Ces analyses savantes lui ont permis de formuler de nombreuses remarques et commentaires, ainsi que des postulats concernant cette loi. “Today, organized crime is affecting every segment of our society. It is a disease which infects everything that comes into contact with it. It is an insult added to every law-abiding citizen. It is high time our governments made a note and, moreover, took immediate action. Perhaps tomorrow will be late.” Organized crime is a form of criminality manifestation, perhaps its most specific type. It is a phenomenon that causes horror as much as wonder about the way it works and, at the same time, a sort of lure for its mystery and the particular way of comprehension. For years and years it has inspired volumes of writing, plenty of which have become best-sellers, or have produced blockbusters, arousing amazing mass interest. That is because criminal organizations and their activity have been to society both a tangible everyday reality and a remote thing, beyond comprehension. Many authors have researched into organized crime and criminal organizations, pointing out their characteristics and specifics. They attribute such features to it as a perpetual connection of many people engaged in criminal activity, an organizational hierarchy with a great power of the leaders, the domination of rule and order, discipline and responsibility among the members, imposed solidarity, maintaining the secrecy of activity and of the organization, and the international character of their activity. Unfortunately, there are a large number of worldwide notorious criminal organizations. Over time, they have been discovered and studied by various criminologists, who have managed to provide sufficient information on the specific features of each of them, the activities on which they focus and the territories in which they operate. But what means should we use in order to face organized crime today? It is necessary that differentiated strategies be studied according to the type of the mafia organization against which a concrete operation is to be launched. The strategy should also be coordinated not only in national level but also internationally, because the international character of organized crime is already an established fact.

Given that “migration” is a global phenomenon, the international community as a whole had to provide it with a legal basis and to find global solutions, as proven à l’évidence by both the international and the European legislation and the “Global Compact for Migration” approved by the European Council. As is well known, the European Union legislation consists of the texts of its official instruments, such as conventions, treaties, declarations, etc., in which we also find, in fact, the principles stated in the international instruments, which have, indeed, the force of jus cogens for all the states of the world, concerning the universal human rights, including, thus, the rights of the migrants. However, even in terms of their policy regarding migrants, the member states of the European Union have not only applied the principles stated in these international instruments, but they also have enacted a special legislation, and they have taken concrete measures for the implementation of its rules. In the present article I offer the reader the possibility to become acquainted not only with the text of the legislation of the European Union regarding migrants, but also with the policy and the actions taken by the European states for the implementation of the international legislation, and of the European one regarding the social rights of the migrants as workers.

The third partition of Poland, and thus the collapse of the Polish state, spontaneously forced a situation in which the legal orders of the partitioning states came into force almost immediately on Polish lands. In the lands divided between Prussia, Russia and Austria, legal acts of the partitioning states came into force with a strong influence of models derived from French legislation. The Polish lands which came under Austrian rule found themselves in the reality, in which the Austrian legislator conducted codification works on the new penal code, which resulted in the fact that in 1787 the penal code of Joseph II, called Josephine, became binding. As early as 1803, a penal code was introduced in Poland, which was under Austrian rule, under the name of the Book of Laws on Crimes and Serious Police Crimes called Franciscan. In the German annexation there was the Prussian Landrecht, which was characterized by a current far removed from the European science of law. On the territory of the former Duchy of Warsaw a Penal Code for the Kingdom of Poland was introduced. In Russia in 1903, the Tagantsev’s Code came into force, which in its systematics divided crimes according to their gravity into crimes and misdemeanours and clearly separated minor offences. The characteristics of criminal legislation until 1918 made it possible to show the enormity of the work of the Codification Commission, the aim of which, after Poland regained independence, was to create a uniform and coherent Polish legal system, not only in terms of social life standards, but also in the area of the catalogue of its areas.

