The article contains a critical analysis of chosen aspects of social participation in the process of preparing the government’s bills. Dialogue between the social partners and the government plays a special role in this process. On the one hand, that dialogue is an important element of so-called deliberated democracy. On the other hand, it contributes to rationalization of the legislative process. The social consultations are not regulated in the Constitution of the Republic of Poland of 2nd April 1997 but in the many of statutes. A catalogue of subjects who participate in the social consultations is very large and contains about 70 organisations, among others trade unions of workers, and employers. A special forum for contacts between the social partners in the process of preparing the government’s bills is the Trilateral Commission for Social and Economic Affairs. In the modern Polish legal order there is no compact model of social consultations, which precisely qualifies their functions in the law-making process. In the context of the principle of sovereignty of the nation and the principle of civil society it is extremely important to give the social consultations a real shape and to provide them a real influence on the legislative process as well.

Artykuł dotyczy zagadnienia wpływu rządu na proces ustawodawczy we współczesnych rozwiązaniach ustrojowych Wielkiej Brytanii i V Republiki Francuskiej w nawiązaniu do systemu rządów parlamentarnych. W obydwu omawianych przypadkach, znacząca aktywność w procesie ustawodawczym, warunkowana bądź to osadzoną w konwenansach konstytucyjnych praktyką polityczną (W. Brytania) bądź świadomie przyjętymi przez ustrojodawcę konstrukcjami normatywnymi (Francja), w powiązaniu z mechanizmami współpracy pomiędzy legislatywą i egzekutywą umożliwia rządom skuteczne realizowanie programu politycznego za pomocą ustawodawstwa.
This article concerns the influence of the government on legislative process in the present political system in Great Britain and the V French Republic in con- nection with parliamentary system of government. The British system does provide a working synthesis of the two things. One of them is the close union and nearly complete fusion of the executive and legislative powers. The Cabinet Ministers, as a rule, are members of one or other of the Houses of Parliament. In a sense, they are representatives of Parliament. On the other hand, the Cabinet is not the mere agent of Parliament, it does not constitute a committee of Parliament. Ministers guide and up to a point deter- mine Parliament’s activities. The responsibility for the initiation and making of laws rests primarily and almost exclusively upon them. Cabinet is well situated to exert a very positive leadership of Parliament. It monopolizes the framing and introduction of all important legislation, controls the allocation of parliamentary time, decides on adjournments and dissolutions, and has an assured majority to back its decisions. According to these conditions, the function of the House of Commons is, therefore, to act as a forum for criticism and a focus of outside opinion. If the Cabinet has a majority, and so long as that majority holds together, the House doesn’t control the government but the government controls the House and shaped the parliamentary legislation. The same effects – but in a different way – achieves the government in the Fifth French Republic. The Constitution of 1958 provides powerful measures for government to control the process of making laws in both Chambers of the French parliament. Among various forms of supervising the internal parliamentary proceedings, exercised by the French government, the most important are, for example, connecting a bill with the vote of confidence, declaring objections to parliamentary amendments to the government’s bills or arranging the vote bloqué procedure. Moreover, an important element forced the domination of French executive branch in parliamentary legislative process is permanent cooperation and good relationship between the government and the President of Republic in conditions of political unity as well as in the state of cohabitation.

The Author analises present legal status, as well practice and legal propositions of changes. Celem artykułu jest analiza obecnej formuły odpowiedzialności dyscyplinarnej sędziów, w kontekście konstytucyjnych zasad niezawisłości sędziowskiej, niezależności sądów oraz prawa do sądu. Autor analizuje zarówno aktualny stan prawny, jak i praktykę oraz proponowane w tym zakresie zmiany. Przy okazji zauważa niebezpieczną tendencję przekraczania granic konstytucyjnych oraz kolizji obowiązujących przepisów z prawem Unii Europejskiej.

