The European Commission has lately been exposed to increasing pressure from the Italian and Greek Governments to actively participate in solving the problem of growing immigration from African and Middle East countries. This surging pressure has resulted in actions aimed at redistributing immigrants among the EU Member States. The implementation of this solution would mean that the immigration issue is most likely to also affect countries which have not had to deal with large immigrant populations in the past. This article focuses on potential immigration to Poland, as one the largest economies in the EU Member States. It aims to answer the question whether Poland needs and is ready, in social, economic and cultural terms, to accept international immigrants from developing countries. Another problem tackled by this paper is the European Union’s attitude towards immigration. It is argued that the redistribution of migrants will be pointless unless other accompanying actions are taken simultaneously. The twin issues of the immigration crisis and the distribution of immigrants have revealed problems resulting from differences between the Member States in terms of their quality of life, including differences in wages and social benefits. This article posits that had the EU met the cohesion goal many economic and social problems, including migrants’ distribution, would not have arisen.

Artykuł przedstawia w skrócie drogę, jaką Chorwacja przeszła od momentu rozpadu Jugosławii do chwili przystąpienia do Unii Europejskiej 1 lipca 2013 roku. Szczególny nacisk położono na przedstawienie sytuacji politycznej i gospodarczej kraju oraz warunków, w jakich prowadzono rokowania. Ukazane zostały w nim także wątpliwości związane z niepełnym wyjaśnieniem wszystkich spornych kwestii. Praca kończy się podsumowaniem sytuacji kraju tuż po wejściu w struktury unijne.
The article shows the Croatian way to the European Union, from the breakup of Yugoslavia to the accession on 1 July 2013. The political and economic situation was pointed out as well as the conditions of the European negotiations. It was written also about doubts connected with not clear explanations of all the problems by the negotiations. The article is summed up with Croatian achievements and the situation of the country just after joining the European structures.

The International Labour Organization is a specialised organisation of the United Nations. Regarding membership, the founding agreement provides for the possibility of a Member State withdrawing. These regulations do not include detailed stages of the procedure, but they indicate specific actions that should be taken by the state to withdraw from the ILO. With the end of the withdrawal procedure, the Member State should be prepared for the emerging (political, economic, strategic) consequences of such a procedure. Importantly, the statutory provisions regarding the procedure for withdrawing from the ILO have been implemented many times, with examples being the breaking of the membership ties by South Africa or Indonesia.

The paper aims to evaluate whether or not the last EU enlargement to the new 10 member states (EUN-10) has influenced the intra EU trade of agricultural products. In particular, the analysis focuses on the effects on trade between two groups of countries EU-15 and EUN-8 (i.e. the Central-Eastern Europe new members countries) of the EU-accession process. The import-export flows show a noticeable increase in trade between the two areas over the last decade. This increase surely stems from the opening up process, but according to second best theory in international trade which applies to Customs Unions – it not necessarily favours efficiency as far as social welfare is concerned. The analysis shows also that the comparative advantages in certain products, which ten years ago fuelled trade, do not appear to have altered the position of the two groups of countries. Focusing on agricultural products the integration process, which was already underway during the pre-accession period, has maintained and not reduced their specific specialization.

Znaczenie organizacji międzynarodowych we współczesnym świecie, a w szczególności ich członków, którzy posiadają szerokie spektrum możliwości przynależenia do poszczególnych społeczności wzrasta z roku na rok, co umożliwia im kształtowanie własnych interesów narodowych przy pomocy narzędzia, jakim są właśnie organizacje międzynarodowe. Formą ograniczenia a wręcz pozbawienia praw przysługujących państwom, które należą do organizacji międzynarodowej jest ich wykluczenie ze struktur organizacyjnych. Jest to swego rodzaju konsekwencja, z którą państwo członkowskie musi sobie radzić dopuszczając się określonych działań naruszających podstawy funkcjonowania tejże organizacji. Nie każdy czyn godzący w interesy organizacji stanowi podstawę wykluczenia. Jest to najdotkliwszy ze skutków, jakie organizacja może przewidywać w swoim statucie, ponieważ to właśnie akt założycielski zawiera postanowienia w tym zakresie. Wykluczenie z organizacji jest, jako przejaw mocy organizacji w stosunku do członków, podstawą jej władzy nad członkami.
The importance of international organizations in the modern world is rising year by year, enhancing the status of their members and giving them a wide range of opportunities to join diverse groups and communities, which enables them to shape their national interests using their membership in international organizations as an expedient instrument of leverage. If a state has its membership in an international organization restricted or is crossed off the list of members, it will sustain a serious blow to its rights. Restricted membership or outright exclusion is a specific consequence a member state may have to cope with if it has acted in contravention of the principles and regulations which are binding on the members of the given international organization. Not every act that violates the interests of an organization gives grounds for full exclusion, which is the severest penalty an international organization can prescribe in its statute. The power to exclude noncompliant members is a manifestation of the organization’s prerogatives and the basis of its authority over its members

