Opis:
The article touches upon a set of issues related to the cross-border crime definition and features. Cross-border crime can be defined as a criminal-legal, criminological and criminalist concept. The author’s approach is that it is exactly criminal-legal dimension of this problem that is primary one. A criminal-legal understanding of cross-border crimes is suggested. It is analyzed by comparing the provisions of a number of international and national acts in the context of cross-boundary as a legal concept and characteristics of offences. There is emphasized that cross-border crimes constitute a relatively stable set of crimes that threaten the interests of states in the sphere of border and national security. The cross-border crimes objective features are considered. They include public interests, offender’s modus operandi, the victim, items transferred across the border. It is concluded that the cross-boundary nature in the criminal law of Ukraine stems from the peculiarities of the offender’s actions. The classification of crimes into unconditionally and conditionally cross-border is suggested. Such a division is associated with the obligatory/optional nature of such an objective feature as border crossing.

Subject and purpose of work: Investigation and statistical analysis of tourism flows and of trends observed in Ukrainian-Polish cross-border tourism. The purpose of the study is aiding further crossborder tourism-related cooperation between Ukraine and Poland. Materials and methods: Government and commercial statistics sources. Data analysis methods included literary, analytical, comparative, and quantitative methods. Results: The processes and dynamics of cross-border cooperation between Ukraine and Poland in the field of tourism during 12 years (from 2006 to 2017) have been investigated. The authors analysed data related to tourism flows and determined the primary source-countries of visitors based on the inbound and outbound indicators and the current tourism market trends within this cross-border cooperation. Conclusions: The main trend in the Ukraine-Poland tourism flow over the last decade is the stabilisation of inbound tourism from Poland to Ukraine and a significant increase in outbound tourism from Ukraine to Poland. In the last few years, it has been driven by Ukraine’s focus on Euro-integration.

In the last decades borderlands studies have been rapidly developing in various disciplines. Within the changing function of European borders (from separating line between two souvereign states to borderscapes of intercultural flows and fluid identity) the focus of border scholars moved towards social relations and bottom-up perspective. Thus, borderlands are perceived as laboratories of European integration and multicultural spaces. For the aim of this article, borderlands are defined as spaces located on the geographical border between different states, nations and cultures that are objects of European Union cohesion policy. By analysing the Eurobarometer survey on cross-border cooperation I try to demonstrate differences between border regions covered by the Interreg cross-border cooperation programmes in terms of cross-border practices, general trust in others and attitudes towards citizens of neighbouring countries.

Nowadays, the development of local communities is hindered by crises, external shocks, and disturbance. Under such circumstances, an important characteristic is their resilience, i.e. the ability to withstand negative external influences and ensure further growth. Border communities are particularly sensitive to external stresses stemming from geopolitical and economic changes. The article aims to identify key determinants and indicators of territorial community resilience in the EU-Ukraine cross-border area. The methodological foundations of the research comprise the main provision of economic theory, regional development, and spatial economy theory, etc. The methods of comparative, economic, and statistical analysis are used in the study of various dimensions of community resilience. The main results of the study of the peculiarities of socioeconomic development of Ukraine’s border communities and existing opportunities for the use of instruments of cross-border cooperation derive from a sociological survey based on the expert opinion method.

This article tracks the definitional debates on social capital to demonstrate the many-sided nature of it. Referring to the relational nature of social capital, this paper regards it as an output of cross-border cooperation. The basis of social capital is social interaction, and cross-border cooperation facilitates and reinforces it in equal measure across national borders. Therefore, this article considers cross-border cooperation as one way to generate formal/informal, linking, bonding, bridging, transnational and other varieties of social capital.

Łukasz Wróblewski’s article is theoretical-empirical in character. In the first part, he focuses on a relatively recent and as yet underresearched category, that of the cross-border market. From the existing definitions of the market, Wróblewski derives a definition of the cross-border market of cultural services. He goes on to discuss the historical conditions of the creation of this market in the Cieszyn Silesia-Těšín Slezsko area. Next, he discusses the structure and specificity of the cross-border cultural product (CBCP). In the third part of the article, Wróblewski examines in detail the levels and nature of cooperation in the process of creating CBCP on the cross-border market of Cieszyn Silesia. He points out that local, regional, and Euroregional organizations and central authorities of the countries sharing the border are involved in the process of creating cultural products on the cross-border market.

This article explores the impact of the EU migration and visa policy on the development of cross-border cooperation between Ukraine and Poland. Cross-border tourism is presented as an important element of international tourism, which affects the development of border regions and has positive consequences for the overall development of the country. The paper sets out to examine the microeconomic aspects of the outsourcing and international transfer of services. To this end, the author defines some basic terminology linked with this process as well as its mechanisms and ties between enterprises in different countries. A chart showing a network of cross-border ties and service flows is presented, as well as the results of various business activities. Changes taking places in enterprises are analyzed from the perspective of evolution of their business operations, management and foreign expansion. The author highlights the importance of information and communication technology (ICT) in these processes. She shows that ICT services tend to be moved from developed countries to the Third World and Central Europe, among other regions, largely because Western European companies want to reduce their production and transaction costs. Many Central European countries are capable of providing modern ICT services at competitive prices. Modern ICT services range from data processing to know-how development, and the general rule is that technologically advanced services produce greater benefits for the service provider and the host country. The movement of services, technology and capital linked with outsourcing is a dynamically developing segment of the international market. Polish companies should step up their activities to win a larger portion of the market even though this forces them to meet a number of conditions, some of which depend on what happens in their business and institutional environments.

