APoli sh-Ukrainian seminar entitled “The Protection of Cultural Heritage – the Foundation of National Identity” was held on 30 June-3 July 2008. The first part of the meeting took place in Żółkiew, and the second one – in Zamość. The participants included representatives of assorted Ukrainian institutions, chiefly deputy starostas of counties in the district of Lviv and employees of the cultural heritage protection departments in county offices. The seminar was organised by the Conservation Centre in Żółkiew, cooperating with the authorities of the University of Management and Administration in Zamość and the European Information Centre Europe Direct in Zamość.

The national scientific conference on ”The Legal Protection of the Cultural Heritage in Poland – the Experiences and Challenges of the Twenty First Century”, held in Warsaw on 27 February 2009, was organised by the Chair of the Administration and Protection of the Natural Environment in the Faculty of Law and Administration at the Cardinal Stefan Wyszyński University in Warsaw and the Warsaw Seminar on Administration Axiology. The partners of the organisers were the National Heritage Board of Poland, the Centre for the Protection of Public Collections, and the Horyńska & Partners Law Firm. The conference was attended by more than 200 persons, including representatives of the conservation environment, lawyers and museum experts. The papers were followed by the acceptance of the text of the end declaration. The rank which the organisers of the meeting granted to it and the presence of the most outstanding Polish lawyers specialising in the legal protection of the cultural heritage testify to the significance of the state of Polish legislation for conservation administration.

W pracy przedstawiono planistyczno-przestrzenne i inwestycyjne uwarunowania związane z występowaniem obiektów dziedzictwa kulturowego. W szczególności przestawiono zasady postępowania inwestora na terenie objętym ograniczeniami związanymi z występowaniem stanowisk archeologicznych. Zaprezentowano instytucje ochrony zabytków w Polsce oraz ich kompetencje. Określono rolę planowania przestrzennego jako instrumentu ochrony obiektów dziedzictwa kulturowego. Ponadto zaprezentowano problemy ochrony zabytków na terenie podkrakowskiej gminy Michałowice.
The paper discusses the role of cultural heritage objects in spatial planning and investment processes. It particularly presents the principles an investor should follow with regards to the area, where archaeological sites have been located. Moreover, it enumerates Polish institutions responsible for the protection of historical objects and their competences. The article also defines the role of spatial planning as an instrument of cultural heritage protection. Finally, it presents problems related to the protection of historical objects in the community of Michałowice located nearby the city of Krakow.

The article presents analysis of post-war changes in the urban space of Krzekowo. After the change of its main function, from agricultural to residential and service, Krzekowo started to be location for many big residential buildings. The article discusses the cases of both detached buildings and whole complexes of residential developments build in the area of the former village and outskirts of modern Krzekowo. The typology of the developments was also described.
W artykule zostały przeanalizowane powojenne przemiany przestrzeni urbanistycznej Krzekowa. Krzekowo po zmianie funkcji z rolniczej na mieszkalno-usługową stało się miejscem lokowania bardzo wielu obiektów mieszkalnych. W artykule omówiono nie tylko przykłady pojedynczych obiektów wybudowanych w ostatnich latach na terenie dawnej wsi, ale również całych zespołów zabudowy mieszkaniowej. Została również przedstawiona typologia nowej zabudowy Krzekowa.

Opis:
The article presents post-war changes to the urban space of Krzekowo. The gradual changes replaced the agricultural function of the area to more residential and service oriented. This was followed by substantial changes to utilization of existing building substance. The majority of old utility buildings was adapted for new services including car workshops, carpenter’s workshops and other. Attractive location of Krzekowo compared to other neighbourhoods in Szczecin increased the number of residential developments in the area of former village and the closest proximity. Free building plots are currently rapidly developed with both detached houses and whole residential complexes. The article presents different forms of residential compacted development and the influence of development projects on the historical urban space of former Krzekowo village.
W artykule zostały omówiona powojenne przemiany przestrzeni urbanistycznej Krzekowa. Krzekowo stopniowo zmieniało swoją funkcję z rolniczej na mieszkaniowo-usługową. Pociągnęło to za sobą znaczące przemiany w sposobie użytkowania istniejącej substancji budowlanej. Większość dawnych budynków gospodarskich zostało zaadaptowanych do różnych funkcji usługowych, takich jak warsztaty samochodowe, stolarnie itp. Atrakcyjne położenie Krzekowa w stosunku do reszty Szczecina sprawia, że również znacząco wzrosła ilość nowej zabudowy mieszkaniowej lokowanej w obrębie dawnej wsi lub jej najbliższym otoczeniu. Wolne od zabudowy tereny są obecnie intensywnie zabudowywane nie tylko pojedynczymi obiektami mieszkalnymi, ale również całymi zespołami zabudowy mieszkaniowej. W artykule omówione zostały różne formy dogęszczania zabudowy mieszkaniowej oraz wpływ tych inwestycji budowlanych na historycznie ukształtowaną przestrzeń urbanistyczną dawnej wsi Krzekowo.