Dobre funkcjonowanie mechanizmów finansowych państwa wymaga sprawnego prowadzenia polityki finansowej, w tym polityki podatkowej. Przewidywalność zmian prawa podatkowego stanowiących wyraz realizacji polityki znanej podatnikom jest zgodna z zasadą pewności prawa, gdyż istotnie redukuje ujemne konsekwencje braku stabilności. Jak wiadomo, posiedzenia Sejmu i Senatu są jawne. Jawne powinny być jednak także projekty przepisów prawa podatkowego, a nawet założenia owe projekty poprzedzające. Z jednej strony umożliwiłoby to, a co najmniej znacznie ułatwiło, przeprowadzenie odpowiednich konsultacji publicznych, z drugiej zaś redukowało niepewność podatników co do przyszłego prawa. W toku prac nad projektem należy dbać o poprawność języka prawnego i szanować zasady techniki prawodawczej. Konsultowanie i opiniowanie projektów przepisów podatkowych przez różne podmioty, w tym przez ekspertów, ma olbrzymie znaczenie dla prac ustawodawczych. Prowadzenie konsultacji z udziałem podatników, przedstawicieli organizacji społecznych, samorządowych i gospodarczych oraz samorządów zawodowych ma wpływ na jakość prawa i sprzyja odpowiedniemu wyważeniu interesu publicznego i prywatnego w prawie podatkowym. W przypadku niezrozumiałego przepisu, podatnika winna chronić zasada in dubio pro tributario. Przepis taki nie może być także podstawą zastosowania wobec podatnika sankcji. Do zasad podatkowych mających największe znaczenie z punktu widzenia praw podatnika należy zasada pewności. Pewność i bezpieczeństwo prawne podatnika ściśle wiążą się z zasadą lex retro non agit. Ważne są też zasady: ochrony praw nabytych i ochrony interesów w toku. Warto podkreślić, że projekt ustawy Karta Praw Podatnika wniesiony niedawno do Sejmu niemało miejsca poświęca przepisom dotyczącym stanowienia prawa podatkowego. Obserwacja praktyki dowodzi, że takie przepisy są potrzebne, gdyż przyczyniłyby się z jednej strony do poprawy jakości naszego prawa podatkowego, z drugiej zaś do wzmocnienia ochrony praw podatnika.
The proper functioning of the state’s financial mechanisms requires efficient financial policy, including tax policy. The predictability of changes in tax law implementing a policy known to taxpayers is consistent with the principle of legal certainty, as it significantly reduces the negative consequences of instability. As is known, meetings of the Sejm and Senate are public. However, draft tax law provisions and even assumptions preceding these drafts should also be public. On the one hand, this would enable, or at least significantly facilitate, appropriate public consultations, and on the other, it would reduce taxpayers’ uncertainty about future law. In the course of work on the draft, care should be taken to ensure the correctness of the legal language and to respect the principles of legislative technique. Consulting and issuing opinions on draft tax provisions by various entities, including experts, is of great importance for legislative works. Consultations with the participation of taxpayers, representatives of social, self-government and economic organizations as well as professional self-governments have an impact on the quality of law and promote the proper balance of public and private interests in tax law. In the event of an incomprehensible provision, the taxpayer should be protected by the in dubio pro tributario rule. Such a provision cannot be the basis for applying sanctions to the taxpayer. One of the most important tax principles from the point of view of taxpayer’s rights is the principle of certainty. The taxpayer’s legal certainty and security is closely related to the lex retro non agit principle. The principles of protecting acquired rights and protecting ongoing interests are also important. It is worth emphasizing that the draft Taxpayers’ Rights Act recently introduced to the Sejm, devotes quite a lot of attention to the provisions on tax law making. Observation of practice proves that such provisions are needed because they would contribute to improving the quality of our tax law on the one hand and strengthening the protection of taxpayers’ rights on the other.

The European Commission directive has been transposed into national law (“Gesetz zur Demonstration und Anwendung von Technologien zur Abscheidung, zum Transport und zur dauerhaften Speicherung von Kohlendioxid” vom 17. August 2012 – KSpG). The national law allows a limited amount of CO2 to be stored underground for demonstration purposes until 2017. At the end of 2017 the effectiveness and application of the law shall be reviewed. The execution of the federal law is regulated by state legislation. Even before that above mentioned date, on May 30th 2012, the state of Mecklenburg-Vorpommern passed a state law prohibiting the storage of CO2 within the state territory and in the Baltic Sea, out to the 12 NM limit. In 2014 appeared a similar state law. On March 27th 2014 Schleswig-Holstein passed a state law banning CO2 storage in all regions of the state territory including the 12 NM zone in the Baltic and North Sea. The government of Lower Saxony prepared a comparable state law, which is expected to be finalized soon, exluding the storage in the entire state territory. The parliament and government of Brandenburg have rejected a proposal of the green party (Die Grünen) for a state law prohibiting CO2 storage in Brandenburg, as they do not want to exclude the entire territory without an examination of each individual site. However, without common criteria for the suitability or exclusion of regions for CO2 storage on a federal level, Brandenburg does not want to allow further storage projects, apart from the research storage in Ketzin. Most of the CO2 storage potential in Germany is expected to be in the North German basin. The four states that currently exclude CO2 storage, cover most of the area of this basin. Which reduces the potential area for CO2 storage demonstration projects in Germany considerably. The federal KSpG includes various issues that shall be regulated in decrees that shall be elaborated in agreements between federal and state governments. Amongst those issues are also specifications for suitable storage sites, which are claimed by Brandenburg as a prerequisite for permitting future storage projects. Because of the fundamental differences between the federal and some state governments, none of these decrees has been produced jet. These legal uncertainties and other obstacles, such as the low carbon credit price, are the reason why all planned industrial demonstration projects in Gemany, proposed by Gas de France, RWE, and Vattenfall, have been withdrawn. Thus, CCS does not seem to be a promising option in the national climate protection portfolio for the near future in Germany. However, despite of the current pessimism in Germany, the global progress of CCS projects, especially in combination with its utilization, mainly for enhanced oil recovery, must not be forgotten. And, storage underneath of the North and Baltic Sea out off the 12 NM-boundary is still an option. Both in national and in international waters.

