    The Sejm’s participation in drafting of the EU law is mainly expressed indirectly, i.e. through the implementation of EU law on a national level. The main role in the process is played by a specialized body of the Sejm: the European Union Affairs Committee. The subject of activity of this Committee is analysing documents drafted by EU institutions. These include, in particular, draft EU legislative acts to be adopted, according to direct treaty basis, directly by the Council and the European Parliament. The Committee uses its competences by means of a legal and factual analysis of documents, both of EU and national origin, related to EU legislation.

    Polskie członkostwo w Unii Europejskiej znajduje wyraz m.in. w zaangażowaniu Sejmu w proces tworzenia prawa UE. Zasady tego udziału określone są w niejednorodnym, zmiennym i ustawicznie się rozwijającym korpusie unijnej i krajowej regulacji prawnej. Złożona natura tej regulacji, która sięga zakresem od podstaw ustroju władzy publicznej do proceduralnych niuansów parlamentarnej praktyki, dostarcza wielu wyzwań wszystkim podmiotom, które tę regulację stosują. Prezentowany artykuł zmierza do ukazania tej złożoności i podjęcia kilku kwestii problemowych, które ujawniają się w parlamentarnej praktyce w sprawach europejskich. Rozważane zagadnienia zostały wybrane z uwagi na doświadczenia oraz najlepsze praktyki zgromadzone przez parlamentarne służby prawne: Biuro Legislacyjne i Biuro Analiz Sejmowych. Wszystkie mają systemowy charakter i – jak się wskazuje w artykule – wywodzą się bezpośrednio z wciąż nierozstrzygniętego problemu konstytucyjnej podstawy dla nowych, „unijnych” kompetencji parlamentów narodowych. W artykule podjęte zostały ustalenia na temat kontroli działań podejmowanych przez sejmową Komisję do Spraw Unii Europejskiej, współpracy międzyparlamentarnej i kontroli przestrzegania zasady pomocniczości oraz reprezentacji prawnej Sejmu na forum unijnym.
    Polish membership in the European Union finds its expression, among other things, in the powers of the Polish Sejm to participate in the European law-making process. The rules of this participation are provided for in the heterogeneous, fluctuating and evolving body of European and domestic law. Its complex nature, stretching between the constitutional foundations of political power, on the one hand, and the procedural matters of the parliamentary practice, on the other, offers a wide range of legal challenges to anyone who applies it. The paper aims to reveal that diversity and addresses some aspects of parliamentary practice when dealing with matters involving the EU. The issues of concern are selected with respect to the experience gained and best practice developed by the Sejm’s legal services: the Legislative Bureau and the Bureau of Research. All of them are systemic and – as it is argued – derived directly from the still unsettled question of the constitutional basis for the newly acquired competences of the national parliament to act on the European stage. The paper deals with the accountability of the Sejm’s committee for EU matters, cross-border interparliamentary cooperation and the subsidiarity check, as well as the legal representation of the Sejm in the European forum.

    This paper deals with the regulation which specifies the rules in which the Sejm affects the policies of the European Union. It examines the assumptions for change in respect of the Act of 8 October 2010 on Cooperation of the Council of Ministers with the Sejm and the Senate in Matters Related to the Republic of Poland’s Membership in the European Union, as well as the Standing Orders of the Sejm. The proposed changes relate primarily to the socalled a general mechanism of cooperation in the field of EU law making between the Council of Ministers and the Sejm and the Senate. It is assumed that general principles relating to the so-called political dialogue and the carrying out by the Sejm of notification duties will be introduced by the Cooperation Act. The proposed amendment to the Standing Orders of the Sejm deals with participation by the branch committees in consideration of documents that are sent to the Sejm by the EU institutions, as well as the participation of the Sejm operating at plenary sitting in activities related to Poland’s membership in the EU.

    In Polish law there is no comprehensive regulation concerning the implementation of the notification obligations under EU law, which is associated with the need to establish rules that would clearly define the jurisdiction of the authorities in matters of notification and clarify the procedure for transfer of the notified document to the addressee. The author presents possible solutions of this problem, according to which the notification of the Act shall be carried out in two separate procedures, identified and described in the article, relating to the notification document concerning measures that go beyond EU harmonization standards and concerning the notification documentation in relation to technical regulations.

    The proposal is worthy of support from the government in the Council of the EU. The draft position of Polish government on the proposed directive does not raise doubts, and the impact assessment of the proposal contained therein is consistent with the assessment by the Bureau of Research of the Chancellery of the Sejm. The draft position was submitted to the Sejm 30 days after the expiry of the time limit specified by the so-called Cooperation Act.

    The opinion presents the most important assumptions of the Draft General Budget of the EU for the fiscal year 2019. The document contains description of priorities adopted during drafting, planned revenues, expenditures, and changes over time (compared to the previous budget) in the projected amounts. The Polish government’s position on the 2019 Draft General Budget is positively assessed, including the government’s statement that during the work on the budget it will be striving for provision of the financial resources necessary to repay the liabilities contracte earlier by the Member States on behalf of the EU budget (it is particularly related to cohesion policy and development of rural areas – both being very important investment instruments in the EU).

    This opinion evaluates four Deputies’ bill as to whether or not they are in conformity with three new EU directives on public procurement. The presented analysis confirms the compliance with EU law of a Deputies’ bill included contained in Sejm Paper No. 1076 and welcomes the extension of the catalog of evaluation criteria to include the criterion of innovative character of proposed solutions. The authors find the bill contained in Sejm Paper No. 1226 to be incompatible with EU law, because contrary to EU law it presupposes the primacy of the criterion of the lowest prices over other criteria. The bill included in Sejm Papers No. 1335 and No. 1635 are found partially incompatible with EU law, due to the lack of objectively justified reasons for division of public procurement into those representing functional and technical unity, as well as a violation of the principle of equal treatment and transparency.

    The primary purpose of the proposed amendment of the VAT Directive is to reduce the administrative burdens imposed on businesses in relation to VAT. The Directive deals with technical, but also important aspects of the functioning of VAT. The authors point out that standardization of information contained in a VAT return will reduce the bureaucratic burden on businesses and is particularly beneficial for SMEs. They conclude that the proposed solutions require in‑depth assessment of their impact, especially on the State budget, including its liquidity and the cost of implementation. They state that the proposal does not breach the principle of subsidiarity.
