The paper deals with the legislative activity of local government bodies in relation to so-called “problem resolutions” The scope of the article covered over 50 resolutions on sexual ethics issues. Problem resolutions of municipal (county, regional) councils are sequentially discussed in the following sub-sections: gender ideology, public expression of the views of the LGBT movement, legalization of same-sex unions, pornography and prostitution. According to the author, the best form of control of the given resolutions is social control carried out by the residents of local communities within the framework of the electoral mechanism. Sub-jecting such resolutions to substantive review by the administrative courts would result in the judiciary’s entanglement in axiological, philosophical, historical and political disputes. Recognisable shortcomings in the functioning of the title institution should not obscure the importance of problem resolutions as a form of local government expression.

Celem artykułu jest określenie skali zjawiska kontaktu dzieci i młodzieży z materiałami pornograficznymi i seksualizującymi, roli rodziców w profilaktyce tego kontaktu oraz wskazanie jego negatywnych korelatów. Badanie zostało zrealizowane techniką Audio-CASI na ogólnopolskiej losowej reprezentatywnej próbie uczniów w wieku 11–18 lat (N = 3943). Wykorzystany w badaniu kwestionariusz poruszał m.in. takie zagadnienia jak: nadużywanie internetu, kontrola rodzicielska, kontakt z pornografią, wiedza na temat seksualności, ocena zadowolenia z różnych aspektów życia i podejmowanie zachowań seksualnych. Wśród badanych 43% miało kontakt z materiałami pornograficznymi i seksualizującymi. Chłopcy oglądają tego typu treści ponad dwa razy częściej (AOR = 2,228) niż dziewczyny. Ponad połowa dzieci i młodzieży (58%), która miała kontakt z materiałami pornograficznymi i seksualizującymi, deklaruje, że trafiła na nie przypadkiem. Osoby, które miały kontakt z materiałami pornograficznymi i seksualizującymi, ponad trzy razy częściej otrzymywały zdjęcia o charakterze erotycznym (AOR = 3,335) i ponad pięć razy częściej je wysyłały (AOR = 5,014). Osoby, które miały kontakt z pornografią i materiałami seksualizującymi, są mniej zadowolone z osiągnięć szkolnych (rho = –0,124), rodziny (rho = –0,182), przyjaciół (rho = –0,065), czasu wolnego (rho = –0,110) i życia ogólnie (rho = –0,155). Nie wykazano żadnych istotnych statystycznie związków między wystąpieniem kontaktu z tego typu treściami a zadowoleniem z własnego wyglądu. Brak jakichkolwiek zasad dotyczących korzystania z internetu ma związek z kontaktem z materiałami pornograficznymi i seksualizującymi (AOR = 2,134).
The aim of the article is to determine the scale of children and youth’s exposure to pornography and sexually explicit material, the role of parents in the prevention of this contact and an indication of its negative correlates. The aim of the article is to assess the, indicate on the risk factors of exposure and the relationship between children and youth’s exposure to pornography and its psychosocial and health variables. The study was carried out using the Audio-CASI technique on a nationwide random representative sample of students (N = 3943) aged 11–18. The questionnaire used in the survey covered issues such as: internet abuse, parental control, exposure to pornography, knowledge about sexuality, assessment of satisfaction of various aspects of life and engaging in sexual behaviors. Among the respondents, 43% had contact with pornographic sexual materials. Boys view this type of content more than twice as often (AOR = 2.228) than girls. More than half (58%) of children and youth who have had contact with pornographic and sexual material declare that it was accidental. Those who had contact with pornographic and sexual materials, more than three times more likely to receive erotic photos (AOR = 3.335) and more than five times more likely to send these types of photos (AOR = 5.014). People who have had contact with pornographic and sexual materials are less satisfied with school achievements (rho = –0.124), family (rho = –0.182), friends (rho = –0.065), free time (rho = –0.110) and life in general (rho = –0.155). There were no statistically significant relationships between exposure to this type of content and the satisfaction with one’s appearance. The lack of any rules regarding the use of the internet is related to exposure to pornographic and sexual materials (AOR = 2.134).

