    Opis:
    Subjective judgment of the prosperity in Poland does not become better despite a constant economic growth. CBOS (Centre of Public Opinion Research) researches show that for Polish people (97%) health is the most essential matter and that 75% persons are dissatisfied with the health service activity. Even only these numbers let observe the lack of the public prosperity optimization in Poland. Public utility services are personal, so they affect directly a feeling of the well-being. Undoubtedly, the quality of the services mentioned affects positively or negatively the prosperity of the whole population. A possibility of a public utilities evaluation in five dimensions has been shown in this paper: (1) in a professional dimension, i.e. efficiency; (2) in an economical dimension, i.e. productivity; (3) in a process-wise dimension, i.e. TQM; (4) in a personal dimension, i.e. consumer satisfaction; and (5) in a social dimension, i.e. public prosperity improvement.

    Objectives: To seek for the optimum economic model for public utility services in the sector of municipal waste management; to present the results of studies regarding the efficiency of companies in the sector of management of municipal waste and the systems that such companies function within. Research Design & Methods: Multi-criterion rankings with the use of synthetic variable, the structure of which has been based on zeroed unitarisation (method of zeroed unitarisation – MZU). Owing to general financial data, technical and operational data, as well as output data, it was possible to determine rankings of effectiveness for companies in the system of municipal waste management and communes. What is more, a correlation diagram was created – the dependency between the aggregated effectiveness of companies and the aggregated effectiveness of waste management in communes. Findings: Communes which entrust municipal companies with management of an integrated system for municipal waste management or/and its individual chains feature more properties of operating, economic, and financial effectiveness within the scope of management of municipal waste. Implications / Recommendations: It is demonstrated that communes which entrust municipal companies with management of an integrated system for municipal waste management – or/and its individual chains – feature more properties of operating, economic, and financial effectiveness within the scope of the management of municipal waste. Contribution / Value Added: Further extended research into the organisation and management of the municipal waste management system. Article classification: The article presents an original and innovative analysis of the municipal waste management sector with the use of the developed research method of aggregation and unit efficiency ranking. The purpose is to continue the extended research on the organisation and management of the municipal waste management system.

    This dissertation provides comments on the essence of social security and developmental security as a status, process, value, need, and basic civil right as well as the role of the state in eliminating threats to such security. Issues related to the role of welfare as an institution of the state’s social policy in providing security to individuals and families in difficult or crisis situations have also been discussed. The dissertation describes the level of involvement of Krakow non-governmental organizations in running welfare institutions and providing high-quality public utility services as well as presents examples of good practices by Krakow non-governmental organizations providing social and developmental security to selected categories of people.

    The main objective of this article is to determine the effectiveness of enterprises providing municipal services and a model approach for processes related to the provision of local public transport services in Poland. In particular, the identification included methods of organisation and implementation of public utility tasks as well as organisational and legal forms and forms of ownership in the case of local collective transport. An attempt has been made to determine the effectiveness of enterprises providing urban transport services in cities in Poland, assessing their operational, financial, technical and social effectiveness. The research design and methods used in this article are based on the assessment of the effectiveness of enterprises using taxonomic methods of grouping e ntities according to selected characteristics and efficiency measures. The use of the k-means method with the number of clusters determined on the basis of the hierarchical Ward method, in which the contribution of variables to the differentiation of clusters was determined on the basis of a one-way analysis of ANOVA variance, to obtain groups of companies with similar efficiency indicators. The findings, based on the conducted research, present the relationship between the economic efficiency of public transport companies and their organisational and legal form as well as the type of ownership. Recommendations from empirical studies indicate that public enterprises operating in the field of municipal services provide public utility services with a higher level of economic efficiency than other distinctive groups of carriers. The added value is that the research methods presented in this work can be successfully applied to other sectors of the economy and other countries in order to verify the effectiveness of individual organizational, legal and ownership forms of enterprises.

Nadal jednak nie rozwiązano wszystkich problemów, które będą determinowały realizację i finansowanie usług użyteczności publicznej w przewozach pozamiejskich. W artykule zwrócono uwagę na istotne kwestie stanowiące zagrożenie dla funkcjonowania tego rynku.