This article is devoted to the temporary legislation issues as multifunctional legislative instruments, which can be efficiently used in the current dynamic of social, political, information, communication and economic processes. The author regards main scholarly advantages and drawbacks of the introduction of temporary legislation in lawmaking, particularly in the context of stability and predictability of legal regulation, equality of participants in the legal relations. The factors determining the practical necessity of temporary regulation (particularly, innovative products, introduction of new public regulation or economic regimes political or military crises, pandemic) are systematized in this article. It also introduces the review of international experience of application of a temporary regulation in the countries with different legal systems, which shows ways of practical usage of this instrument and lack of systemized approaches for it. The author suggests distinguishing between two main types of temporary regulation - temporary (transitional) and experimental - and identifying potential areas of practical application of such regulation, in particular: rapid response to temporary topical problems, decision-making in highly unpredictable situations, more dynamic regulation of innovation and development. At the same time the systematic modeling of introduction and expiration date of temporary regulation is indicated as the main requirement for the effective implementation of such regulation in compliance with the principle of rule of law. Overall, the author concludes that to be effective, efficient and prospective tool of regulation temporal regulation has to be based on the principles, methods and restrictions of its application, which in turn have to be developed by lawyers.

The aim of the paper is to show the state and changes in the school legislation of the Catholic Church in the crucial period of its history, between 1378 and 1477. The focus of the analysis is especially on the acts of law decreed by the popes, on the canons of the councils, but also on the ius particulare of those ecclesiastical provinces that were affected by the Hussite movement. Also, factors influencing the ecclesiastical law in the realm of education are analysed, such as political, social, economic besides religious. Very important was the question if the changes could be controlled or inspired by the Church or whether the changes of the school legislation were only meant to preserve the status quo.

The coordination of social security systems is regulated in the primary law of the European Union (Regulations No 883/2004 and 987/2009), which causes that the provisions are directly applied in the Member States. The general principle is the right to be subject to the legislation of a single Member State, which means that the designated institution of the Member State and other entities cannot make Determination of the legislation applicable and the principle of being subject... – 169 – 2/2014 I US NOVUM a person excluded from a social security system or make him/her subject to the social security system of more than one Member State. In this light, the procedural aspects of determining the applicable legislation, especially the determination of the provisional legislation, seem to be particularly interesting. The article aims to present the issues connected with the determination of the legislation applicable, including the provisional one, and to consider the relations between the institutions of the Member States and between the institutions and the persons concerned as well as appellate organs.
Koordynacja systemów zabezpieczenia społecznego regulowana jest w prawie pierwotnym Unii Europejskiej (rozporządzenia: 883/2004 i 987/2009), co sprawia, że przepisy te są w państwach członkowskich stosowane bezpośrednio. Generalną zasadą jest podleganie ustawodawstwu jednego państwa członkowskiego, co sprawia, że zarówno instytucja właściwa państwa członkowskiego, jak i inne podmioty nie mogą doprowadzić ani do wyłączenia zainteresowanego z jakiegokolwiek systemu zabezpieczenia społecznego, jak i do objęcia go systemem zabezpieczenia społecznego więcej aniżeli jednego państwa członkowskiego. W tym świetle szczególnie interesująco przedstawiają się proceduralne aspekty ustalania ustawodawstwa właściwego, w szczególności wobec możliwości ustalenia ustawodawstwa mającego zastosowanie w sposób tymczasowy. Celem artykułu jest przedstawienie zagadnień związanych z określaniem ustawodawstwa właściwego, w tym również w sposób tymczasowy, uwzględniające relacje zachodzące zarówno pomiędzy instytucjami państw członkowskich, jak i relacje pomiędzy tymi instytucjami a zainteresowanym oraz organami odwoławczymi.

It is expected that people from all over the world will visit Ukraine after its victory in the war against Russian aggression, turning Ukraine into a world-popular tourist destination. Hence, Ukrainian egislation on tourism must be improved in the post-war period. The authors analysed the current legislation on tourism in Ukraine and identified major problems that must be addressed systematically and those that should be settled in the post-war period in view of the post-war humanitarian, socio-economic, institutional, and cultural challenges. In this context, the authors proposed a set of changes to improve Ukraine’s legislation on tourism on the national and institutional levels. Such changes should positively impact other socio-economic processes of reconstruction in post-war Ukraine.