Pornography has become an important social and political issue. The emphasis on pornography as a form of sexual and gender diversity is a component of larger societal and cultural trend - globalisation. The aim of the paper is to present and prove the thesis, that Internet pornography is nowadays a good mirror of deep social processes and structrures (suppressed fears, complexes, needs, changes of identity and forms of power, esp. biopower). The first part includes the recapitulation of the methodology of sociological research of pornography (esp. visual anthropology, discourse analysis). The author shows, how important are implications of Polish laws for research on Internet pornography in Poland (there are no international laws regulating Internet pornography). He also proposes new definition of pornography. Global pornography is in the dialectic relation with social institutions. It sexualizes social practices, which people try to desexualize in everyday life to avoid allegations of sexual misconduct (eg. health care practitioners). Hence, existence of pornography causes reaction of the social system, which generates new taboos (eg. nakedness of children) and forms of social control. But also pornography transgresses social norms and visions. The second part of the article includes three case studies: the BDSM pornography, the medical fetishism as a form of biopower and a problem of 'pedophilization' of visual representations in public sphere.
Artykuł podejmuje problem pornografii internetowej jako przedmiotu badań socjologii. Analizuje podstawowe zagadnienia metodologiczne, w tym związane z penalizacją pewnych form pornografii. Autor zarysowuje trudności definicyjne i proponuje własną definicję pornografii. Główna teza artykułu głosi, że dzięki właściwościom Internetu jako masowego, globalnego medium, możliwego do odbioru w miejscach prywatnych, pornografia przeszła jakościową zmianę – w stopniu wcześniej niespotykanym zaczęła reprezentować główne, głębokie, trendy społeczne oraz rozszerzyła gamę obrazów o najbardziej dewiacyjne zachowania. Stała się specyficznym zwierciadłem nowoczesnych społeczeństw, ukazując z całą wyrazistością tłumione lęki, kompleksy, potrzeby, przemiany tożsamości i formy władzy. Zglobalizowana pornografia pozostaje w dialektycznym związku z instytucjami społecznymi. Seksualizuje zdeseksualizowane praktyki społeczne, prowadząc z jednej strony do ostrej reakcji systemu społecznego, mnożącego granice i tabu, a z drugiej poprzez transgresję w świecie wyobrażeń społecznych podważa tradycyjne formy władzy. Autor weryfikuje tę tezę badając Bondage and Discipline, Domination and Submission, Sadism and Masochism (BDSM), występowanie reprezentacji biowładzy (w sensie Foucaulta), w postaci tzw. fetyszyzmu medycznego oraz problem pedofilizacji sfery publicznej.

The paper Sex and Oppresion in Cyberspace: A Speculative Vision in Margaret Atwood’s “Oryx and Crake” Novel analyzes Margaret Atwood’s Oryx and Crake in reference to the issues of violence and sex as present in the cyberspace. Before focusing on these two problems, generic outline is introduced, starting from the commonly used categories of utopia/eutopia/dystopia to those more closely associated with Atwood herself, i.e. speculative fiction and utopia. Violent internet games and explicit pornography act in the novel as sign of ethical reevaluation, which in the long run leads the novel’s world to the verge of a total catastrophe. At the same time, the overabundance of such on-line stimuli becomes synonymous with our contemporary culture of exhaustion.

The paper discusses contemporary condition of French erotic or/and pornographic novel. As social and cultural circumstances seem to put an end to its transgressive potential, the authors of this kind of writing tried, at first, to keep abreast of other media. Nevertheless, the “trash” or “grunge” novel as well as autofictional erotic writings were not able to satisfy the critics. The novels from L’instant erotique collection, written by specialists of erotic art, change the strategy and exploit the new state of cultural relations in which the role of this sort of literature is rather to imitate or to play with erotic or pornographic tradition, creating a new model of reception: very conscious and erudite.

The subject of the following essay centers around erotic language in Jacek Kaczmarski’s works. The main objective is to present how erotic language can be used to create both metaphors of sexual intercourse and metaphors of sex organs. Using numerous, various examples the author describes language phenomenons appearing in Kaczmarski works (from vulgar and almost-pornographic vocabulary to original metaphors and allegories) and in a vast spectrum.

