L’ANALYSE JURILINGUISTIQUE EN TRADUCTION, EXERCICE DE DROIT COMPARÉ. TRADUIRE LA LETTRE OU «L’ESPRIT DES LOIS»? LE CAS DU CODE NAPOLÉON

Le texte traduit reflète parfois la tradition d’écriture du droit visé, mais l’équivalence du message juridique, elle, doit être réalisée. La traduction du droit vers une culture juridique différente ne peut se faire sans analyse comparée des droits, dont la connaissance est requise pour réaliser l’équivalence juridique. La forme linguistique du texte cible doit néanmoins correspondre à sa culture. La traduction juridique est alors le point de rencontre entre langues, cultures et droits. Pour advenir, cette rencontre doit reposer sur une connaissance ad hoc des droits en présence. Entre alors en jeu le droit comparé, « compagnon de route » du traducteur, qu’il prépare à l’échange. Pour le réaliser, « il suffit de deux réceptions qui s’entrecroisent» (Carbonnier). Cette opération connaît le succès lorsque concepts et notions se recoupent et que la lettre du droit (le fond) et son expression (la forme) se fondent, illustrant «l’esprit des lois». L’analyse comparative est le moyen d’atteindre ce résultat. Elle est conduite ici sous l’éclairage de la jurilinguistique par l’analyse de termes et notions présentant diverses difficultés de traduction, démontrant la nécessité du droit comparé (I). Une comparaison de traductions du Code Napoléon et d'autres codes civils complètera la quête de l’esprit des lois par la manière dont est rendue la lettre ou l’esprit du texte à traduire (II). Les leçons à tirer s’adressent aux langagiers. Ils trouveront dans la méthode d’analyse comparative de la jurilinguistique matière à perfectionner leurs travaux et, dans les traductions des codes civils, une base de réflexion sur le rôle et la fonction de la traduction.

Przełożenie prawa na inną kulturę prawną polega na analizie porównawczej przepisów właściwych, których opanowanie jest konieczne do uzyskania ekwiwalencji. Forma tekstu docelowego musi również odpowiadać jego kulturze prawnej. Tłumaczenie prawne jest zatem miejscem spotkań języków, kultur i praw. By było ono efektywne, musi się opierać na wiedzy ad hoc w zakresie obu przepisów. W tym momencie w sukurs przychodzi prawo porównawcze, „towarzysz podróży” tłumacza prawnego i prawniczego, którego przygotowuje do przekładu. Aby to zrozumieć, „wystarczą dwa styczne podejścia” (Carbonnier) – gdy idee i pojęcia nakładają się, a litera prawa (substancja) i wyrażenie prawa (forma) łączą się, pokazując „ducha praw”. Sposobem na osiągnięcie tego celu jest benchmarking, który uwidacznia się w świetle jurysdykcji w drodze analizy terminów i pojęć. Przedstawiają one różne trudności w tłumaczeniu, które dowodzą konieczności odwoływania się do prawa porównawczego (I). Porównanie tłumaczeń Kodeksu cywilnego pozwoli prześledzić poszukiwania jak najlepszego przekładu (II). Wnioski skierowane są do profesjonalistów językowych, którzy w porównawczej analizie prawnej znajdą sposób na udoskonalenie swojej pracy, a w tłumaczeniach Kodeksu cywilnego podstawę do refleksji nad rolą i funkcjami tłumaczenia.

Translated texts sometimes reflect the targeted legal system’s conventional manner of writing law; however, the equivalence of the legal message must be realized. Translating law into another legal culture goes through a comparative analysis of the laws involved, the command of which is needed to achieve legal equivalence. The form of the target text must nevertheless correspond to its legal culture. Legal translation is then the meeting point of languages, cultures and laws. To succeed, this meeting must be based on an ad hoc knowledge of both laws. Then comparative law enters into play as the legal translator’s “fellow traveler”, whom it equips for the exchange. To realize it, “two intersecting receptions will suffice” (Carbonnier). This operation is successful when concepts and notions overlap and the letter of the law (the substance) and the law’s expression (the form) merge, demonstrating “the spirit of the laws”. Benchmarking is the way to reach this goal. It is conducted here under the light of jurilinguistics via the analysis of terms and concepts presenting various translation difficulties, which demonstrate the necessity of comparative law (I). A comparison of translations of the Napoleonic Code and other civil codes will complete the quest for the spirit of the laws by the way in which the letter or the spirit of the text to be translated is rendered (II). The lessons to be learned are aimed at language professionals, who will find in jurilinguistic comparative analysis a way to perfecting their work and, in the translations of the civil codes, a basis of reflection on the role and functions of translation.