Problematyka miejsca i roli aktów o mocy ustawy w porządku ustrojowym ma istotne znaczenie w nauce prawa konstytucyjnego, zarówno w kontekście konstrukcji systemu źródeł prawa, jak i systemu rządów. Kwestia wydawania prze organy egzekutywy aktów prawa powszechnie obowiązującego o mocy równej ustawie ściśle związana jest bowiem z zasadą podziału władzy, a konkretnie z formułą racjonalizacji prawotwórstwa w systemie rządów parlamentarnych. Świadczy o tym fakt, iż największy rozwój prawodawstwa tego typu nastąpił w pierwszej połowie XX wieku, stanowiąc odpowiedź na głęboki kryzys funkcjonalny parlamentaryzmu w Europie. Akty o mocy ustawy mają również swoje stałe miejsce w polskiej tradycji ustrojowej. Wprowadzone po raz pierwszy na mocy tzw. noweli sierpniowej z 1926 r. w różnych formach i z różnym natężeniem funkcjonowały nieprzerwanie w polskim systemie źródeł prawa aż do roku 1989. Przyjmowała je również Mała Konstytucja z 1992 r., w wersji rozporządzeń z mocą ustawy, wydawanych przez Radę Ministrów na podstawie upoważnienia sejmowego. Konstytucja z 2 kwietnia 1997 r. zmniejszyła rolę i znaczenie rozporządzeń z mocą ustawy, redukując możliwość ich wydawania przez prezydenta RP wyłącznie do okoliczności nadzwyczajnych, związanych z wprowadzeniem stanu wojennego oraz brakiem możliwości działania Sejmu. Z uwagi na dostrzegalną coraz mocniej potrzebę racjonalizacji polskiego prawotwórstwa zasadnym jest rozważenie możliwości poszerzenia zakresu stosowania rozporządzeń z mocą ustawy w polskim porządku konstytucyjnym poprzez przyznanie rządowi kompetencji do ich wydawania na podstawie upoważnienia sejmowego, tyle że w formule skorygowanej w stosunku do rozwiązań, jakie przyjmowała Mała Konstytucja z 1992 r.
The issue of the place and role of the acts under the Act in order political system is important in the study of constitutional law, both in terms of the structure of the system of sources of law and system of government. The question of the issue by the acts of the executive authorities of universally binding law of the power of the law is in fact closely linked to the principle of separation of powers, namely the formula rationalization of law-making in a system of parliamentary government. Evidence of this act, that the greatest development of this type of legislation came in the first half of the twentieth century, acting in response to a profound crisis of parliamentarism functional in Europe. Acts under the Act are also a permanent place in the Polish political tradition. Introduced for the first time under the so-called novel in August of 1926, in various forms and with varying intensity continuously operate in the Polish system of sources of law until 1989. She received them the Small Constitution of 1992, as amended regulations with the force of law, issued by the Council of Ministers on the basis of parliamentary authority. The Constitution of 2 April 1997 reduced the role and importance of regulations with the force of law, reducing the possibility of their issuance by the President only for exceptional circumstances relating to the imposition of martial law and the inability to act of the Sejm. Because of the perceived need to rationalize more and more Polish law-making, it is appropriate to consider the possibility of widening the scope of application of the Regulations with the force of law in the Polish constitutional order, by granting the government the power to issue them under parliamentary authority, so that the formula adjusted relative to solutions that She received Small Constitution of 1992.

The article brings up the problem of the relationship between the constitutional principle of the common good and the activity of a territorial self-government in Poland. The first part contains some theoretical comments on the essence of the principle of the common good and on the relationship between the common good and the principle of subsidiarity. In the second part the author presents basic legal measures of the participation of the local community in the decision-making process. The third part contains some critical comments on the present relationship between the central authority and a local government. In the author’s opinion, some of the legislative initiatives of the lower chamber of the Parliament lead to the limitation of local governments independence and breach the principle of the common good.
Artykuł porusza problem relacji pomiędzy konstytucyjną zasadą dobra wspólnego a funkcjonowaniem samorządu terytorialnego w Polsce. Część pierwsza zawiera teoretyczne rozważania na temat zasady istoty zasady dobra wspólnego oraz relacji pomiędzy dobrem wspólnym i zasadą pomocniczości. W części drugiej autor prezentuje podstawowe środki prawne służące partycypacji społeczności lokalnej w procesie decyzyjnym. Trzecia część zawiera krytyczne uwagi na temat aktualnych relacji pomiędzy władzą centralną i samorządem terytorialnym. W ocenie autora niektóre spośród inicjatyw legislacyjnych większości sejmowej prowadzą do ograniczenia samodzielności samorządu terytorialnego, naruszając zasadę dobra wspólnego.