Internet users mainly consider ‘hardcore’ in connection with something extreme (eg. sports), which ensures maximum intensity of dangerous experience or resistance to change. ‘Hardcore’ is also name of the style in music, which in the 1980s was initiated by the second wave of punk bands. At the same time it applies to the genre of electronic music. Inhomogeneous concept of hardcore is associated with its earlier use than those that we now know. The word ‘hardcore’ was also used as the name of a base for road construction (eg. small stones, pieces of brick and grits), and/or to describe difficult/extreme physical exercise. However, before the term ended up in the language of culture, it was an economic term, meaning people who were not only unemployed, but those unemployed who have been out of work for a year or longer. The word appears in the Oxford English Dictionary (1936) in a phrase ‘hard-core unemployment’ (hard core of unemployed) which can be traced to the difficult situation of people. In general, the first time it appears in 1930 in the texts by Irish parliamentarians. Then, after 1950, it is more often used to determine former prisoners, terrorists (pro-segregation), people addicted to hard drugs, and even ... Republicans. Associations with ‘hard’ pornography or hardcore bands of music meant that deadline was not included in the art and did not function as an aesthetic category. At the same time hardcore, in all its manifestations, the term exists because of its diverse literary layer, as ‘cute’ word, and many references that make it difficult to ignore.

Artykuł stanowi jedną z pierwszych prób zwrócenia uwagi na relatywnie nowe zjawisko internetowych inicjatyw antypornograficznych. Są to strony i fora internetowe, zrzeszające internautów negatywnie nastawionych do pornografii, a często także masturbacji, które w ich mniemaniu mają destrukcyjne oddziaływać na wiele wymiarów życia. Zasadniczym celem nie jest jednak sam opis inicjatyw, ale ich odbioru wśród polskich internautów dzięki wykorzystaniu podejścia z zakresu etnografii wirtualnej. W praktyce oznaczało to analizę kilku publikacji internetowych i kilkuset komentarzy osób zaangażowanych lub zainteresowanych badanym zjawiskiem. W tekście są poruszone także etyczno-prawne problemy związane z prowadzeniem badań w Internecie na kontrowersyjne tematy.
This article is one of the first attempts to draw attention to the relatively new phenomenon of the Internet antiporn initiatives. These initiatives embody as websites and internet forums that gather Internet users who are negatively oriented towards pornography and often also masturbation, which in their opinion have destructive effects on many dimensions of life. However, the main aim of the article is not to describe the initiatives themselves, but to illustrate their recognition among Polish Internet users by using the virtual ethnography approach. In practice, this came down to the analysis of several online publications and several hundred comments of people involved or interested in the studied phenomenon. The publication also covers ethical and legal problems related to conducting Internet research on controversial topics.