Wskaźnikiem skali potrzeb w procesie rewitalizacji, obok przesłanek społecznych i ekonomicznych, jest także diagnostyka obiektów z uwzględnieniem historycznych zmian zachodzących w zabudowie. Zagadnienia techniczne zabudowy mieszkaniowousługowej wraz z ochroną dziedzictwa kulturowego w działaniach rewitalizacyjnych zostały przedstawione na przykładzie zespołu staromiejskiego w Kożuchowie. Kożuchów jest jednym z najstarszych miast Środkowego Nadodrza. Oprócz pierścienia murów obronnych, zamku, licznych baszt, bastei, w obrębie obwarowań zachował się do dzisiaj również zespół zabytkowych kamienic, usytuowanych w trzynastowiecznym układzie urbanistycznym. Zachowane kamienice pochodzą z okresu od XVI do początku XX w. Atrakcyjność Starego Miasta w Kożuchowie stale jednak maleje m.in. przez zły stan techniczny kamienic. Obiekty kubaturowe wymagają licznych zabiegów: remontów, restauracji elewacji, konserwacji detalu, modernizacji, rozbudowy, nadbudowy. Niezbędna jest kompleksowa renowacja i kapitalny remont całego zespołu staromiejskiego
One of the indicators important in the process of revitalization of buildings is a diagnosis of its technical parameters. The paper analyses several cases from the Old Town in Kożuchów. The town is proud of its well preserved historical architecture. Most of the townhouses located within the limits marked with, also remaining city fortifications, were built between 16th to early 20th century. However, the attractiveness of the Old Town is constantly declining, and it is largely caused by poor condition of the buildings. They require serious renovation, which would have to include the restaurant of facades, reconstruction of details, modernization and sometimes expansion. A comprehensive renovation of the Kożuchów Old Town should be made a top priority goal for the local powers.

The article aims to present the legal and factual state of restitution of Polish cultural property and point out selected, interesting doubts, problems, and disputable issues related to applying the current law. The analysis is based on legal regulations, the latest literature, and statistics on the effectiveness of restitution of cultural property in Poland in 2011-2017. The thesis was put forward that a coherent system of restitution of cultural property, before the adoption and against the background of application of the Act on Restitution of National Cultural Assets, has not yet been developed in Poland. The regulation can be treated as an essential way to stimulate change and increase the importance of the restitution of cultural assets. Restitution of Polish cultural property in the years 2011-2017 is a complex process, encountering various problems. The adoption of the Act on the Restitution of National Cultural Assets, despite numerous critical voices, may constitute a critical developmental impulse due to numerous difficulties in the effective enforcement of the restitution idea in Poland recently.
Celem artykułu jest przestawienie stanu prawno-faktycznego restytucji polskich dóbr kultury oraz wskazanie na wybrane, interesujące wątpliwości, problemy i kwestie sporne związane ze stosowaniem obowiązującego prawa. Analizę oparto na przepisach prawnych, najnowszym piśmiennictwie i statystykach skuteczności restytucji dóbr kultury w Polsce w latach 2011-2017. Postawiono tezę, że w Polsce nie udało się wypracować spójnego systemu restytucji dóbr kultury, zarówno przed uchwaleniem, jak i na tle stosowania ustawy o restytucji narodowych dóbr kultury. Regulację można traktować, jako istotny sposób pobudzenia zmian oraz zwiększenia rangi problematyki restytucji dóbr kultury. Restytucja polskich dóbr kultury w latach 2011-2017 to proces złożony, napotykający na szereg problemów. Przyjęcie ustawy o restytucji narodowych dóbr kultury, mimo licznych głosów krytycznych, może stanowić ważny impuls rozwojowy ze względu na liczne trudności w skutecznym egzekwowaniu idei restytucyjnej w Polsce w ostatnim okresie.