The purpose of this article is critical analysis of polish model of the government, adopted in the Constitution of 2nd April 1997, in the bearing of adopted factors of the rationalization. The key assumption of this article is to proof, that the legal constructions, referred in the Constitution of 2nd April 1997, in the relation to political practice, don’t satisfy the conditions, typical for the rationalized parliamentarism in its classical versions, for example in the Constitution of the Fifth French Republic of 1958 and in the 1949 Basic Law for the Federal Republic of Germany.

The article deals with the issue of relations between the Sejm and the Senate in the procedure of exercising its legislative function by the parliament. The author points out that the current Constitution of the Republic of Poland of 2 April 1997 greatly limits the influence of the Senate on the legislative process, which refers to the Polish systemic tradition. In this way, the Constitution adopts an extremely asymmetric bicameral model, despite the fact that both chambers of parliament in the Polish system are perceived as an organ of the legislative authority. The author critically assesses the regulations in force from the point of view of the axiology of the democratic system and postulates strengthening the Senate’s position in the implementation of the legislative function.
Artykuł dotyczy problematyki relacji pomiędzy Sejmem i Senatem w procedurze wykonywania przez parlament funkcji ustawodawczej. Autor zwraca uwagę, że obowiązująca Konstytucja Rzeczypospolitej Polskiej z dnia 2 kwietnia 1997 r. bardzo ogranicza wpływ Senatu na proces ustawodawczy, czym nawiązuje do polskiej tradycji ustrojowej. W ten sposób Konstytucja przyjmuje model dwuizbowości skrajnie asymetrycznej, mimo że obie izby parlamentu w polskim ustroju postrzegane są jako organ władzy ustawodawczej. Autor krytycznie ocenia obowiązujące regulacje z punktu widzenia aksjologii ustroju demokratycznego i postuluje wzmocnienie pozycji Senatu w realizowaniu funkcji ustawodawczej.

Pilny tryb ustawodawczy stanowi istotny instrument normatywny, za pomocą którego rząd w systemie parlamentarnym wpływa na przebieg parlamentarnego procesu ustawodawczego. Do polskiego procesu ustawodawczego tryb pilny wprowadzony został mocą postanowień „Małej Konstytucji” z 1992 r. jako środek służący zapobieganiu przewlekłości procedur sejmowych oraz obstrukcyjnym działaniom opozycji parlamentarnej wobec programu legislacyjnego rządu. Podobnie jak w poprzednim stanie prawnym tak i na gruncie rozwiązań przyjętych w Konstytucji z 2 kwietnia 1997 roku wyłączne prawo inicjowania postępowania ustawodawczego w trybie pilnym posiada Rada Ministrów. W świetle art. 123 ust. 1 Konstytucji klauzula pilności nie może być zastosowana wobec projektów ustaw podatkowych, ordynacji wyborczych, ustaw regulujących ustrój i właściwość władz publicznych oraz kodeksów. Ponadto, na podstawie odrębnych przepisów z możliwości stosowania trybu pilnego wyłączone są projekty ustaw budżetowych. Podstawowym mankamentem trybu pilnego w polskich rozwiązaniach ustrojowych jest brak konstytucyjnych terminów, które wyznaczałyby tempo sejmowych prac nad projektem objętym klauzulą pilności. W tych warunkach, rzeczywiste tempo rozpatrywania projektów pilnych w Sejmie zależy od woli samej Izby i jej organów. W efekcie, tryb pilny jest rzadko stosowany przez Radę Ministrów w praktyce polskiego prawa parlamentarnego, szczególnie wtedy, gdy rząd dysponuje stabilnym poparciem sejmowej większości. Może wówczas stymulować tempo sejmowych prac nad swoimi projektami ustaw za pomocą nacisków politycznych bez potrzeby uciekania się do trybu pilnego. Ewentualne zmiany regulacji konstytucyjnej powinny zatem objąć bardziej szczegółowe unormowanie trybu pilnego na etapie sejmowego postępowania ustawodawczego, na wzór regulacji dotyczącej czasu pracy Senatu nad ustawą.
Legislative procedure for urgent bills constitutes a crucial prescriptive instrument that is useful to a government in parliamentary system to influence the course of legislative process. In Poland the urgent procedure was introduced by virtue of provisions of the Small Constitution 1992, as a factor that serves to prevent the lengthiness of parliamentary procedures and obstructive actions of parliamentary opposition towards government legislation program. On the basis of decisions taken by the Constitution adopted on 2nd April 1997 and as in the previous legal situation, The Council of Ministers has the exclusive right to initiate legislative proceeding as a matter of urgency. In accordance with the 123rd article, para 1 of the Constitution, urgency clause cannot be applied against tax bills, bills governing elections, draft laws regulating systems and competence of public authorities and drafts of law codes. What is more, on the basis of separate articles, budget bills are excluded from using the urgency process. The basic drawback of the urgency process in Polish political solutions is the lack of constitutional deadlines that would indicate the pace of Sejm activities concerning the urgency clause. In such a situation, the actual pace of investigation of urgent bills in the Sejm depends on the lower house’s will and its bodies. As a result, in practice of Polish parliamentary law, the urgency process is rarely applied by the Council of Ministers, particulary when the government has stable support of Sejm’s majority at its disposal. In such a case, the government may stimulate the pace of parliamentary activities concerning its bills with the use of political pressures nad with no need of using the urgency process.

