The amendment of the above mentioned Act results from the implementation of the provisions of five directives of the European Communities into the Polish legal order. Nevertheless, the author points out that the proposed amendment goes beyond the limits specified by EU law, reducing both the autonomy of private entities and constitutional freedom of contracts. He refers to the defective wording of the provisions specifying the substantive scope of the Act, at the same time supporting the proposal for the extension of the scope of claims that can be brought by persons harmed by unequal treatment and provisions modifying the rules for application of statute of limitation of claims.

The Consumer Credit Act of 12 May 2011 introduced, with effect from 11 March 2016, Article 36 a 1, which specifies the maximum amount of non-interest credit costs. The maximum amount of these costs is calculated according to a formula (Article 36a (1)), and additionally, these costs over the entire duration of the credit may not be higher than the total amount of credit (paragraph 2). On the other hand, with effect from 30 May 2010, Article 304 CC was amended to include new paragraphs 2 and 3-2, aimed at protecting the consumer from excessive benefits in loan agreements. According to the author of the article, the provisions aimed at protecting the consumer against unfair practices of lending entrepreneurs are insufficient and, despite the implementation of Directive 93/13/EEC, do not provide sufficient consumer protection. Therefore, the court deciding the case should always ex officio examine whether contractual provisions constitute prohibited clauses.

The present article concentrates on the interpretational divergence concerning VAT taxation of entity change in a civil law partnership. On the basis of the presented research it is difficult to justify the autonomy of taxation law from other branches of law. As far as the context of autonomy of taxation law is concerned, it is possible to interpret some factual conditions different from other branches of law but also it is difficult to justify the fact that within the taxation law one act approaches the issue completely differently than the other.

A dominant view that a foreign state uses immunity in court examination of civil law cases deserves acceptance. This is the so-called limited immunity. The immunity of a foreign state in court examination of civil law cases and matters related to its examination should not be regulated in domestic law, including the Code of the Civil Procedure. Solutions for pursuing claims before national courts from a foreign state cannot be limited only to the issue of regulation of state immunity and the possibility of its waiving by the foreign state, but they also should cover issues related to the subsequent execution of a judgement delivered in such proceedings.

Opis:
Franciszek Ksawery Bohusz (1746—1820), Jesuit and diocese priest after the dissolution of the monastery, was a man educated in philosophy, theology, and law. Between 1777—1778 and 1781—1782, he made long journeys abroad, during which he got to know Czechia, Germany, France, England, Austria, Italy, and Switzerland. These were the journeys of an intellectual, typical of the period of Enlightenment. Not only did he admire edifices worthy of interest, visit museums and libraries, but he also tried to gain knowledge of the political regimes, social and economic relations in the visited countries. His observations were diligently noted down in travel journals and finally edited upon his return to the country. A lot of comments concern court law: civil and criminal, particularly procedural law. The traveler was also interested in the administration of punishments. The references to law vary from extensive, comprehensive discussions of whole branches of law to prevailing brief mentions of particularly interesting legal institutions. The author attempts to offer a possible objective view of legal solutions he became familiar with, yet, does not always fully succeed. It is worth noting his commentaries on English law, which are not only exceptionally extensive, but also filled with not always well-justified praise. On the other hand, his evaluations of other legal systems, for instance Swiss, seem to be rather harsh and stereotypical. Nevertheless, Fr. Bohusz’s observations on court law in the visited countries deserve a thorough analysis since they let us assess their accuracy and the degree to which some foreign legal solutions found appreciation in his eyes.

The paper describes the behavior of a patient who in order to obtain medical benefits simulates symptoms which, according to special medical knowledge could be recognised as a threat to life or health. The main problem arises when despite the fact that the limits of medical benefits financed from the public funds have run short, a medical doctor, wishing to fulfil his statutory duty, decides to render medical assistance to such patient. Whether that assistance was really indispensible can only be determined after the patient has been thoroughly examined. It may then be too late, though, and the doctor may face serious difficulty in being reimbursed by the National Health Fund, or, if there was no actual threat to patient’s life or health, such compensation for rendered service becomes out of reach. The author analyses the abovementioned situation from the civil law point of view.