Romantyzm i fascynacja górami zapoczątkowała popularność Zakopanego, jako ośrodka turystycznego. Kultura Podhala, jego architektura i sztuka użytkowa stały się rozpoznawalnymi symbolami regionu, stanowiąc o niezwykłej skali zainteresowania Zakopanem i wpływając na jego rozwój urbanistyczny. Wizytówkowa ulica miasta, Krupówki, w przeszłości pełniąca bardziej formę modnego deptaku, po transformacji w latach 90, nabrała komercyjnego charakteru. W ciągu ulicy pojawiły się wielkoformatowe reklamy, punkty handlu z ręki do ręki, szyldy i plakaty oraz elementy małej architektury, często o niskiej wartości estetycznej i zupełnie niezwiązanych z estetyką otoczenia urbanistycznego. Po fali krytyki tego stanu rzeczy, która przetoczyła się przez media, w roku 2016 miasto wprowadziło obszar Parku Kulturowego dla Krupówek i przylegających ulic, którego głównym zadaniem jest ochrona lokalnych wartości regionalnych, a także poprawa jakości przestrzennej głównej ulicy Zakopanego. Celem artykułu jest identyfikacja i analiza typowych elementów architektury regionalnej Krupówek oraz przygotowanie wytycznych dla dalszej ochrony regionalnych wartości architektonicznych. Artykuł prezentuje także rezultaty przekształceń przestrzeni ulicy zgodnie z wytycznymi opracowanymi dla Parku Kulturowego.
Romanticism and fascination with the mountains opened Zakopane to tourism. Its culture, folk art vernacular architecture became symbols of the region, making Zakopane highly popular and impacted its urban development. The most important heritage street – Krupówki, in the past fashionable boardwalk, was until recently the victim of its own popularity – building facades covered with advertisements that disfigured the streetscape. Billboards, posters, information boards, hand-to-hand sales, unlicensed street shows, and street – displayed goods were besieging the space and were in most cases not related to the regional culture. After the critique and nationwide media discussion local authorities in July 2016 initiated Culture Park, mainly to protect regional values and to better the overall image of the street. The aim of this paper is to identify and classify typical forms of regional elements of Krupówki street to formulate and prepare guidelines for the preservation of regional heritage. The paper will also present the transitions of the streetscape caused by Culture Park.

Artykuł dotyczy ogólnych problemów prawnych związanych z celami prawnymi postępowania upadłościowego w związku z celami ochrony dziedzictwa kulturowego. Obydwa zagadnieniami zbudowane są przez zupełnie inne systemy wartości. Postępowanie upadłościowe ma na celu ochronę interesów majątkowych ograniczonej grupy ludzi, podczas gdy dziedzictwo kulturowe jest chronione dla obecnych i przyszłych pokoleń, bez względu na jego znaczenie handlowe. Niewypłacalność właściciela dóbr kultury jest problemem globalnym, ale krajowe przepisy dotyczące upadłości i przepisy dotyczące ochrony dziedzictwa kulturowego różnią się bardzo poważnie. Z tego powodu artykuł nie ogranicza się do żadnego konkretnego porządku prawnego. Omówiono kilka ważnych uniwersalnych kwestii: ograniczenia syndyka/zarządcy w zarządzaniu dobrami kultury będącymi częścią masy upadłości, status prawny dóbr kultury wyłączonych z masy upadłości, konsekwencje sprzedaży masy upadłości w przypadku braku tytułu własności masy upadłości.
This paper deals with general problems of legal aims of bankruptcy proceedings in connection with the aims of heritage protection – issues built by completely different systems of values. Bankruptcy is designed for protecting pecuniary interest of a limited group of people, while cultural heritage is protected for present and future generations, despite its current commercial significance. In the global environment, bankruptcy of a cultural goods owner usually has a cross-border range but national bankruptcy legislations and laws devoted to heritage protection differ in very serious aspects. For this reason the paper is not limited to any concrete legal order. There are discussed some important universal issues: limits for a trustee in managing cultural goods which are a part of bankruptcy estate, legal status of cultural goods excluded from bankruptcy estate, consequences of bankruptcy sale in the case of lack of bankrupt’s ownership title.

