Artykuł stanowi próbę poznania i wyjaśnienia zakresu ingerencji harmonizacyjnej Unii Europejskiej w porządki prawne państw członkowskich. Przyjęto w nim
i wykazano, że granice możliwości stanowienia prawa przez UE są niejednoznaczne
oraz że w konsekwencji konieczne jest kontrolowanie zakresu samoograniczenia
się państw członkowskich w wykonywaniu ich suwerenności w zakresie stanowienia
prawa. Obszar badawczy stanowią kwestie dotyczące analizy i weryfikacji zagadnień,
mających na celu ustalenie zakresu i ograniczeń kompetencji Unii do harmonizacji
porządków prawnych państw członkowskich. W artykule omówiono istotę samoograniczenia państw członkowskich w stanowieniu prawa, polegającą na przekazaniu Unii
kompetencji z tego zakresu. Przedstawiono również zakres upoważnienia Unii do
ingerencji w porządki prawne państw członkowskich i wskazano granice jej uprawnień. W konsekwencji wskazano, że Unia winna stopniować intensywność swojej
ingerencji w zależności od tego, jak silnie dany zakres przedmiotowy determinuje
tożsamość konstytucyjną państwa i dotyka jego praw jako suwerena. Podkreślono
także i uzasadniono rolę parlamentów narodowych państw członkowskich, które
posiadają traktatowe uprawnienia, pozwalające na aktywne strzeżenie swoich państw
przed nadmierną ingerencją Unii.
The article attempts to recognize and to explain the scope of the harmonizing
interference of the European Union into legal orders of its member states. It is
assumed and proved that the limitations on the EU legislation are indefinite; it is
therefore necessary for the member states to control the scope of self-restraining
their sovereignty regarding legislation. The research field covers issues connected
with the analysis and verification of questions that aim to determine the limits of
the European Union’s competence to harmonize member states’ legal orders. Thus,
the phenomenon of member states’ self-restraining regarding their legislation is
introduced and characterized as a transfer of competence in the field in question.
Next, the authorization of the European Union to interfere in law orders of its
member states is shortly described and its limits are indicated. In consequence, it
is proved that the Union should gradually change the intensity of its interference
depending on how the specific law area determines the constitutional identity of
states and touches their authority as sovereign entities. Then, the role of the national
parliaments having the treaty entitlement to protect their states from an excessive
interference of the EU is highlighted and substantiated.
