The article presents the results of the study on the statements of Janusz Korwin-Mikke on the Polish political elite in the first 25 years of the Polish Third Republic. Aside from the synthesized material on the elite assessment itself, the criteria used by the author and key features of his character, as well as fragments of his life, which shaped and crystallized his views have been presented. Both these factors had major influence on the style and content of the publications of Janusz Korwin-Mikke. The article also presents a short description of the language used by Janusz Korwin-Mikke. There is also a presentation of the conclusions drawn by him on the possible improvement of the condition of Polish political elites and suggested actions to be taken in order to repair them.

The article deals with the ideological and theoretical foundations of the French constitutionalism of the Third Republic. The author notes that the Constitution of the Third Republic was a result of the continuous struggle between the supporters of the republican form of government and monarchists in the National Assembly. A compromise, reached by legislators in 1875, led to the uniting of different approaches to the organization of French governmental power in the Constitution. The views of Duke V. de Broglie, E. Laboulaye and L.-A. Prévost-Paradol were reflected in the Constitutional Law of the Third Republic. As a consequence, there was an acceptance of the institutions and authorities of public law specific to a dual monarchy. However, those public and legal institutions turned out to be indifferent to the form of government, that, in its turn, determined the longevity of the main constitutional and legal institutions, established in the last quarter of the nineteenth century.

Polish-French economic relations in the interwar period: new research postulates Summary: Economic relations of the Second Polish Republic with the French Third Republic were derived directly from political relations between these two states. Because of its position in the international arena, France set the terms of trade exchange which the Polish side was supposed to comply with. It stemmed from the economic hardship Poland was experiencing at that specific time. One possible solution was acquiring considerable French funds. The flow of goods in both directions took place, primarily, by sea, and control over the import of French products was exercised by the Polish consulates in France. Despite the increasing circulation of goods, facilitated by the newly-signed treaties and economic agreements, the overall trade balance was negative. The great economic crisis in the thirties intensified in France the use of quota policy elements, which negatively affected the bilateral relations. In these circumstances, Poland began to seek other methods of selling its domestic products, especially, to distant continents – Africa, the Middle and Far East.

One of the more important issues drawing the attention of Polish scholars and publishers in the past quarter-century has been undoubtedly the condition and role of the Polish intelligence during the social and political changes in the 20th century, with special attention paid to its engagement in the building process of the chunks of the Polish Third Republic. A thorough analysis of the aforementioned problem allows for noticing the very clear attitude evolution process and acceptable system of values, although its representatives still think themselves to be a separate social layer with clear social and political tasks to complete. From the point of view of the issue described in this article, it seems relevant in the way that these changes, above all related to new regime reality and the inevitable civilisation and generation changes, naturally influenced not only the ability to alter reality, but also the character of the visions of rebuilding and modernise the Republic, formulated within its boundaries.

The article is an analysis of the polemics of Jarosław Kaczyński with Adam Michnik. The first one took place on the pages of the underground paper in 1979. Both this one and further polemics of Kaczyński and Michnik point out a clear ideological division of the “Solidarity” camp, which did not vanish during the 25 years of the existence of the Polish Third Republic. An analysis of direct polemics of Kaczyński on the Michnik texts, television debates of them both and the attacks of the “Tygodnik Solidarność” led by Jarosław Kaczyński on the editorial board of “Gazeta Wyborcza” has been made. An answer has been found to e.g. the questions: what topics were the subject of the discussion between Kaczyński and Michnik in that time? What was the evaluation of the PPR by Michnik in texts referred to by Kaczyński, and vice versa? What was the opinion of both of them towards decommunisation?

The perspective of 25 years of the Polish Third Republic and achieving the goals assigned at the beginning of the transformation, connected with reorienting the Polish politics allows for looking at the Polish-German relations in a broader context of European dynamics and international relation in the world, although not without the living schematics, stereotypes and habits, able to determine thoughts and decisions. Relations with Germans have stopped being a subject of superpolitical unanimity, and in the perception of further generations the historical traumas will give place to the pragmatic everyday life. The material refers to the concepts of interest community, memory and generational changes which show the scale of the change made in the Polish-German relations, as well as try to set the perspective of implementing the experiences gathered so far.