The article concerns the conditions and procedures of the taking over the duties of the President of the Republic of Poland by the Marshal of the Sejm or by the Marshal of the Senate in two varianties according to the Article 131 of the Polish Constitution of 1997. First of them takes place if the President of the Republic is temporarily unable to discharge the duties of his office. The Constitution of 2nd April 1997 does not clearly determine the circumstances that warrant this situation but determines the procedure of the taking over the duties of the President of the Republic. In the event of the temporary inability to discharge the duties of the office the President of the Republic shall communicate this fact to the Marshal of the Sejm, who shall temporarily take over the duties of the President of the Republic or the  Constitutional Court – on request of the Marshal of the Sejm – shall require him to temporarily perform the duties of the President of the Republic. The second variant takes place in the event of a vacancy in the office. Article 131 § 2 of the Polish Constitution determines the following situations where such a vacancy is deemed to occur: the death of the President of the Republic; the President’s resignation from office; judical declaration of the invalidity of the election to the Presidency or other reasons for not assuming office following the election; a declaration by the National Assembly of the President’s permanent incapacity to exercisehis duties due to the state of his health, adopted by a majority vote of at least two-thirds of the statutory number of members of the National Assembly; dismissal of the President of the Republic from office by a judgement of the Tribunal of State. In such circumstances the Marshal of the Sejm shall discharge the duties of the President until the next President will be elected. Furthermore the article presents the analysis of issue of the scope of constitutional responsibility of the Marshal of the Sejm or Marshal of the Senate who discharge the duties of the President ofthe Republic.

Artykuł stanowi próbę oceny doświadczeń polskiego parlamentaryzmu w dwudziestym wieku. Autor analizuje polskie regulacje konstytucyjne oraz praktykę parlamentarną, szczególnie koncentrując się na rozwiązaniach przyjętych w latach 1919–1935, a także wpływ tych regulacji na ewolucję polskiego parlamentaryzmu po II wojnie światowej, uwzględniając również aktualne doświadczenia ustrojowe. Analiza prowadzi autora do konkluzji, iż współczesne mankamenty systemu rządów parlamentarnych w znacznej mierze bazują na historycznych doświadczeniach polskiego parlamentaryzmu.
The Article is an attempt to evaluate the experiences of Polish parliamentarism in the twentieth century. The author analyzes Polish constitutional regulations and parliamentary practice, with a particular focus on the solutions adopted in the years 1919–1935, as well the impact of these regulations on the evolution of Polish parliamentarism after the Second World War, also taking into account the current political experiences. The analysis leads the author to the conclusion, that the contemporary defects of the system of parliamentary government are to a large extent the result of the historical experiences of Polish parliamentarism.

