Artykuł ma na celu przedstawienie okoliczności i rezultatów kluczowego dla integracji europejskiej wydarzenia, jakim był zwołany w 1948 r. Kongres haski, a także zaprezentowanie wpływu jego postanowień na proces powstawania Rady Europy i kształtowanie prawnych uwarunkowań jej funkcjonowania. W artykule opisano poszczególne wydarzenia, które wpisują się w podejmowane po II wojnie światowej działania integracyjne na Starym Kontynencie, umieszczając pośród nich i szczegółowo omawiając charakterystykę Kongresu Europejskiego w Hadze. Korzystając z treści przyjętych wówczas rezolucji, dokonano analizy okoliczności i argumentów przemawiających za rozwiązaniami wdrożonymi w następnych latach. Artykuł ukazuje liczne postanowienia Kongresu haskiego, które znalazły swoje odzwierciedlenie na drodze podejmowanej w jego następstwie integracji europejskiej. Analiza ustaleń podjętych w 1948 r. oraz zrozumienie ich aksjologicznego tła pozwalają lepiej zrozumieć genezę licznych instytucji oraz procesów mających wpływ na kształtowanie kultury prawnej Europy w ostatnich kilkudziesięciu latach. Ponadto, w artykule został zaprezentowany szeroki katalog postaci uczestniczących w organizacji Kongresu haskiego wraz z ich afiliacją odwołującą się do rożnych poglądów na zakres integracji. Dzięki odwołaniu do tekstów źródłowych oraz literatury ukazującej okoliczności powstania Rady Europy można pełniej zrozumieć podstawy jej misji w zakresie umacniania stabilności demokratycznej i rządów prawa na kontynencie. Wreszcie, dzięki odniesieniu podstaw prawnych funkcjonowania Rady Europy do opisu historii jej powstania, artykuł daje odpowiedź na pytanie, dlaczego organizacja ta obrała charakterystyczny dla siebie sposób funkcjonowania i metody oddziaływania na systemy prawne państw członkowskich.
The paper aims to present the circumstances and results of the event of crucial importance for European integration, which was the Hague Congress convened in 1948, as well as to present the impact of its resolutions on the process of laying the foundation for the Council of Europe and shaping the legal conditions for its functioning. The paper describes different events that are part of the integration actions undertaken on the Old Continent after World War II, including and discussing in detail the characteristics of the Congress of Europe in The Hague. On the basis of the resolutions adopted at that time, the paper analyses the circumstances and arguments in favour of the solutions put in place in the following years. The article indicates the numerous provisions of the Hague Congress resolutions which have been implemented in the process of the subsequent European integration. The description and the axiological background of the decisions made in 1948 allow a better understanding of the origins of the many institutions and processes that influenced the shaping of Europe’s legal culture over the past few decades. In addition, the article presents a broad catalogue of the figures involved in the organisation of the Hague Congress, together with their affiliation with the different views on the scope of integration. The references to source texts and literature highlighting the background of the creation of the Council of Europe make it possible to understand more fully the basis for its mission concerning the strengthening of the democratic stability and the rule of law on the continent. Ultimately, by linking the legal bases of the functioning of the Council of Europe with a description of the foundations on which it was created, the article gives us an answer to the question of why the Council of Europe has developed its own modus operandi and its own methods of influencing the legal systems of the Member States.

Central European federalists gathered in Central European Federal Youth Movement (CEFYM) and Central European Federalists (CEF) propagated throughout the period of its existence the plan of federalization of Europe. Under the influence of stagnation in the work of integration in the fifties and sixties adopted a model of integration of “Europe Homelands” presented by Charles de Gaulle, and based on a confederation of sovereign states. Finland is a member of the European Higher Education Area. The principles of the Bologna Declaration have become reality in certain respects. The form and structure of Finnish law degrees are uniform with the Bologna model. However, mobility and the free movement of students have only been realised in a limited sense. Finnish law degrees are still closed both in international and national respects. Uniformity of degrees is treated here as a means to carrying out free movement and the right of establishment as the principles of the European Union. Uniformity of degrees is a necessary precondition in recognising degrees earned in another country. Without the recognition of the workmanship and degree earned in a home country, it is very difficult to establish oneself in a host county. Both the basic treaties and the applicable directives of the European Union obligate member states to recognise degrees earned in other member states. There are, however, important exceptions and restrictions. Lawyers often work as judges, prosecutors, bailiffs and other officers. They are subject to exceptions and restrictions. As a rule, advocates have the freedom to provide services and establish themselves in a permanent way, and act as advocates in another member state. Even in this case, there are steps and restrictions. In practice, it is not easy to move to another member state and act as an advocate with the help of a law degree earned in the home state. Basically, the reasons for these difficulties are the differences between national legal systems.