Pursuant to the principle that the perpetrator or his legal successor is liable for the damage caused, The Third Republic of Poland shall not be held liable for the damage resulting from the actions taken by public authorities that functioned in the territory of Poland in the political regime of 1944-1989. Those authorities, in all fundamental matters, did not act independently, but merely implemented the decisions, also the damaging ones, that had been made by the Soviet Union. And yet, it is highly unlikely that the Russian Federation (the legal successor of the USSR) will ever recognise any claims for damages or compensation for the damage caused. Consequently, other possibilities must be considered. What seems possible and recommended is assistance offered to the harmed citizens, although such assistance is not provided by the law but is rooted in the principles of ethic and depends on the financial capability of the State involved. Solutions similar to those provided in the Civil Code should be resorted to only in situations where the state of unjust enrichment continues to be enjoyed by today’s public authorities, or individuals who acquired unlawful gains in bad faith, at the cost of others. The deliberations presented in the paper apply to the internal situation in the state only since the fact that in the analysed period Poland was not a sovereign state will not, any longer, have any practical consequences for international relations. Further, the subject matter of this paper does not concern compensation due to the Church and religious denominations, which is part of a much more broadly understood area pertaining to the financing of Churches.
Zgodnie z zasadą, że za szkodę odpowiada jej sprawca lub następca prawny, III RP nie powinna ponosić odpowiedzialności za krzywdy wyrządzone z powodów ustrojowo-politycznych przez władze publiczne funkcjonujące na obszarze Polski w latach 1944-1989. Władze te w zasadniczych sprawach były niesamodzielne, będąc jedynie wykonawcami decyzji kierownictwa ZSRR – dotyczy to również szkód, o których mowa w artykule. Skoro jednak jest mało prawdopodobne, aby Federacja Rosyjska (następca prawny ZSRR) uznała jakiekolwiek roszczenia odszkodowawcze, należy poszukiwać innych rozwiązań. Możliwa, a nawet wskazana, jest pomoc poszkodowanym, ale nie na gruncie prawa do odszkodowania, lecz w oparciu o przesłanki etyczne i z uwzględnieniem możliwości finansowych Państwa. Jedynie w sytuacjach utrzymujących stan bezpodstawnego wzbogacenia dzisiejszych władz publicznych lub osób, które wzbogaciły się w złej wierze kosztem pokrzywdzonych, należałoby uwzględniać roszczenia prawowitych właścicieli, korzystając z rozwiązań podobnych do tych, które określone są w Kodeksie cywilnym. Rozważania zawarte w artykule odnoszą się jedynie do stosunków wewnętrznych, w stosunkach międzynarodowych bowiem brak suwerenności Polski w tamtym okresie nie może już wywoływać żadnych skutków praktycznych. Ponadto artykuł nie dotyczy odszkodowań należnych Kościołom i związkom wyznaniowym. Jest to problematyka, którą należy połączyć z szerszą sprawą finansowania Kościołów.

The assessment of the Round Table was extraordinarily stable. The political environments accepting the Polish Third Republic, taking part in ruling the country, are generally positive about the talks between the government of the Polish Third Republic and the opposition. In 2014, even the representatives of “Prawo i Sprawiedliwość” (Law and Justice) party maintained the opinion from the previous years, formulated by Jarosław Kaczyński and Lech Kaczyński, that the Round Table, as a tactical action, was a necessary undertaking at that time in history. The negative assessment of the event were characteristic of non-parliament parties and ones with small social support. The following anniversaries of the start of the debate were a good opportunity to mark one’s difference from the establishment by negation. Change of the assessment was a result of the evolution of the situation in Poland. Hard political fight in the Polish Third Republic caused a change of positions e.g. with regard to former political opponents or even enemies. The verbal change of position of W. Frasyniuk towards gen. Jaruzelski can only be explained with the attack of the Jarosław Kaczyński establishment on the politicians of the Democratic Union and Freedom Union. The environments reluctant to PiS for the same reasons forgot that the government led by Tadeusz Mazowiecki could only take place because of the activity of Jarosław Kaczyński. Many of the evaluations, both on the side of the Round Table architects and its opponents had no connection to the subject of the proceedings.

The article presents problems connected with forming democracy in Poland after 1989. In order to comprehend the Polish democracy and to answer the question ‘Where are you heading, democracy?’, the author indicates the model of democratic system in ancient Greece and points to the phenomenon of explosion of democratic systems in the world. Also studies of the state of knowledge of democracy are presented. They show that there is a discrepancy between the degree of satisfaction with the practical performance of democratic countries and the faith in the ideals of democracy. A special attention is devoted to the distance that separates the Polish democracy from mature Western democracies. By analyzing the literature and emphasizing the gaps in the mechanism of democracy it is shown that Poland meets the minimum standards of the democratic system. The author suggests the direction of transformation that should be followed in order to make Poland a democratic country.