Research objective. Legislative processes are important due to the fact that little attention is paid by the market as well as market models of economic development to the issues resulting from the exploitation of the natural environment. Currently, the crucial actions to protect the natural environment include setting up legal regulations that would reduce the degradation of nature caused by consumer behavior. The aim of this article is to analyze and evaluate the selected legislative solutions pertaining to the protection of the natural environment in the European Union and Poland. The research problem and methods. The analysis of legislation and legal regulations pertaining to the environmental protection in the context of the selected issues spans the timeframe of 2015-2020. The conducted study pertains mainly to legal acts including regulations as well as directives. The process of argumentation. The function of the state in the economy was described to explain the role of the policy adopted for the environmental protection. Further in the considerations, the analysis included selected legal regulations observed by the EU member states. Evaluation was made in terms of incentives and other solutions in the area of economic instruments and other solutions facilitating the implementation of sustainable development premises. Research results. The sources of law of the European Union are an important constituent part of the national system of environmental protection. Domestic regulations are more and more frequently supplementary and executive in nature. The results of research show the selected suggestions and evaluate the legal solutions adopted within the analyzed timeframe. Conclusion, innovations, and recommendations. Legislative solutions should yield benefits both to the manufacturers as well as the economy. Ecological awareness is equally important, setting social responsibility for the environment as a model conduct.

Transport, zgodnie z zapisami traktatu unijnego, jest obszarem wspólnej unijnej polityki gospodarczej, a celem organów unijnych i rządów państw członkowskich jest stworzenie wspólnego europejskiego rynku transportowego. Rynek ten powinien podlegać wspólnym regulacjom prawnym, zaś istniejące lokalne przepisy krajowe powinny być zharmonizowane z aktami prawnymi Unii. Żaden z lokalnych przepisów prawnych nie może być sprzeczny z prawem unijnym, które jest nadrzędne w stosunku do prawa krajowego.

This publication is an attempt to answer the question: what was the role of the criminal penalty, especially in its strictest form (summum supplicium) in the Roman legislation of Christian emperors? Finally, whether is it noticeable, based on the example of summum supplicium, that Christianity influenced the Roman criminal law in any way? As it has been demonstrated, the new state religion did not radically change the Roman criminal legislation. The legislation of the Christian emperors confirmed both, the division of society into servi and liberii that had existed for centuries in the Roman state and the diversity of the legal situation of individual social groups. Punishment in the legislation of Christian emperors continued to fulfil the role it had played in the previous centuries and became, even more than ever before, an essential tool for the political struggle of the present state authority. The finest example of this was the legislation of Constantine the Great, followed by all the severity of criminal repression which resulted in the issuing of this legal act. A great desire to bring about a new order, maintain power and even the fear of losing it can be detected in the strictness of the Constantine’s legislation. Finally, the once persecuted Christians began to behave like their previous persecutors.
Niniejsza publikacja została poświęcona próbie udzielenia odpowiedzi na pytanie – jaką rolę pełniła kara kryminalna, a zwłaszcza jej najsurowszy wymiar (summum supplicium), w ustawodawstwie rzymskich cesarzy chrześcijańskich? W końcu, czy na przykładzie summum supplicium można zauważyć, że chrześcijaństwo wpłynęło w jakiś sposób na rzymskie prawo karne. Jak wykazano, nowa religia państwowa nie zmieniła w radykalny sposób rzymskiego ustawodawstwa karnego. Prawodawstwo cesarzy chrześcijańskich utwierdziło istniejący od wieków w państwie rzymskim podział społeczeństwa na servi i liberii oraz zróżnicowanie sytuacji prawnej poszczególnych grup społecznych. Kara w ustawodawstwie cesarzy chrześcijańskich nadal spełniała te funkcje, które pełniła w poprzednich wiekach, ale stała się w jeszcze większym stopniu niż do tej pory, zasadniczym narzędziem walki politycznej obecnej władzy państwowej. Najlepszym tego przykładem było ustawodawstwo Konstantyna Wielkiego, ale także cała surowość represji karnej, której efektem było wydanie tego aktu prawnego. W surowości ustawodawstwa Konstantyna widać wielką chęć zaprowadzenia nowego porządku, utrzymania władzy, ale jeszcze bardziej strach przed jej utratą. W końcu prześladowani wcześniej chrześcijanie zaczęli postępować tak, jak ich poprzedni prześladowcy.