The Hungarian labour law reform is a good example of how the idea of flexicurity is enforced in the 21st century in a post-socialist country. Flexible employment relationships overshadow the social side what is necessary in order to develop effectiveness and competitiveness. This process is completed by the relationship between labour and civil law and it is traced back to the special tradition of legal history. The present study surveys the main connection between labour and civil law and gives some remarks on the special private law-nature of labour law. This paper deals with one of the central questions of the Hungarian labour law reform, that is, the changing relationship between labour and civil law. This legal problem can be observed in Hungarian law for a long time. The study focuses on the civil law-type of the employment relationships and the differences between them. This study examines the regulation before 1st July of 2012 with the aim that development will be seen clearly in connection with the regulation in force. The study emphasizes what kind of fundamental changes the direct usage of civil law can perform in the strict structure of employment relationships.

Separating Roman law from the theory of applicable private law inspires - from the beginning of 20th century – the questions pertaining to the meaning, aims, and methods of researching Roman law. This article analyses these issues in the context of the changes of the evaluation of research resulted from the Polish higher education and science act enacted in 2018. The core of this analysis is the comparison of the traditional understanding of the internationalization of the study of Roman law by Polish researchers and the understanding of world-class research according to the new Polish law. The tension between traditional approach of Romanists and bibliometric criteria of evaluation has significant implication for whether and how the Roman law should be studied and taught on the Polish faculties of law. The paper stresses the role of the impact of Polish researches of Roman law on the European debate about basic problems of private law and legal method today. The future of Roman law in Polish legal education interacts with today’s fundamental dispute about what is Western civilization and how it is to be understood.

Infringements of competition law can cause serious harm to both consumers and undertakings. Aside from the development of public enforcement of competition law, much focus has been placed in recent years in the European Union on private competition law enforcement. Lawsuits raised by undertakings that sustained damages from anti-competitive practice concerning the compensation of such damages have historically not been widespread in Europe. No such cases have been recorded in Albania at all yet, despite the fact that its competition protection legislation has provided this possibility since 1995. The main causes of the lack of private competition law enforcement in Albania include the absence of judicial practice and doctrinal approaches in this area. Relevant here is also the inability of Albanian businesses and consumers to react to competition protection cases as they still lack competition law knowledge and as a result of the absence of an appropriate legal framework for class actions. The scope of this article is to analyze the current situation of private competition law enforcement in Albania. The paper emphasizes the current legal framework including existing obstacles to private competition law enforcement and improvements that should be introduced in the context of its competition law, the law of civil procedures and the law of obligations.
Les violations du droit de la concurrence peuvent causer un préjudice grave aux consommateurs et aux entreprises. À part du développement de l'application publique du droit de la concurrence, beaucoup d’attention a été consacrée les dernières années à l’application privée du droit de la concurrence dans l’Union européenne. Néanmoins, les actions en indemnisation introduites par les entreprises qui ont subi des dommages résultant de la violation du droit de la concurrence n’étaient pas trop répandues en Europe. Malgré le fait que depuis 1995 la loi albanaise sur la protection de la concurrence prévoit la possibilité d’introduire les actions en indemnisation par les entreprises qui ont subi des dommages resultant de la violation du droit de la concurrence, aucune de ces actions n’était pas été introduite en Albanie jusqu’à présent. Les raisons principales du non-développement de l’exécution privée du droit de la concurrence en Albanie sont : l’absence de la pratique judiciaire et l’absence de la doctrine juridique dans ce domaine. il faut aussi mentionner sur ce point l'incapacité des entreprises et des consommateurs albanais de répondre aux actions privées ce qui résulte du manque de connaissances en droit de la concurrence et l'absence d'un cadre juridique approprié pour les actions collectives. Le but de cet article est d’analyser l’état actuel de l’exécution privée du droit de la concurrence en Albanie. L’article met l’accent sur le cadre juridique actuel, y compris les obstacles à l’exécution privée du droit de la concurrence, et propose les améliorations qui devraient être introduites dans le droit de la concurrence, dans la procédure civile et dans le droit des obligations afin de changer cette situation.

Code of Criminal Procedure provides some kind of possibility of seeking compensation for wrongful conviction, temporary detention or detention. Claims, pursuant to article 552 § 1 of the Code of Criminal Procedure, does not provide for exceptions to the principle of full compensation of damages. It includes both claims for damages for actual loss as well as for lost profits. The indicated provision corresponds to art. 417 § 1 of the Civil Code and article 4171 § 2 of the Civil Code The State Treasury is liable for damage caused by unlawful act or comission in the exercise of public authority. If the damage was caused by issuing a final decision or a final decision, its remedy can be demanded after it has been found in the proper proceedings that they are unlawful. Therefore, whether the situation described in article 552 of the Code of Criminal Procedure - the revocation of a final judgment by way of cassation, as a result of which a more favorable decision is issued for the accused, is the state equivalent to finding the unlawfulness of the ruling thus violated? The liability of the State Treasury for damage and harm caused by unjust condemnation, arrest or detention, in many cases, extend the scope of this responsibility to states that could not be classified as unlawful acts or omissions in the exercise of public authority. Depending on the choice of position, one should consider maintaining a separate criminal and civil procedure for examining cases for damages for unjustified conviction, temporary detention or detention.

