Opis:
W niniejszym artykule zanalizowane zostały regulacje prawne odnoszące się do działania tzw. unijnych agencji migracyjnych. Zgodnie z przyjętym założeniem kreowanie unijnej polityki migracyjnej opiera się w dużym stopniu na zasadzie priorytetu bezpieczeństwa migracyjnego. Zasada ta zakłada przyjęcie jak najwyższego poziomu bezpieczeństwa wobec wszystkich uczestników procesu migracyjnego. Z zasadą tą powiązane jest również prawo solidarnościowe do bezpieczeństwa migracyjnego. Szczególną rolę w realizacji polityki migracyjnej UE pełnią tzw. migracyjne agencje zdecentralizowane – Frontex, EASO i eu-LISA. Autorka analizuje regulacje prawne odnoszące się do działań każdej z nich oraz poziom ich praktycznego wdrożenia, skupiając się szczególnie na okresie po kwietniu 2015 r. tj. po eskalacji europejskiego kryzysu migracyjnego.
The article analyses legal regulations with regard to the activities of the so-called EU “migration agencies”. In accordance with the adopted assumption, EU policy-making in the area of migration is based to a large degree on the principle of the priority of migration security. This principle entails the adoption of the highest standards of security with regard to all the actors of the migration process. The solidarity right to migration security is also related to the above principle. A special role in the implementation of the EU migration policy is played by the so-called decentralized “migration agencies”: Frontex, EASO and eu-LISA. The author discusses the legal regulations pertaining to the activities of the said agencies and the level of the implementation of the regulations, focusing especially on the period after April 2015, i.e. after the escalation of the migration crisis.

The article analyses the conclusions of the European Council in the years 2011–2017 from the perspective of the implementation of the so-called principle of migration security priority in the area of EU’s return and asylum policy. In accordance with the theses of the current article, there exists an overarching principle of migration security priority, which is applicable at the level of the shaping of EU’s migration policy, whereas the European Council has a real infl uence on the shape and directions of the development of EU’s migration policy. In actual fact, the European Council performs the function of the creator within the sphere of asylum and return policy – develops programme guidelines, provides solutions to problems and proposes possible changes in the instruments of the law. The article presents the results of an in-depth analysis of the conclusions of the European Council with regard to the management of migration processes in the era of the migration crisis, which escalated in April 2015.

Artykuł prezentuje wyniki badania orzecznictwa Trybunału Sprawiedliwości Unii Europejskiej w obszarze prawa azylowego i powrotowego, dotyczącego ochrony praw migrantów. Zanalizowane orzecznictwo dotyczy postępowań po eskalacji europejskiego kryzysu migracyjnego w 2015 r. Presentowane studiu, dąży do odpowiedzi na pytanie o możliwość funkcjonowania jurydycznego standardu ochrony prawa do bezpieczeńśtwa migracyjnego. Analiza zawiera również odniesienie do problematyki konieczności zapewnienia bezpieczeństwa procesów migracyjnych i obowiązku zapewnienia ochrony praw podstawowych migrantów.
The current article presents the findings of the research on the case-law of the CJEU in the area of asylum and return migration law concerning protection of migrants’ rights. The analyzed case-law concerns the proceedings from the period after the escalation of the European migration crisis in April 2015. The presented study seeks to answer the question about the existence of a juridical standard for the protection of the right to migration security. The analysis also includes the examination of the relation between the necessity of providing security in migration processes and the obligation to ensure the protection of migrants’ fundamental rights.