Artykuł koncentruje się na problematyce prawnych regulacji sejmowego postępowania ustawodawczego w zakresie odnoszącym się do realizowania przez posłów prawa do wnoszenia poprawek do rządowych projektów ustaw. Analiza postanowień Konstytucji z 2 kwietnia 1997 r. oraz Regulaminu Sejmu z 1992 r. dowodzi, iż obowiązujące regulacje prawne, zarówno w odniesieniu do tzw. zwykłych projektów ustaw jak i projektu ustawy budżetowej stwarzają posłom duże możliwości ingerowania w treść rządowych propozycji legislacyjnych zarówno na etapie pierwszego jak i drugiego czytania ustawy. Stwarza to poważne niebezpieczeństwo dla integralności materialnej projektów jak również ogranicza efektywność prowadzonej przez rząd polityki. Dotychczasowe zmiany Regulaminu Sejmu, wprowadzone w celu ograniczenia oddziaływania poselskich poprawek na treść rządowych projektów okazały się nie dość skuteczne, stąd Autor postuluje dalszą modernizację postępowania ustawodawczego, zmierzającą do zagwarantowania skutecznej ochrony rządowych projektów przed ich deformacją w sejmowym postępowaniu ustawodawczym.
The article concentrates on the issue of regulations of legislative proceedings in the Sejm in the scope of the right of Members of Parliament to put forward amendments to government bills. Analysis of the provisions of the Constitution of April 2, 1997 and of the Standing Orders of the Sejm of 1992 proves that the current regulations, both with reference to the so-called regular bills, as well as the draft of the budget act, create great possibilities for Members of Parliament to make changes to the government legislative proposals during the stages of the first and the second reading of a bill. This creates a serious threat to the material integrity of the projects, as well as limits the effectiveness of the policy conducted by the government. The previous amendments to the Standing Orders of the Sejm made in order to limit the influence of MP’s amendments on the contents of government projects proved to be not effective enough; therefore, the Author calls for the further modernization of legislative proceedings aimed at guaranteeing effective protection of government projects against their deformation during the legislative proceedings in the Sejm.

The article refers to the status of the Marshal of the Sejm, especially with regard to his position as a „guard of the Sejm”. The Author characterizes Marshal competences con-nected with watching over peace and order within the Sejm, both in terms of legal status and parliamentary practice. In the context of the practice of the previous term of office of the Sejm, he draws attention to the numerous cases of the Marshal using his proce-dural powers in a way that favours deputies of the fraction represented by the Marshal and their abuse against opposition deputies.

Prezentowana publikacja stanowi próbę określenia podstawowych wyznaczników miejsca i roli ustawy budżetowej w systemie ustrojowym RP z perspektywy doktryny prawa finansowego i konstytucyjnego jednocześnie. Ustawa budżetowa stanowi jeden z najważniejszych programowych dokumentów państwa, na którym w znacznej mierze rząd opiera prowadzenie gospodarki finansowej w danym roku budżetowym. Rada Ministrów, jak i jej członkowie ponoszą polityczną odpowiedzialność za opracowanie projektu ustawy budżetowej, terminowe wniesienie go do Sejmu, a po rozpoczęciu roku budżetowego realizację postanowień uchwalonej na podstawie tego projektu ustawy oraz sprawozdanie z jej wykonania. Trudności i wątpliwości w zakresie procedury budżetowej i realizacji ustawowego obowiązku Rady Ministrów dotyczącego złożenia projektu ustawy budżetowej w określonym terminie rodzi jego zbieg z terminem wyborów parlamentarnych i wynikającą stąd możliwą zmianą układu sił politycznych i w konsekwencji rządu. Istniejący stan prawny nie eliminuje całkowicie, choć istotnie ogranicza poprzez tzw. procedury awaryjne, sytuacje w której pomimo rozpoczęcia roku budżetowego brak jest budżetu państwa lub jego dopuszczanego normatywnie surogatu. Zasadne wydaje się wprowadzenie regulacji konstytucyjnych i ustawowych, które stanowiłyby ostateczne rozwiązanie sytuacji braku podstaw normatywnych prowadzenia gospodarki finansowej państwa i wykluczenie zjawiska tzw. próżni budżetowej.
The presented publication is an attempt to determine, from the perspective of the financial and constitutional law at the same time, the basic place and role that the budget act has in the political system of the Republic of Poland. The budget act is one of the most important programme documents of the state, on the basis of which the government manages the financial economy in a large measure. The Cabinet of the Republic of Poland, together with its ministers, is politically responsible for drawing up the budget bill, submitting it to the Sejm promptly and – after the budget year commences – executing the regulations after passing the bill, and finally reporting on how the regulations were executed. Difficulties and doubts that arise when concerning the budget procedure and carrying out the duty of the Cabinet to submit the budget bill in a given time limit are due to the fact that this deadline coincides with the parliamentary election, which could cause a possible change in the line-up in politics and, consequently, in the government. The existing legislature does not entirely eliminate (however, through the so-called emergency procedures, it does considerably minimise the risk of) a situation when, although the budget year commences, neither the state budget nor its normatively acceptable substitute is passed. It seems advisable to implement constitutional and statutory regulations that would be the solution to the lack of the normative fundamentals to carry out the financial policy of the state and eliminate the situation of the so-called budget void.