The text focuses on the migration in the European Union and in Poland at the begging of the 21st century. It aims to prove that even if the reasons and consequences of migration are varied, they have significantly shaped the development of human civilization and have been a part of human socialization. Furthermore, this text points out that the phenomena of globalization and democratization have affected the population movement and caused new patterns of contemporary migration. The European Union is a great example of cooperation between different countries in order to realize the principle of free population movement, which was put to the test over past years. Additionally, this article characterizes the Polish migration, especially the inflow of immigrants to Poland. Poland has become an emigration and an attractive immigration country. This text revels also the consequences of migration in modern Europe.

The results of the referendum regarding the UK leaving the European Union indicated that the majority of British citizens, who are also citizens of the EU, decided to leave the European Union. The citizens’ decision has serious legal consequences arising from Article 50 of the Lisbon Treaty. This is the first case of a state leaving the European Union, which raises many questions. In the presented material, the institution of referendum is being analyzed as a form of direct democracy as well as, in this context, the effects of Brexit affecting directly the citizens of Great Britain – ex-citizens of the European Union.

The aim of the paper is to present ramifi cations in the field of family law, inheritance law and tax law which arise from the lack of recognition of registered partnerships and same-sex marriages in certain European Union Member States, such as Poland. The lack of recognition is commonly perceived as discrimination on grounds of sexual orientation, but the emphasis is usually placed on its consequences concerning human rights. In this article, the author focused on discriminatory aspects in the area of family life and personal taxation. A lack of appropriate provisions in domestic law produces negative effects affecting taxation obligations for cross-border families that concluded their marriages or partnerships abroad but cannot benefit from these institutions in certain EU Member States such as Poland. For the purpose of determining discriminatory aspects, the author analysed the domestic rules differentiating couples living in a marriage and couples not possessing the right to marry. Due to lack of case-law on tax and inheritance discrimination resulting from sexual orientation, relevant case-law of the Court of Justice of the European Union have been recalled, revealing possible violations of fundamental freedoms, including free movement of persons.

On July 22, 2011, Spain suspended the application of freedom of movement for workers within the European Union with regard to certain categories of Romanian workers in all sectors and regions, grounding its decision in the difficult economic situation, high level of unemployment and approaching season in the agricultural sector, therein Romanian citizens were undertaking an employment. European Commission in the decision of August 11, 2011, did not consider the decision of Spain as unjustified. As a result of the decision, the discriminatory treatment of the Romanian citizens was maintained till the end of 2013. The correctness of the decision was not deeply examined on the ground of both the Polish and international legal writing. The aim of the paper is to examine the correctness of the decision of the European Commission of 11 August 2011, No. 2011/503 and to cover the gap in the legal discourse provided both on the international and domestic level. In the paper Author presents the essence of the free movement of workers and describes exceptions to this rule, with particular emphasis on exceptions established directly in the treaties of accession, having regard the exception in which the decision of Spain was grounded. In such a context Author casts doubts on the correctness of the decision of European Commission, which did not consider the restrictions as being contrary to the European law and formulates a thesis on excessive and unjustified character of restrictions implemented by the Government of Spain. Adopted methodology consists in the analysis of the case law of the European Court of Justice, legal acts, reports of the European Commission, international and domestic literature, with particular reference to the international scientific journals.

This article argues that the arrests and expulsion of large numbers of Roma carried out by the French government in 2010 violated the European Union’s human rights principles because non-French Roma were targeted collectively for removal. In response to the expulsions, the European Commission initiated infringement proceedings against France for procedural violations of European Union Directive 2004/38 (the Free Movement Directive). However such racially discriminatory state action should be challenged more properly as a substantive violation of Directive 2000/43 (the Racial Equality Directive). Because the European Union does not have its own separate body of human rights law that is binding within Member States, using the Racial Equality Directive to offer protection to vulnerable minorities by challenging discriminatory state practices may be an alternative method of achieving human rights objectives within Member States. Moreover, since the Racial Equality Directive lacks interpretation, a situation of race-based expulsion of EU migrants would be an opportunity to clarify and develop the scope and meaning of the Directive.