Transport links are one of the main factors required to develop cross-border cooperation and integration. However, differences in the quality and quantity of transport infrastructure inhibits the development of cross-border cooperation, as exemplified by the cross-border transport network in the northern part of the Polish-German borderlands, namely, the Szczecin–Berlin inland waterway. The existing differences constitute bottlenecks that restrict the use of cross-border transport links to strengthen cross-border cooperation. This article aims to assess the transport function of the Szczecin–Berlin inland waterway and identify the bottlenecks and missing links hindering its potential. The findings will serve as the basis for indicating the types of proposed measures aimed at implementing the proposals made by cargo shippers with respect to cross-border transport links identified during an in-depth interview survey. The types of measures proposed in this article will improve the competitiveness of cross-border transport links by ensuring interoperatibiliy, interconnectivity, and intermodality. However, they will require the effective coordination in policies regarding development of the transport infrastructure in the cross-border area, promotion of its development, and facilitating the cooperation between stakeholders. Measures to be taken in that regard are an important issue in cross-border governance and management.

Globalization is very contested, however in the context of the West Pomeranian’s and Mecklenburg Vorpommern’s development, it has brought an integrated cooperation. This cooperation is an effective tool for strengthening two nations comparative advantage in the global market. What is more, authors put an emphasis on the strength of the regionalization and globalization processes of the regions and what impact the factors have on the socio-economic development. Moreover, authors prove the two processes may coexist and bring tangible socio-economic effects but only if subjected to an effective management.
Globalizacja jest bardzo sporna, jednak w kontekście rozwoju województw zachodniopomorskiego i Meklemburgii Pomorza Przedniego globalizacja odnosi sukcesy w postaci między innymi zintegrowanej współpracy. Współpraca ta skutecznie wzmacnia oba regiony zapewniając im silniejszą względną przewagę konkurencyjną na globalnym rynku. Co więcej, autorzy kładą nacisk na siłę regionalizacji i globalizacji regionów i jaki wpływ czynniki te mają na rozwój społeczno- -gospodarczy. Dodatkowo autorzy dowodzą, że te dwa procesy mogą ze sobą współistnieć i przynosić wymierne skutki społeczno-ekonomiczne pod warunkiem skutecznego zarządzania.

The article discusses the issues of cross-border organized crime. It also lists offences committed by organized crime groups throughout Europe. Furthermore, the article provides statisticaldata concerning cross-border crimes. The author of the article pays special attention to the threats this phenomenon poses for the countries in the European Union. Moreover, the article shows what efforts should be made to effectively combat this phenomenon.

Pogranicze jako obszar transgraniczny to specyficzne miejsce prowadzenia działalności gospodarczej. Transgraniczne współdziałanie gospodarcze jest coraz częściej wspierane przez programy współpracy transgranicznej. Celem artykułu jest zaprezentowanie specyfiki pogranicza oraz wskazanie możliwości, jakie tworzą programy współpracy transgranicznej w zakresie budowania trwałych relacji gospodarczych między firmami. Ponadto przedstawiono ideę klastra transgranicznego wraz z przykładem jako formę transgranicznego współdziałania gospodarczego.
Borderland as the cross-border area is a specific place of business. The existence of the businesses have opportunities to work with partners coming from a neighboring country. Cross-border economic cooperation is increasingly being supported by crossborder cooperation programs. The article presents the specificity of the border, create opportunities for cross-border cooperation programs and characterized the idea of crossborder cluster with an example as a form of cross-border economic cooperation.

Although cross-border online shopping (CBOS) provides the consumers with multiple advantages ranging from easy access for locally unavailable products to reasonably lower prices, current data reveal that individuals hesitate engaging in CBOS. Identifying the present problems causing the hesitation to buy online internationally is very important both from the aspect of businesses and the consumers. By indicating the reasons of hesitation, businesses could easily focus their marketing activities to prevent the hesitations and increase the amount of purchases from their web sites, on the other hand being aware that customers are performing a major role in marketing, finding out the factors that are essentially affecting the purchasing intentions and behaviors of Turkish consumers on international online environment is vital. Thus, the purpose of this research is to find out about the factors that prevent the consumers to engage in cross-border online shopping and moreover to figure out whether there is a difference regarding the problem perceptions of the individuals who have already engaged with the concept and the consumers who had never dealed with CBOS. Research results revealed that the problem perceptions are significantly lower for the former group, indicating that as the consumers get experienced, their hesitations regarding the concept decreases.

A comprehensive interpretation of the European Grouping of Territorial Cooperation (EGTC) requires interdisciplinary studies, with particular focus on economic aspects. An EGTC is an innovative legal instrument of the EU and an economic tool developed to improve cross-border, transnational and interregional cooperation. Fifty EGTCs had been established in Europe by the end of 2014, including 3 EGTCs in Poland. The aim of this article is to indicate and discuss the key determinants of development of such institutions, as well as to point out barriers and present proposals to overcome them. The operation of Polish groupings in view of European ones was discussed in this article. A working model describing internal and external determinants was developed. In the context of cohesion policy, it was proved that objectives and tasks of the groupings are coincident with the objectives of the European Territorial Cooperation. Previous original studies on EGTC development in Europe were used. Legal documents were analysed, a survey and interviews with directors of EGTCs were conducted in 2015.