The Kraków City Council takes care of the appearance and condition of its monuments — the most valuable treasures of Kraków — by co-financing renovation and conservation works. Over the last 10 years, the amount of funds provided reached a total of nearly PLN 25 million. The historic city centre features many old bourgeois tenement buildings and palaces, numerous churches and monasteries (St. Mary’s Church, Church of saints Peter and Paul, Church of St. Andrew, Dominican and Franciscan monasteries), public buildings, both official and commercial in nature (Town Hall Tower, Wielopolski Palace housing the Kraków City Council Offices, and Cloth Hall), and old university buildings (Collegium Maius, Collegium Iuridicum). The architecture of Kraków is characterised by extraordinary diversity — each artistic epoch left its traces in this city. In order to take care of the City’s image and seek to ensure the preservation and proper maintenance of its numerous historic monuments, Kraków City Council adopted a resolution proposed by Mayor under which the city budget has been used to fund targeted grants for works on historic monuments every year since 2006. Kraków was one of the first cities in Poland to undertake to co-finance conservation, restoration or construction works on historic monuments. The purpose of the subsidies is to support and complement activities enabling owners or holders of historic monuments to take proper care of their valuable elements, in particular their front façades, which undoubtedly have an influence on Kraków’s image. In the years 2006-2016, subsidies for a total of PLN 24,910,000 were granted from the city budget to over 230 applicants. The fact that works on many old buildings that were co-financed by the Municipality of Kraków were also supported financially by the National Fund for the Renovation of Kraków Monuments is of immense importance. The operator of this Fund in the Civic Committee for Restoration of Kraków Heritage is a civic forum. The Committee introduced mechanisms and principles governing the co-financing of the renovation of Kraków’s monuments from national and local government funds and the private funds of the owners. Based on these well-established mechanisms and financing rules, the owners of historic buildings contribute funds at least equal in value to the subsidies. It is an example of effective cooperation for the sake of the culture and image of Kraków. Thanks to such large-scale restoration works, financed jointly by the National Kraków Monument Renovation Fund, the City, and the building owners, Kraków is regaining its original splendour. Additionally, in order to protect the material and landscape cultural heritage more effectively and in order to enhance the beauty of Kraków, the City Mayor has undertaken activities aimed at establishing a specific form of protection, i.e. a cultural park. In accordance with the Act on the Protection of Monuments and the Guardianship of Monuments, the Kraków City Council, on a proposal from the City Mayor, adopted a resolution on the establishment of the Old Town Cultural Park, covering the entire area of the Old Town. The resolution, which is an act of local law, places particular emphasis on the preservation and presentation of heritage and the landscape of the historic urban layout; the protection of its historic buildings and the size of its architectural forms; the functional and compositional protection of Planty Park and other green areas, in particular gardens and garden squares; the protection of visual corridors and scenic overlooks; the protection of the cultural landscape through counteracting the domination of commercial activities, advertising, and services which interfere with the historic space and disturb its aesthetics; and the principles of desirable display. The effects of these actions, which are not easy to perform on a daily basis, have been noticed by the local governments of several cities, as well as smaller communities. Observing the positive effects that have been achieved through the introduction of the Old Town Cultural Park and in response to the numerous initiatives of city residents, the Mayor of the Royal Capital City of Kraków has taken steps towards establishing culture parks in other parts of the city. In June 2014, on a proposal from the City Mayor, the Kraków City Council adopted a resolution concerning plans to establish culture parks within the area of North Kraków: “Nowa Huta Cultural Park” and “Stare Podgórze and Krzemionki Cultural Park”. It needs to be emphasised that these activities have a very beneficial effect on the appearance of Kraków, which is very important both for its inhabitants and its large numbers of tourists, not only from Europe, but also from all over the world. In recent years, Kraków has been visited by over 10 million tourists a year, and in 2016, due to the fact that the city hosted the World Youth Day, the number of visitors exceeded 12 million. Taking care of the historic City of Kraków is a special mission that we should carry out both for us — the contemporary inhabitants — and generations to come. This mission is fully reflected in the development strategy of the City, in the close links between its economy, its historic heritage, and its creative and scientific potential.