    This study addresses the problem of the progressive growth of public supervision over privatized business tasks in the area of provision of a general service provided by municipal companies; the issue is presented in the comparative analysis to the regime of the public law of power companies. The undertaken analysis of the legal environment of public service enterprises is focused upon the fact that as the model of regulation of tariffs for water and wastewater enterprises (a monopolist) is amended, the recipients of their services are deprived of their right to independent administration law path for challenging such tariff as infringing their legal interests. An autonomy of an individual has been reduced in a democratic state of law and the question arises whether the actual situation is sufficiently justified; and whether the protection of an individual has been reinforced or weakened. Hence, the subject of the analysis chosen is the potential to ensure the active role of citizens in promoting and effectively achieving the integration of the EU legal system in the field of competition and consumer rights. When an individual attains its private interest, an individual may have a simultaneous participation and influence in the public sphere, in which the protection of fundamental rights is most effectively carried out in the interest of all individuals.
    Opracowanie podejmuje problematykę wzrostu publicznego nadzoru nad sprywatyzowanymi zadaniami gospodarczymi z zakresu świadczenia usługi powszechnej realizowanej przez przedsiębiorstwa komunalne — w analizie porównawczej do reżimu prawa publicznego przedsiębiorstw energetycznych. Tłem jest de lege lata wzmożenie administracyjno-prawnych środków nadzoru nad tymi podmiotami prawa. Sednem podjętej analizy otoczenia prawnego przedsiębiorstw użyteczności publicznej jest pozbawienie odbiorcy usług przedsiębiorstwa wodno-kanalizacyjnego (monopolisty), przy okazji zmiany modelu regulacji taryfowej tego rodzaju dostawców, prawa do samodzielnej drogi administracyjnoprawnej zaskarżenia taryfy jako naruszającej interes prawny tego odbiorcy. Autonomia jednostki w demokratycznym państwie prawa została ograniczona i powstaje pytanie, czy stan obecny jest wystarczająco uzasadniony, czy ochrona jednostki została wzmocniona, czy też ma miejsce jej osłabienie? Stąd przedmiotem analizy uczyniono możliwości zapewnienia aktywnej roli obywateli w promowaniu i efektywnym osiąganiu integracji systemu prawnego UE, na polu konkurencji i praw konsumentów. Przy okazji osiągania przez jednostkę jej interesu prywatnego może mieć miejsce jednoczesny udział jednostki i jej oddziaływanie w sferze publicznej, w której najefektywniej realizowana jest ochrona praw podstawowych w interesie ogółu jednostek.

    The text deals with the definition of public services and their scope in Belarus and Poland. As a result of the conducted research, it was found that it is difficult to accept one criterion indicating that the given services are public. A permanent criterion of non-payment for the services provided cannot be accepted, as there are public services which are paid for. A wide group of beneficiaries may indicate that it is a service or product of general interest. A comparison of the scope and services of public utility in Belarus and in Poland shows their wider scope present in Belarus. The aim of the study is to investigate: − whether the scope of public utility has evolved in the last thirty years, after the political transformation that took place in Poland and Belarus, − what scope of public utility services is provided by the public administration in Poland and Belarus, − whether services of general interest can be provided by private entrepreneurs in these two States. Conducting the research required the use of a comparative research method aimed at comparing the legal regulations regarding the conduct of activities in the field of public utility in Poland and in Belarus. The historical-legal method was also used to show the evolution of the scope of public utility services through the change of legal regulations.

    As a general rule, according to the Treaty any aid granted by a EU member state or through state resources in any form whatsoever which distorts or threatens to distort competition by favouring certain undertakings or the production of certain goods shall, in so far as it affects trade between member states, be incompatible with the internal market. However, under the state aid rules, public authorities are at liberty to finance services of general economic interest as they see fit, provided that such compensation does not go beyond what is necessary to ensure that the SGEIs are performed under economically acceptable conditions. Despite changes in EU law aimed at clarifying and simplifying the applicable rules public authorities providing public service compensation violate the competition rules as often as before.

    The public sphere which is the closest to the inhabitants is managed by the local government. The legislator entrusted this local government with a number of tasks that should certainly be defined as basic from the point of view of the local and regional communities. These tasks having the nature of a public interest include also tasks related to telecommunication. The local government units as entities financed to a large extent from the public funds could abuse their market position by competing with telecommunication companies, therefore, they were obliged by the legislator to comply with the rules of the market game, including fair competition. They cannot, therefore, abuse their position in the scope of telecommunication activities or in the case of developing telecommunication infrastructure or sharing it with others.

    Polish Postal Service – the biggest public utility company, has been undergoing many transformations in recent years. The process of changes began on the day when the organization unit called Polish Postal, Telegraph and Telephone Service was divided into two independent organizations: Polish Postal Service public utility company and Polish Telecommunications PLC. The former one provides many different services: from sending typical letters and parcels, through financial services to commercial activities. The market for postal services is rapidly changing under the influence of its growing liberalization and appearance of competitors. This forces Polish Postal Service to undertake actions securing its participation in the market or making it wider. Under the influence of various other factors connected with the development of the society and progress in science and technology, at the threshold of joining the European Union, Polish Postal Service is facing a serious challenge: working out a strategy that will allow a further development of this company that will be harmonized with the European market.