Civil law contracts are widely used in school practice. It is the school running body which is entitled to entering into such contracts, however in most cases of school practice, school principal is also capable of entering into such contracts. Civil law contracts most of all will find application in dealing with external parties. They are less common in employee relations. This is due to the specificity of teacher’s job, which is characterised by employment relationship, and this excludes the possibility of entering into a civil law contract. However, it is possible to enter into a civil law contract with a teacher so that they can perform additional tasks. It seems that nowadays when cooperation with external parties is becoming more and more relevant, which is facilitated by the new core curriculum, civil law contracts will have wider application.

In 1952 Witold Czachórski posited as a general principle of Polish contract law that legal actions leading of a transfer of wealth require for their validity a proper cause; the rule was construed as a mandatory one and precluded the creation of abstract obligations unless expressly permitted by law. Czachórski’s theory was underpinned by an in-depth analysis of the entire body of civil law, as well as axiological considerations that emphasized the need to control contractual fairness (Section 1). After 40 years of largely uncontroverted acceptance the rule was abruptly abandoned by the Supreme Court on grounds of freedom of contract (Section 2). Despite its fundamental nature, this change was not accompanied by any in-depth discussion in legal doctrine (Section 3). While unsatisfactory on a theoretical level, it seems in retrospect that this was, at a time of systemic transformation to a liberal market economy, a pragmatic and perhaps inevitable approach that served to further the newly re-established principle of freedom of contract. Paradoxically, however, with the contemporary shift to a more control-oriented approach to freedom of contract it would not be entirely surprising to see a rebirth of the role of cause and of Czachórski’s theory some time in the future (Section 4).

The purpose of the paper is to discuss the problems arising from the application of sub-clause 20.1 of the FIDIC contract templates in the civil and common law countries. For these considerations, the author chose the red and yellow book editions of 1999 in unmodified versions. The paper tries to determine whether it is possible to implement the sub-clause in their original wording in the above-mentioned legal systems. Another aspect under the scrutiny of the author is the legal nature of provisions of 20.1 sub-clause which concern, in particular, the issues related to the 28-day deadline for filing a claim and releasing the contracting authority from the obligation to provide compensation as a result of the Contractor's failure to meet the indicated deadline. The research was conducted using the legal-comparative method. With regard to the civil law system, the analysis concerned the compliance of the sub-clause provisions with mandatory standards, in particular Article 119 of the Civil Code, and Article 353¹ in conjunction with Article 58 of the Civil Code. When it comes to the common law jurisdiction, the study concerned the consequences of failure to comply with the obligation imposed by the sub-clause on the Contractor in the light of the prevention principle and on the basis of praemia that law does not arise from injustice. As a result of the conducted research, it was found that sub-clause 20.1 of the FIDIC contract terms requires prior modifications both in civil and common law countries and adaptation to the requirements of the law in force in the country in which it is to be implemented.

This article is directly connected with the issues presented in the article “The historical background for the legal expression of the rule Impossibilium nulla obligatio est (D. 50,17,185) in the German Civil Code”. The mentioned article criticizes, from historical point of view, the enlargement of the application of the Celsus’s rule to the cases of initial subjective and subsequent – both objective and subjective, impossibility of performance. The following article shows some of doctrinal consequences of such an enlargement interpretation. One of them concerns the § 311a (2) BGB, which contains the separate liability regime for the initial impediments of performance. This paragraph entitles the creditor to claim damages in lieu of performance, unless the debtor did know of the impediment when the contract was concluded, and was not responsible for not having known about it. The debtor held liable for the positive interest. This regulations is firstly presented in relation to its doctrinal inconsistency. Afterwards, it is presented in relation to the proposition of the analogy application of § 122 BGB when the debtor is not responsible for not knowing about the impediment, to make him liable at least for the negative interest. Finally this regulation was evaluated in relation to the demand of staying in the line with the Principles of European Contract Law and the UNIDROIT-Principles.