The paper analyses the exportation and importation of works of art between Poland and the European Union prior to Poland’s entry into the bloc on May 1, 2004. The author presents a dynamic analysis of artwork exports and imports data according to Poland’s Central Statistical Office (GUS) in 1992-2004. She identifies the main artwork export and import markets in Europe and estimates the share of the private sector in artwork trade. The analysis yields several conclusions. The value of artwork exports and imports between Poland and the EU-15 was characterized by major changes. EU countries accounted for a high percentage of Poland’s artwork trade in 1992-2004. This applies to both exports and imports. In the analyzed period, the value of Polish artwork exports was higher than the value of imports. Moreover, the analysis revealed that the movement of artwork between Poland and the EU was strongly concentrated in the case of several countries, with a clear marginalization of the remaining member states. France, Germany, Britain and Italy had the greatest share in Poland’s artwork trade. The share of the private sector in artwork trade was considerable, exceeding 75 percent in exports and 58 percent in imports.

Free movement of workers is one of the most important fundamental right, which results from the membership in the European Union. This right includes in particular : the right to apply for the offers of employment in the other EU states; the right of free movement for the purposes of seeking work; the right of residence; the right to stay in the other EU state after the termination of labour contract. According to European Union law, mention rights belongs not just to employees, who are the citizens of the European Union, but in limited range also to their family members. The exemptions to the right of free movement are rather limited. The aim of the presented contribution is to describe the essence of the right of free movement of workers in the European Union mainly in the light of the relevant judicial decisions of the Court of Justice of the European Union.

January 1, 2013 have passed twenty years since the formal establishment of the single internal market of the European Union. This does not mean that from that day there were no barriers to movement of goods, persons, services and capital. They were abolished gradually, but still today the European Union’s internal market, which consists of 28 countries and inhabited by over 500 million people, it does not operate as a single national market. The aim of the study is to show the evolution of the functioning of the free movement of goods, persons, services and capital, with particular emphasis on the direction of changes in the near future.

The issue of re-nationalization (disintegration and fragmentation) of integration process is manifested by the will of some of the Member States to verify their relations with the European Union. In the age of an economic crisis of the EU and in relation to the large migration of the population, there has emerged strong social and political criticism, on the European level, of the integration process, with some Member States even consideringtheir withdrawal from the EU. In those States, demands forextending the Member States’ competences in the field of some EU policies are becoming more and more popular. The legal effects of the above-mentioned processes are visible in the free movements of the internal market, mainly within the free movement of persons. Therefore, there are problems, such as increased social dumping process, the need to retain the output of the European labour law, the issue of the so-called social tourism, erosion of the meaning of the EU citizenship and the principle of equal treatment.

The inclusion of Poland to the common market for goods meant the abolition of customs duties and quantitative restrictions on agricultural products in mutual trade with the countries of the European Union (customs duties on industrial goods have already been abolished by the Europe Agreement) and the application of the Common Customs Tariff on imports from third countries. Freedom of movement of goods after the accession to the EU accounted for Polish entrepreneurs a chance, because the fulfillment of EU norms and standards means full access to the common market, amounting to more than 500 million inhabitants. Particularly noticeable was the impact of accession on foreign trade, which, thanks to the membership not only gained easier access to the common market, but also new opportunities to increase trade with third countries. Since Polish accession to the EU gradually increased trade in agricultural products as well as their participation in the Polish foreign trade. Emigration of Poles also increased significantly, especially to countries that with effect from 1 May 2004 opened their labor markets, namely the United Kingdom, Ireland. In the final evaluation of the benefits of joining the common market and free movement of goods, persons, services and capital far outweigh, in both the scale of the economy and at the micro level, the costs associated with membership in the European common market.

The article outlines the role of the EU in resolving the armed conflict in the western Sudanese province of Darfur, and explains the important role played by the EU in its engaged in peacekeeping and that guided his condition, as well as how it actions and decisions were received by the Darfurians and the government in Khartoum. All this was not only to save the life of hundreds of thousands of civilians, but also opposition to the regime and impact on its interests. Unfortunately, there was no general coordination of EU the actions, not only in Darfur, but also in the whole of Sudan. That resulting chaos in actions related to the quality of cooperation between the EU bodies. There was no close co-operation aimed at planning of aid from the United Nations, also because it was a kind of rivalry between EU and UN organizations who want to be seen as a major mediator in peacekeeping.