W dobie nowej rewolucji seksualnej, naznaczonej głównie nadmierną stymulacją koitalną (Melzer 2019: 32) i eksploracją sensoryczną za pomocą praktyk oferujących nowe użycie ciała (Breton 2017: 188), desygnacja bytu w mentalnej reprezentacji istniejącej w świecie pozajęzykowym wydaje się niezwykle interesująca, zwłaszcza w odniesieniu do konstrukcji referencji anaforycznej w nowych mediach. W tym względzie należy zauważyć, że w dobie kultu ciała wzmocnionego wykorzystaniem nowych technologii różne przejawy miłości są popularyzowane w sieciach społecznościowych, a także w serwisach tematycznych, które stały się niezbędne dla strategii skutecznego marketingu. Wśród tych stron znajdują się bardzo specyficzne portale, a mianowicie strony z treściami pornograficznymi, zwane stronami X, gdzie w bardzo łatwy sposób można uzyskać dostęp do wielu zdjęć i filmów pozwalających użytkownikom na zaspokojenie rozmaitych apetytów cielesnych. Okazuje się bowiem, że ogromna popularność, a co za tym idzie – skuteczność tych portali internetowych nie ogranicza się dziś tylko do ich strony wizualnej, choć oczywiście to warstwa ikoniczna odgrywa tu kluczową rolę. Analiza szczególnego gatunku zewnętrznego dyskursu pornograficznego (Paveau 2014: 50), proponowana w tym artykule, opiera się na korpusie, dla którego zebraliśmy diastratyczny materiał niestandardowego języka, a mianowicie sto kart informacyjnych, określanych mianem biografii erotycznych 93 gejowskich i biseksualnych aktorów porno, publikowanych na francuskojęzycznej stronie https://www.videosxgays.com. Celem naszych badań jest sprawdzenie, jakie są funkcje slangu seksualnego ujmowanego za pomocą wyrażeń anaforycznych w multimodalnych tekstach o silnym wymiarze perswazyjnym, w których nie słowa, lecz obrazy, filmy czy zdjęcia odgrywają zasadniczą rolę referencyjną. Postaramy się zaobserwować efekty dyskursywne, jakie wywoływane są w obrębie tej odmiany językowej, wykorzystując różne typy anafor w bardzo szczególnym kontekście perswazyjnym, wraz z jej ogromną gamą specyficznych środków leksykalnych i stylistycznych: peryfraz, metonimii czy hiperboli.
In the era of a new sexual revolution marked mainly by coital overstimulation (Melzer 2019: 32) and sensory exploration through practices offering new uses of the body (Breton 2017: 188), the designation of an entity in the mental representation that exists in the extralinguistic world seems extremely striking, especially with regard to the construction of anaphoric reference in new media. In this regard, it is important to note that at a time of body worship reinforced by the use of new technologies, various manifestations of love are popularized on social networks as well as on thematic sites that have become essential to strategies of effective marketing. Among these web pages, there are very specific portals, namely those with pornographic content, called X pages, where one can very easily have access to numerous photos and videos allowing users to satisfy different carnal appetites. Indeed, it turns out that the immense popularity and, therefore, the effectiveness of these web portals today is not limited only to their visual side, although it is, of course, the image that plays a key role here. Analysis of a particular genre of external pornographic discourse (Paveau 2014: 50) that we propose in this paper is based on a corpus for which we have collected diastratic variational material from non-standard language, namely a hundred information sheets, referred to as erotic biographies of 93 gay and bisexual porn actors, gathered on the French-speaking site https://www.videosxgays.com. The objective of our study is to analyse the functions of sex slang apprehended through anaphoric references, which are expressed in multimodal texts with a persuasive vocation, where images, films or photos play a key referential role. In short, we will try to highlight the discursive effects that this linguistic variation seems to produce by exploiting the anaphoric reference in a particularly persuasive context, with its enormous range of specific lexical and stylistic means: periphrases, metonymies, hyperboles, etc.

Opis:
It shall not be doubtful that pornography is very detrimental particularly for children. As a consequence children shall be protected against pornography in the Internet. However, introduction of the legal provisions on blocking the Internet access to pornography in the interest of children results in a number of problematic issues, such as collision with economic rights (EU internal market freedoms) or freedom of speech. The analysis carried out in the article results in a conclusion that introduction of such restrictions is nevertheless legally possible and reasoned. It is also pointed out that because at the time being the EU does not intend to adopt appropriate legally binding measures, it is for national legislators to confront the problem. The question is therefore not if access shall be restricted, but how to do it, in particular, whether it shall be restricted on the basis of normative regulation or on the basis of self-regulation.

Le langage de la pornographie se déploie aujourd’hui non seulement dans les dictionnaires des mots du sexe ou dans les textes, mais aussi sur diverses pages Web. Notre étude se fonde sur un corpus pour lequel nous avons analysé un matériau variationnel relevant du non-standard : une centaine de biographies érotiques d’acteurs X homo- et bisexuels rassemblées sur le site francophone https://www.videosxgays.com/. L’objectif de notre analyse est de nous pencher sur la construction discursive de l’identité des acteurs X pour mettre en avant l’ethos de puissance qui se dégage dans le discours étudié à travers un répertoire spécifique d’instruments langagiers.
Today the language of pornography unfolds not only in sex word dictionaries or texts, but also on various web pages. Our study is based on a corpus for which we analyzed a variational material relating to the non-standard: around a hundred erotic biographies of homo- and bisexual pornstars gathered on the French-speaking site https://www.videosxgays.com/. The objective of our analysis is to look at the discursive construction of the identity of X actors in order to highlight the power ethos that emerges in the discourse studied through a specific repertoire of linguistic instruments.