Artykuł analizuje orzecznictwo pokryzysowe Trybunału Sprawiedliwości Unii Europejskiej w obszarze bezpieczeństwa migracyjnego państw członkowskich. W związku z eskalacją kryzysu migracyjnego w 2015 r. Unia Europejska stanęła przed nowymi wyzwaniami w zarządzaniu migracjami. Orzecznictwo TSUE, zwłaszcza wydawane w procedurze tzw. pytań prejudycjalnych, stanowi swoisty barometr dla problemów, z jakimi mierzą się państwa członkowskie w zakresie zagwarantowania bezpieczeństwa. Zgodnie z przyjętymi założeniami badawczymi, Trybunał ma realną możliwość kształtowania standardów bezpieczeństwa migracyjnego w obszarze polityki azylowej i powrotowej. Co więcej, w ramach prawa migracyjnego UE i polityk migracyjnych istnieje priorytet bezpieczeństwa migracyjnego, zgodnie z którym konieczne jest zagwarantowanie jak najwyższego poziomu bezpieczeństwa wszystkim uczestnikom procesów migracyjnych, tj. zarówno migrantom, jak też społeczeństwu przyjmującemu. Zasada ta powinna być wdrażana zarówno na poziomie procesów legislacyjnych, jak też w obszarze implementacji norm prawnych. W wyniku przeprowadzonej analizy orzecznictwa Trybunału, wyodrębnione zostały cztery podstawowe obszary związane z bezpieczeństwem migracyjnym państw członkowskich: sprawy dotyczące bezpośrednio ochrony bezpieczeństwa i porządku publicznego, sprawy odnoszące się do możliwości ograniczenia cudzoziemcom niepożądanym wjazdu na terytorium państw członkowskich oraz swobody poruszania się, sprawy dotyczące zakazów wjazdu nakładanych na cudzoziemców o nieuregulowanym statusie oraz problematyki solidarnego dzielenia odpowiedzialności przez państwa członkowskie w obliczu masowego napływu migrantów, a tym samym zapewnienia bezpieczeństwa migracji na terytorium wszystkich państw członkowskich.
The article analyzes the post-crisis CJEU case-law in the area of migration security of the Member States. Due to the escalation of the migration crisis in 2015, the European Union has been facing new challenges in migration management. The case-law of the CJEU, especially issued in the procedure of the so-called questions referred for a preliminary ruling, constitutes a certain benchmark for the problems, which the Member States need to deal with in the area of guaranteeing safety. In accordance with the research method adopted for the purpose of the current study, the Court of Justice has a real possibility of shaping the standards of migration security in the area of asylum and return policies through its case-law. What is more, within the field of EU migration law and migration policies, there exists a migration security priority, in accordance with which it is necessary to provide the highest level of security to all the actors of migration processes, i.e. both the very migrants, as well as the receiving society. This principle should be applied at the level of legislative processes and also in the area of the implementation of legal norms. As a result of the conducted analysis of the case-law of the CJEU, the four basic areas with regard to the migration security of the Member States have been identified.

The article analyzes the 2015 migration crisis in the European Union from the perspective of Non-Traditional Security (NTS) Challenges. It argues that the current wave of immigration to the EU, due to its dynamics and scale, should be treated not only as a humanitarian or social challenge but also as a security one. The value of the NTS approach is based on the assumption that well-known phenomena such as illegal migration, infectious diseases, or food shortages, which once had only an indirect influence on national or international security, now pose direct threats to the survival and well-being of peoples and states.
Celem artykułu jest analiza kryzysu migracyjnego w UE z 2015 roku z perspektywy niestandardowych problemów bezpieczeństwa. Podstawę rozważań stanowi teza, zgodnie z którą fala imigracji do UE, ze względu na dynamikę i skalę, stanowiła nie tylko wyzwanie humanitarne czy problem społeczny ale również zagrożenie dla bezpieczeństwa. Zgodnie bowiem z koncepcją niestandardowych problemów bezpieczeństwa, zjawiska takie jak nielegalna migracja, choroby zakaźne czy braki żywności, które do niedawna jedynie pośrednio wpływały na jego poziom, stanowią obecnie bezpośrednie zagrożenie dla przetrwania i rozwoju państw.

Illegal migration in Europe means that an ever-increasing number of people are leaving their homes to live in better countries. Migration carries risks that affect individuals and groups of people, sometimes society as a whole, and therefore states decide to intervene in migration processes. The causes of current irregular migration are quite diverse, but the common feature is that migrants had to leave their countries of origin because they could not live a normal life there. Illegal migrants are increasingly nationals of economically underdeveloped countries, who do not have financial resources, are socially deprived, and because of all these facts are involved in committing criminal anti-social activities. In countries where the number of migrants has risen sharply, the racial, ethnic and religious structure of the population composition may change. The escalating tensions between the indigenous peoples and immigrants accelerate racism (bilaterally), radicalism in politics, socio-economic problems, crime, and other risk factors. It is in the European Community’s interest to take all possible legal and effective measures to eliminate the risks of irregular migration and to ensure a safe environment for the population. The paper characterizes migration and analyzes its causes and consequences, including crime associated with illegal migration.

The protection of Hungary’s external Schengen border is a priority which affects both the security of our country and the whole Schengen Area. Border surveillance is considered safe if it can prevent unlawful acts and proceed against offenders. The implementation of the tasks requires special staff and technical readiness. In the framework of the border protection of our country, it is the Police’s basic task, but in case a state of crisis resulting from mass migration is declared, the Hungarian Defence Forces take part in it. Border surveillance is a constant activity which aims to prevent illegal state border crossings; due to this, its efficiency cannot be measured exclusively based on numerical data. Border surveillance is also effective if it ensures the apprehension of people illegally crossing state borders and if it prevents them from accomplishing that; thus, the ‘physical’ presence itself contributes to the task execution in a manner meeting the requirements. Continuity plays a decisive role from the point of view of border surveillance. Border surveillance shall be considered a component. Thus, the border surveillance system consists of successive system elements which do not go without each other. The border surveillance system is built on border policing strategies, it can be operated based on leadership decisions which shall be in accordance with the border surveillance principles as well. Similarly to the border surveillance system elements, border surveillance principles are those rules which have constant influence/effect on border surveillance/in the field of border surveillance, the practical implementation of which ensures state border surveillance which meets the requirements/is reliable; moreover, it enables the targeted application of the forces and tools available. The operability of the system can only be granted if the principles apply jointly.