This article investigates the engagement of EU law with the interests represented and pursued by the Member States within the framework of the European Union. In principle, because the interests which the Member States feed into the EU governance machinery are formulated in political processes at the national level, and thus possess paramount political legitimacy, EU law may only interact with those interests when a clear and sufficient mandate has been provided for doing so. Such mandates follow from Treaty provisions or EU legislation. They embody common political agreements among the Member States by which they commit themselves to realising the specific interests they share, as well as achieving related common policy objectives. In practice, however, the boundaries of EU law’s mandate are difficult to determine with precision, and this may weaken the legitimacy of EU law’s interventions. The weaker legitimacy of the law raises particular problems in the law of the Single Market, where the interests pursued by national governments are subjected to filtering, moderation, and even transformation by the Court of Justice.

The aim of this article is to present a general forecast of the development of processes of legal integration in the European Union in the coming years. The European Union is in ‘multi-crisis’, which may force the member states to adopt an organizational development scenario based on differentiation. The selectivity of this differentiation is understood both in terms of the heterogeneity of integration in some areas and the reduction in the number of states fully participating in integration. An analysis of the current trends and solutions proposed and taken by EU decision-makers shows that the EU legal system is not subject to federalization, but in fact the tendency to deepen integration does not conflict with intergovernmentalism. The multiplicity of problems resulting from the multi-crisis will most likely require the deepening of the current differentiation mechanisms and the emergence of new ones.

The study addresses the task of determining the scope of sovereignty (exclusive competence) of member states in the area of the development of national power policy on the basis of Treaties, mainly the Treaty on European Union. The author makes an attempt to prove that the impact of the EU legislation on the national legal order, pursuant to the EU regulations, is subject to selective exclusion, and the member states are entitled to supremacy relative to the EU power policy in specific areas of the development of the power policy. Therefore, the member states kept their autonomous right to develop the market of energy supplies in a manner that would make it possible to maintain the balance between the supplies and the demand within the limits necessary for keeping the energy security at the national level required for the public order and the national security. The hierarchical relation of the EU interest and the national public interest arising from the supremacy of the EU law and its direct effectiveness does not jeopardize the national objectives defined in this way. The national energy security, understood in this way, opens the space for specific preferences of national suppliers subject to the national legislative regime as well as the national power authorities and power enterprises managing the transfer or distribution infrastructure.

For the countries of the Central Europe, the regional policy measures which concentrate on the maintenance of the small and medium sized producer’s units and are trying to find solutions to the worsening negative circumstances for the family farms (in the EU-12, 68.5% of farms are regarded as being semi-self-subsistent [Statistical… 2010, p. 85] are particularly important. It is unanimously acknowledged that for these farms it is not the support through supplementary income found in the 1st axis that gives a chance of survival (it rather piles difficulties up on them because of the additional cost of administration and protection of the environment), which is rather helpful for the producers of large quantities in complying with the processes of world markets, but it is the support given for the maintenance of the environment and the programmes serving to strengthen connection to the local and regional markets that can produce results (presently 2nd axis). The endeavours mentioned above provide some possibilities of protection and long-term survival of multifunctional, small size family farms, which at the same time produce quality goods, and of warding the hectic changes in the free markets off. Among the countries of Western Europe, it is France that could provide especially useful examples in the course of reformation of the European support system, because the French government and the rural stakeholders have been following their aim, almost for two decades, of the effective development of direct selling (in French vente directe) and short food provision systems (in French circuits courts) through which they preserve those agricultural structures that are built on family connections. The subject of this paper is adaptation possibilities of the French direct marketing model, which evolved for the preservation of multifunctional family farms and warding of the hectic changes in marketing conditions off. It provided proof in the past decade that it is not only the intensive industrial production that can be competitive and viable, but also the small size, multifunctional farms, close to nature, that support one or two families, can provide effective perspectives for the renewal of the prime sector and the agriculture of Europe. If the good practices of Western Europe, and within it France, can be employed in the region of the Eastern and Central Europe, this will contribute to the reduction of distances between country areas, to the uplift of those areas that lag behind and are subdued to a measure of poverty.

The paper examines the development of education systems and international migrations in selected new Member States. The countries are Estonia, the Czech Republic and Slovakia. The paper focuses on various elements in the development of education systems making people able to cope with competition on global labour markets. The outcomes of these developments largely regulate the supply of labour and consequently its international demand. Some statistics on international migration and integration of migrants in global labour markets are presented. The aim of this paper is to raise questions about relevant issues to be paid attention to in studies focusing on education and international migrations rather than to try to give any straightforward solutions.