Opis:
The purpose of this article is to bring closer the legal aspects of deepfake. Beginning with what exactly deepfake is and what its history is, in what areas it is and can be used and what risks and benefits it brings. This article distinguishes between civil law and criminal law aspects. Furthermore, the authors have indicated examples of legal regulations of deepfake, which were adopted in such legal systems as the USA or China. At the end of the article, the authors give the potential evolutionary paths of legal solutions concerning deepfake technology.
Celem niniejszego artykułu jest przybliżenie prawnych aspektów deepfake. Poczynając od tego, czym dokładnie jest deepfake i jaka jest jego historia, w jakich obszarach jest i może być stosowany oraz jakie ryzyko i korzyści przynosi. W artykule dokonano rozróżnienia między aspektami prawa cywilnego i karnego. Ponadto autorzy wskazali przykłady regulacji prawnych dotyczących deepfake, które zostały przyjęte w takich systemach prawnych jak USA czy Chiny. Na końcu artykułu autorzy podają potencjalne ścieżki ewolucji rozwiązań prawnych dotyczących technologii deepfake.

The article examines the relations between photography, body, nudity, and sexuality. It presents changing relations of photography with a naked or semi-naked body and different forms and recording conventions. From the mid-19th century the naked body became the subject of scientifically grounded photographic explorations, an allegorical motif referring to painting traditions, an object of interest and excitement for the newly-developed “touristic” perspective. These three main ways in which photographs depicting nudity were being taken at that time shaped three visual modes: artistic-documentary, ethnographic-travelling, and scientific-medical. It has deep cultural consequences, including those in the ways of shaping the notions of the corporeal and the sexual. Collaterally, one more, probably prevalent in numbers, kind of photographical images arose: pornographic. In the middle of the 19th century, the repertoire of pornographic pictures was already very wide, and soon it become one of the photographic pillars of visual imagination of the modern society, appealing to private and professional use of photography, popular culture, advertisement, art. The number of erotic and pornographic pictures rose hand over fist with the development of digital photography. Access to pornographic data is easy, fast, and cheap, thanks to the Internet, as it never was before. Photography has fuelled pornography, laying foundations for a massive and lucrative business, employing a huge group of professional sex workers. How all those processes affected our imagination and real practices, what does the staggering number of erotic photography denote? One possible answer comes from Michel Foucault who suggests that our civilization does not have any ars erotica, but only scientia sexualis. Creating sexual discourse became an obsession of our civilization, and its main pleasure is the pleasure of analysis and a constant production of truth about sex. Maybe today the main pleasure is about watching technically registered images, and perhaps that is why we may consider visual redefinition of the body as the main social effect of the invention of the photography.

Opis:
An offence involving in the use of indecent words in a public place is one of the acts classified in Chapter XVI Misdemeanour Code that violates public decency. Its subject matter consists in placing an obscene announcement, inscription or drawing or using obscene words in a public place. Both the notion of public morality and the sign of indecency are indeterminate in nature. Similarly, the concept of an “obscene word” is not very precise. Both public morality and obscenity are highly relative, perceived differently by different social groups and considered more or less acceptable depending on the age of the audience. The pursuit of offences involving the use of indecent words cannot, however, be selective. One should distinguish between the use of vulgar words as an insult and a specific “interlude”.
Wykroczenie polegające na używaniu w miejscu publicznym słów nieprzyzwoitych jest jednym z czynów stypizowanych w rozdziale XVI Kodeksu wykroczeń godzących w obyczajność publiczną. Jego strona przedmiotowa polega na umieszczeniu nieprzyzwoitego ogłoszenia, napisu lub rysunku, albo używaniu słów nieprzyzwoitych. Zarówno pojęcie obyczajności publicznej, jak i znamię nieprzyzwoitości mają charakter niedookreślony. Podobnie mało precyzyjne jest pojęcie „słowa nieprzyzwoitego”. Zarówno obyczajność publiczna, jak i nieprzyzwoitość są wysoce relatywne, postrzegane są różnie przez różne grupy społeczne i uznawane za mniej lub bardziej dopuszczalne w zależności od wieku odbiorcy. Ściganie wykroczeń polegających na używaniu słów nieprzyzwoitych nie może być jednak selektywne. Odróżnić należy posługiwanie się słowem wulgarnym jako wyzwiskiem od traktowania go jako swoisty „przerywnik”.