The aim of the article is the reconstruction of a nature of EU’s immigration policy that emerges from EU’s activities and reaction on migration crisis, understood as an effect of the unprecedented inflow of economic migrants and asylum seekers in 2015–2016. The analysis is focused on presenting the impact of the concept of security on the nature and scope of legislative and political measures adopted by the EU in the scope of migration policy. The article underlines that security is a factor which fundamentally determines the EU’s migration policy. The EU’ intervention to the migration crisis, giving priority to security-driven concern, was focused to meet a ‘secure border’ demand, understood as a process of increase the level of their closeness (as a opposition to openness) and impermeability. In the effect, the EU’s response to the migration crisis was highly narrow, fragmentary and insufficient.

The aim of the paper is to examine the role of national identity in the process of shaping individual identity of a person in modern world. Analyzed was the approach to the category of a place and the role of this category for an individual in contemporary Polish literature, taking into account the political situation that has influenced it. Assumed was that in globalized world, in which people are deprived of roots and sense of safety, they have some difficulties within answering the question of own identity. On the basis of interpretation of attitudes of few characters in the novels, written after 1989 noticed was that identity is a great challenge for people in the new geopolitical situation. The paper also discuss the relation between identity and individual sense of safety and state security, which may influence one another.

The study analyzes the management of the borders of the European Union as a factor having a significant impact on improving the security of Member States. Legal regulations regulating the external borders of the Schengen Group, treated as land and sea borders as well as airports and seaports of the parties to the Schengen Convention are indicated, provided that these borders are not external borders that formally form borders. The role of entities supporting border traffic management in the European Union is described. In addition, an analysis of documented attempts to illegally cross the external borders of the EU and the borders of countries associated with the Schengen area between border control visits was made, indicating potential threats in this area.

The subject of this thesis was international migration in relation to internal state security. The author, after reading the literature of the subject, noticed that international migration is a very important element of the modern order in the world and they determine both domestic and foreign policies of many countries. The serious problem, which is being faced by modern Europe is the uncontrolled influx of immigrants, which is posing a significant threat to the security of host countries. The number of migrants in Poland, especially those from Muslim countries, is negligible, but due to the demographic problems our country has been struggling for almost three decades, it may be that encouraging migrants to come to Poland might be prerequisite, to counteract the negative effects of the aging society. Issues related to the migration on the level of internal security of the country have become the inspiration for writing this thesis. In the course of writing this thesis, the author used the extensive literature of the subject as well as articles in scientific journals.

In the article, an attempt to characterize migration movements observed in the beginning of the second decade of the XXI century is made. The article describes the theoretical basics, origins and present meaning of Polish migration policy, based on chosen migration statistics. It contains the characteristics of the views of the key experts in the field. It explains the meaning of migration policy and its impact on the so-cial security of the country. The article is based on the statistical data of the immigration of people from Ukraine to Poland in comparison with other countries in the years 2010–2018. The article also explains the meaning of the phenomenon of migration and its influence on the labour market.

Opis:
The paper aims at analysing the relation between the model of social policy implemented in Poland after 1989 and the scale and structure of migration processes. The statistical data analysed in the paper show the impact of the deficit of good jobs, weakening protection of workers' rights, and low levels of social security in Poland on the post-accession emigration of Poles. The paper has tried to challenge the strategy implemented in Poland after 2004, which is based on compensating for the effects of emigration of young and well-educated Poles with the influx of foreign workers. It has been also emphasized that social policy instruments towards immigration and immigrants tend to be one-sided, as they focus on the labour market needs and do not provide enough support for the process of adaptation and integration of immigrants in Poland. Moreover, a verification of the assumptions of the governmental document "Migration policy of Poland” (2012) has been suggested, i.e. taking into account the negative effects of the post-accession economic emigration and recognizing the issue of contemporary Polish emigration as an important area of Poland’s migration policy. Finally, the paper has outlined the role of social policy in stimulating migration processes in accordance with the principle of protection of native human capital, the needs of the economy, and the Polish raison d'etat. It has also identified spheres of social policy development which are necessary to achieve this objective.
