area of implemented reforms of social policy, which were begun by the New Deal Program up to the conception of Universal Credit. The publication was devised on the base of research, which were made in London in September 2011. They included interviews with representatives of both public and private labour market institutions. The respondents came from the Department for Work and Pensions and two British employment providers, which have significant meaning for the employment services, they participate regularly in the state Work Programs and they create British social policy. Moreover, the author, in the publications, recommends some of the British solutions, which are worth implementing in Polish social and economic reality

Motivation: The academic debate on whether the relationship between factor mobility and international trade is one of complementarity or substitution is inconclusive. In general, the relationship between the two can vary depending on the specific research methodology and the object of study. Moreover, there are fewer empirical analyses with China and the European Union as subjects, so studying the relationship between labour mobility and trade in the case of China and Europe is worthwhile. Aim: The purpose of this paper is to determine, through empirical analysis, the relationship between labour mobility in the form of dispatched labour and bilateral trade between China and the European Union in the period of 2005-2021. Materials and methods: This paper utilises quantitative analysis to investigate the relationship between labour movements and trade (imports and exports) based on data from 2005 to 2021, primarily through co-integration analysis and Granger causality testing. Results: The study found that there is a substitution relationship between the number of dispatched labour from China and the trade in goods between China and the European Union in the research period. Additionally, Granger causality tests show that China's dispatched labour to the EU is the Granger cause of China-EU export trade, and vice versa. However, China's dispatched labour to the EU is not a Granger cause of China-EU import trade.

The paper focuses on methodological aspects of labour market research on the basis of Labour Force Survey (LFS) in Poland. The analysis shows that methodology covers both the subject of research (the scope of research as well as aspects of researched reality) and applied scientific methods. Scientific methods should be adjusted to the scope of research and the aim of research. Labour Force Survey conducted in Poland since 1992 constitutes an important source of information about labour market. It enables to conduct research on labour demand, labour supply, structural imbalances and, moreover, on basic relationships which exist on labour market. Knowledge of basic labour market theories facilitates such research. Mathematical approach and quantitative methods, especially econometric methods, are of great importance for explanation of relationships existing on labour market (thus, when research is conducted within the scope of positive economics); nevertheless, they are insufficient when labour market research is conducted within the scope of normative economics or economics as art.
Przedmiotem artykułu są metodologiczne aspekty badań rynku pracy na przykładzie badań aktywności ekonomicznej ludności w Polsce. Z analizy wynika, że metodologia badań obejmuje zarówno przedmiot badań (zakres badań i rodzaj aspektów badanej rzeczywistości), jak i stosowane metody badawcze. Metody badawcze winny być dostosowane do przedmiotu i celu badań. Badania aktywności ekonomicznej ludności prowadzone w Polsce od 1992 r. są ważnym źródłem informacji o rynku pracy. Umożliwiają podejmowanie badań na temat podaży pracy, popytu na pracę, niedopasowań strukturalnych, a także podstawowych zależności występujących na rynku pracy. W badaniach tych pomocna jest znajomość głównych teorii rynku pracy. Podejście matematyczne oraz metody ilościowe, zwłaszcza ekonometryczne mają zasadnicze znaczenie dla objaśnienia zależności występujących na rynku pracy (a więc, gdy prowadzone są badania w kategoriach ekonomii pozytywnej); są one jednak niewystarczające gdy badania prowadzone są w kategoriach ekonomii normatywnej i ekonomii jako sztuki.

There are numerous pathologies in the labour market. However, until now, no effort has been made to approach this subject from the perspective of criminology. In this study, I use the conceptual apparatus of criminology to create a model describing negative phenomena on the labour market. The key element of this model is referred to as a labour market delict (violation), a term which denotes any behaviour by a participant in this market which may lead to infringement of the rights of or damages to the possessions of another market participant, or which may create a threat to the common good, such as social order or justice, or which puts into question the economic and social meaning of work. Delicts of the labour market can be recognized in several areas, such as those involving wages, partner obligations, safety, or duties towards the workplace. The article also contains a theoretical model of labour market delicts and an analysis of preliminary empirical survey of this issue.

The aim of this study is to present, analyze and assess the level and relations of labor costs and productivity in Poland and European Union. Analyses of labor markets in European Union states show that these markets are characterized by very similar measures regarding the levels of professional activity, unemployment rate and efficiency of labor market policy programs. However, the difference in the level of wages still remains high. Among the reasons for this phenomenon we can indicate the levels of labor costs and productivity, which determine the levels of wages in particular member states. Thus the subject of this paper is the analysis of the levels of labor costs and productivity in Poland versus those in European Union. The thesis stated in the study is that the maintained differences in wages in European Union may be explained by differences in the levels and relations of labor costs and productivity, which are discussed in detail in the study.