This article concerns the current pre-accession process of Turkey and the question of its prospects. In order to answer this question the author conducts an in-depth analysis of factors that can influence the process on three main levels: EU (i.e. general political and economic situation, EU enlargement policy, EU institutions), member states and Turkey. He wants to verify the hypothesis that although the situation in this candidate country is crucial for the future of Turkey-EU relations, the decisive factors are in the EU and member states. The pre-accession process of Turkey will be continued but its pace and course will depend to a large extent on the position of the main Union’s powers, the clear vision of the EU as well as the economic/political situation and public feelings in Europe.

The paper includes the issues related to sustainable development in the energy-using sectors in the European Union countries. The paper presents the analysis of participation of renewable energy in the total energy consumption in these sectors of the European economy. It was found that participation of renewable energy in the total energy balance continues to increase, differs in each country and is not dependent on the macroeconomic situation. Strong positive correlation between participation of renewable energy and afforestation rate was found, which is caused by largely involvement of biomass in renewable energy. The research indicates that the economic aspect for sustainable energy development is of low importance, the ethical field and the need to preserve resources for future generations are crucial.
Przedstawiono zagadnienia związane z rozwojem zrównoważonym w sektorach wykorzystujących energię na przykładzie krajów UE . Dokonano analizy udziału energii odnawialnej w zużyciu całkowitym energii. Stwierdzono, że udział energii odnawialnej w bilansie całkowitym energii ciągle wzrasta, jest zróżnicowany w poszczególnych krajach oraz nie zależy od sytuacji makroekonomicznej. Stwierdzono silną dodatnią korelację między udziałem energii odnawialnej a lesistością, co było spowodowane dużym wykorzystaniem biomasy w energetyce odnawialnej. Przeprowadzone badania wskazują, że aspekt ekonomiczny w przypadku zrównoważonego rozwoju w sektorach wykorzystujących energię miał małe znaczenie, a na pierwszy plan wysuwały się płaszczyzna etyczna i konieczność zachowania zasobów dla przyszłych pokoleń.

The article discusses the decision of the Polish Supreme Court of 2 June 2022, I KZP 17/21. The ruling of the Supreme Court was issued based on a legal question submitted by a common court in relation to the European Investigation Order (EIO). The Author refers to the ruling by discussing broadly both the issues of the legal question and the authority issuing the European Investigation Order within the framework of pre-trial proceedings. Of paramount importance are the characteristics of the subjective sphere, i.e. the authority empowered to issue a European Investigation Order from the point of view of legally protected confidential information, in particular bank secrecy constituting the subject matter that served the basis for the ruling of the Supreme Court being commented herein.

The coordination of social security systems is regulated in the primary law of the European Union (Regulations No 883/2004 and 987/2009), which causes that the provisions are directly applied in the Member States. The general principle is the right to be subject to the legislation of a single Member State, which means that the designated institution of the Member State and other entities cannot make Determination of the legislation applicable and the principle of being subject... – 169 – 2/2014 I US NOVUM a person excluded from a social security system or make him/her subject to the social security system of more than one Member State. In this light, the procedural aspects of determining the applicable legislation, especially the determination of the provisional legislation, seem to be particularly interesting. The article aims to present the issues connected with the determination of the legislation applicable, including the provisional one, and to consider the relations between the institutions of the Member States and between the institutions and the persons concerned as well as appellate organs.
Koordynacja systemów zabezpieczenia społecznego regulowana jest w prawie pierwotnym Unii Europejskiej (rozporządzenia: 883/2004 i 987/2009), co sprawia, że przepisy te są w państwach członkowskich stosowane bezpośrednio. Generalną zasadą jest podleganie ustawodawstwu jednego państwa członkowskiego, co sprawia, że zarówno instytucja właściwa państwa członkowskiego, jak i inne podmioty nie mogą doprowadzić ani do wyłączenia zainteresowanego z jakiegokolwiek systemu zabezpieczenia społecznego, jak i do objęcia go systemem zabezpieczenia społecznego więcej aniżeli jednego państwa członkowskiego. W tym świetle szczególnie interesująco przedstawiają się proceduralne aspekty ustalania ustawodawstwa właściwego, w szczególności wobec możliwości ustalenia ustawodawstwa mającego zastosowanie w sposób tymczasowy. Celem artykułu jest przedstawienie zagadnień związanych z określaniem ustawodawstwa właściwego, w tym również w sposób tymczasowy, uwzględniające relacje zachodzące zarówno pomiędzy instytucjami państw członkowskich, jak i relacje pomiędzy tymi instytucjami a zainteresowanym oraz organami odwoławczymi.
